There were 238 corporate insolvencies in Q3 2024, up 60% compared to the same quarter in 2023, according to new figures published by Deloitte. This brings the total number of insolvencies in the first three quarters of 2024 to 650, up by 36% compared to the same period in 2023. Commenting on the latest statistics, James Anderson, Turnaround & Restructuring Partner, Deloitte Ireland, said: "In Deloitte's last quarterly update we forecasted that Ireland was on course for more than 800 insolvencies in 2024, but it is now likely that it will be closer to 900. At the current activity level, corporate insolvencies in 2024 are on track to be 30% greater than in 2023, with forecasted activity to be in line with 2017, which had 874 appointments. SMEs continue to be disproportionately affected, accounting for 98% of activity levels. The hospitality and retail sectors accounted for 28% of activity levels in 2024 both of which significantly increased from the same period in 2023. These stark figures reinforce how the cost of doing business in Ireland in recent years has significantly increased. More tailored supports and reliefs are required to support SMEs in Ireland." The increase in insolvencies year-to-date Q3 2024 is driven by Creditor's Voluntary Liquidation (CVL) activity, which saw a 38% increase compared with the same period last year. Nearly all insolvencies in Q3 2024 were SMEs (98%), which is the same as H1 2024 corporate insolvency figures. Small Companies Administrative Rescue Process (SCARP) There have been 9 SCARP appointments in Q3, bringing the total to 22 in 2024 and saving 272 jobs. The number of appointments is the same as 2023. Since its introduction, there have been 77 SCARP appointments. Anderson said: "I would encourage SMEs (and their advisors) to consider SCARP as a viable option to supporting businesses and saving jobs. The low number of companies using the process does not align with the positive impact and outcomes that the scheme has had." Sector focus As in previous periods, the wide-ranging services sector accounts for the highest proportion of corporate insolvencies by the end of Q4 2023 with 237 insolvencies, representing 36% of total insolvencies recorded in the first 9 months of the year. Within the services sector, financial services and holding companies account for the highest incidence of insolvencies with 76 so far in 2024. Other notable services sub-sectors were Technical and Professional Services with 41 Insolvencies, real estate with 30 insolvencies and Entertainment with 20 insolvencies. The hospitality sector continues to see significant increases in insolvencies - with 108 so far in 2024, which is 61% up from the same period in 2023 (67) and significantly higher than the same periods in 2021 and 2022 when there were just 26 hospitality insolvencies. This is likely due to similar trends seen throughout the year, including increased labour and energy costs, as well as the VAT rate at 13.5% and insurance costs. The remainder of the insolvencies were spread amongst the other sectors, with 74 in Retail, 67 in Construction, 33 in Manufacturing, 29 in Transport, 28 in IT, 19 in wholesale and the remainder in other business sectors. Regional focus Leinster had the highest number of insolvencies in 2024 to date with 504 (78% of all insolvencies), as expected. There were 82 (13%) in Munster, 55 (8%) in Connacht, and 9 in Ulster (Republic of Ireland only). There were 412 corporate insolvencies in H1 2024, up 25% compared to this time last year and the highest half-yearly corporate insolvency figure since H1 2018 (435). Commenting on the latest statistics, James Anderson, Turnaround & Restructuring Partner, Deloitte Ireland, said: "These figures put Ireland on course for more than 800 insolvencies this year, as forecasted in our Q1 Insolvency & Restructuring Statistics. This is an increase of 25% on 2023 activity levels and would represent the highest number of insolvencies since 2017, when the figure was 874." The increase in H1 2024 is driven by Creditors' Voluntary Liquidation (CLV) activity, which saw a 33% increase compared with H1 2023 (323 CLVs in H1 2024 vs 243 in H1 2023). Nearly all insolvencies in H1 2024 were SMEs (98%). SCARP There have been 13 SCARP appointments to date in 2024, which is down from 17 in H1 2023. There have been 68 SCARP appointments since its introduction at the end of 2021 and it has a success rate of 70%, saving 672 jobs to date. Anderson said: "The drop in SCARP appointments compared to last year is very concerning. This scheme continues to attract low numbers of companies despite the positive impact it has had on those who have used it. We know SCARP can be successful in saving jobs and we would urge the Government to further invest in raising awareness of this process and its benefits." Debt warehousing Almost 90% of the €1.65 billion debt that remained in the warehouse at the start of April 2024 was either paid in full, secured under phased payment arrangements or included within a proposed phased payment arrangement, according to Revenue in May. Anderson said: "The debt warehousing scheme supported businesses in Ireland during a difficult and uncertain period. The vast majority of companies who availed of it are now either engaging with Revenue or have cleared off their debts. This shows it was a good decision to introduce it and confirms that such emergency measures for businesses can have a positive impact during turbulent times." Sector focus There were 77 insolvencies in the hospitality sector in H1 2024, which is a significant increase of 88% from H1 2023. This is likely due to similar trends in Q1, including increased labour and energy costs, as well as the VAT rate at 13.5% and insurance costs. The mandatory Pension Scheme will come into operation in September of this year. These factors, together with the overall higher cost of living impacting discretionary spend, is likely to see continued distress in the hospitality industry for the remainder of 2024. Anderson said: "We're nearly one year on since the VAT rate of 13.5% was reintroduced for the retail and hospitality sector and we're seeing the remarkable impact costs such as these are having on the businesses involved." Regional focus Leinster had the highest number of insolvencies in H1 2024 (321), as expected, and recorded a 27% increase compared to H1 2023. There were 46 in Munster, 40 in Connacht, and 5 in Ulster (Republic of Ireland only). 2024 forecast Based on the activity levels in H1 2024, corporate insolvency activity in 2024 is forecasted to surpass 800 appointments. This represents a 25% increase on 2023 activity levels and the highest level in six years. Based on the appointments in H1 2024, SMEs will likely continue to be the most impacted, and the Hospitality and Retail Sectors are likely to experience continued restructuring activity in 2024.

But it's been almost 2 years since the introduction of the new Small Company Administrative Rescue Process - known as SCARP, which has radically simplified and shortened the insolvency process for SMEs. Today the accountancy firm formerly known as Baker Tilly and now known as Azets published its SCARP index, which claims that 561 jobs have been saved as a direct result of the new scheme. 3.00" Neil Hughes, Managing Partner of Baker Tilly Ireland explains SCARP, the newly enacted examinership system for smaller businesses. H says that this fundamental change in company law is a 'once in a lifetime' event. He says there are tens of thousands, maybe hundreds of thousands of businesses who have been brought to their knees during Covid. The process takes less than 70 days - but a scheme could be in place within 42 days (compared to up to 150 days, plus hefty legal fees, in examinership). He calls it a 'short, sharp, SCARP. Neil explains where the name came from (strange!) but he says that SCARP is here to stay. He talks about the Retail Excellence Ireland survey of members and their rental arrears and what that means for SMEs. He reckons that the initial up-front costs should be much, much lower and also that the process is far more private than the open court Examinership system. This more discrete system means that predatory Interlopers won't be able to know that businesses they might want to scoop up are going through the process. Dept of Jobs still has to allow enabling legislation, so we won't see SCARP really kick in until 2022. The process is EU driven to give business owners a second chance. The legislation is similar to Australian law where it works very well. He says that Ireland is now a leader in restructuring law worldwide - a big turnaround from some years back.Neil's hire in a heartbeat? (He gives a very circuitous answer, but eventually plumps for rowing gold medallist Paul O'Donovan29.30" Shane Kiernan, founder of IAMUS Technologies, says that his company will be a €1 billion business in the next six years! He was a posh City banker but now gets his hands dirty (literally) working occasionally in chicken coops that are the size of football pitches and house 50,000 broiler chickens. Shane started his entrepreneur journey in school, running an unofficial (and not sanctioned!) tuck shop. He delivered goods from Northern Ireland, during which time he was interviewed by broadcaster Gerry Ryan, an chat that led to 5,000 emails in his inbox the following morning. He worked with the Bill Clinton Foundation and has met the US President twice. This brought him to Kenya but that's another story...He established a business in the Philippines employing 220 people. He tells us that 2,000 chickens are eaten every SECOND around the world and this has led to producers looking for ways to produce more, better. He has had help from poultry entrepreneur Vincent Carton who showed him a major gap in the market. He says that his robots are gender neutral! IAMUS are funding at the moment and want to talk to TeamGBS about investing in his business. There are 350,000 chicken sheds around the world so he says it's a massive investment opportunity, so he's trying to raise $2 million to kick off his international business. He talks about Cargill's massive recent investment in the US chicken industry. His business is not selling individual robots, but he sells his robotic solutions, what he calls Robotics as a Service. He talks about his involvement with the Techstars accelerators. He aims to have 3,300 robots manufactured by 2025. He's using IFAC to help raise funds. And Shane's 'hire in a heartbeat'? Oxford don, Dr Marian Dawkins.54.00" Jeud Ennis of Signworks.ie. Her dad got her into the business of painting grass, or more correctly painting logos on grass on pitches. A logo is painted by her team in two days, She started with Croke Park and then, by chance, met a South African at a UK tradeshow who introduced her to 3D painting of brand logos. Her first 3D logo was for Royal Liver. She explains that stadium managers don't always appreciate her painting her grass. She gives a shout out to her brothers who run a company called Sportsworks.ie that is involved in pitch maintenance and more. She can turn around 3 logos in a couple of days with a crew of 4. Rain can destroy logos and she explains how she handles marketing managers about distorted logo colours. She loved to pick up business across Europe and Dubai (she's been on holidays there and loves the place). Adam Sears, of the progressive rock band Lobate Scarp, helps Steve name his new podcast! Together, they discuss the value of creating meaningful work that can make an impression on others or make the world a better place. Many starting out in the music industry might not have the means to create the caliber of music they'd like to. Adam and Steve share stories of navigating these challenges while creating Lobate Scarp's album on limited funds including cancelling family vacations for jobs (Adam was halfway to Arizona when he was offered a part in MTV's Matrix Reloaded Spoof!), testing out crowdfunding and working with Adam's dream mixer, Rich Mouser. Steve jokes that “If you want work in the entertainment business, book a vacation.” They also begin to dive a bit into dark matter and dark energy. It's between the galaxies and what hold them together. We can't see it, but could it be like the 5th dimension?
