I'm new to Arizona. We moved here from Florida for a number of reasons, chief among them was the fact that AZ was trending bluer while FL has become Fascist Central. Well, yesterday Arizona's Supreme Court reinstated a law that was in effect until 1973 when Roe v Wade came into effect and legalized a woman's right to choose what happens with her own body. Since that 1864 law was never officially removed from the books it was still in effect once Roe was overturned. ARGHH. I attempted to get some AZ officials and others to discuss the ramifications of yesterday's news to no avail. That makes sense as I'm guessing this is an all hands on deck moment. So, I thought back to how we dealt with the Supreme Court overturning Roe two years ago. It was June 24, 2022 when they did the unthinkable. The following Monday, June 27, I spoke with the man regarded as the father of the birth control and abortion rights movement, Bill Baird. I was introduced to him by the always brilliant Barry W. Lynne. When we spoke almost two years ago, Bill had just turned 90! As is too often the case, we had some technical difficulties, but it's worth hanging through them to meet and learn about Bill Baird. I hope he will give you the inspiration he's given me during incredibly awful times like these.... We'll begin with a song from Jill Sobule that she wrote after Texas enacted its disgusting Fetal Heartbeat bill that outlawed abortion after six weeks. (From Wikipedia: The Texas Heartbeat Act, Senate Bill 8 (SB 8), is an act of the Texas Legislature that bans abortion after the detection of embryonic or fetal cardiac activity, which normally occurs after about six weeks of pregnancy. The law took effect on September 1, 2021, after the U.S. Supreme Court denied a request for emergency relief from Texas abortion providers.[1] It was the first time a state has successfully imposed a six-week abortion ban since Roe v. Wade, and the first abortion restriction to rely solely on enforcement by private individuals through civil lawsuits, rather than having state officials enforce the law with criminal or civil penalties. The 4-1 ruling is a victory for pro-life legislators in the state, which passed a similar law in 2021. It's all balderdash. These are stories to frighten people into opposing the Texas law on abortions. The “mechanism” of private enforcement only relates to breaking a law and won't even apply in the case of abortions after a fetal heartbeat is detected if that law is struck down by the courts. It simply cannot be used to enforce something that is not a legally passed and binding law. For example, California can't simply decide that citizens can sue gun makers for the use of guns in crimes because such is counter the Protection of Lawful Commerce in Arms Act. Any such cases would not stand review by courts if they attempt to punish someone for something protected by law. When state lawmakers return to Columbia next week the House of Representatives is expected to debate the Fetal Heartbeat Abortion bill. The measure, which has already been approved by the Senate, would forbid doctors from performing abortions once a fetal heartbeat is detected usually around the sixth week of pregnancy. The bill is expected to have little trouble passing in the Republican controlled House. Similar bills have passed in previous years. The bill could be signed into law by Governor McMaster as early as next week. Traveling behind the Heartbeat bill in the House is the Open Carry with Training Act. It would allow persons with concealed weapons permits to openly wear a handgun.

Once again this legislative session, conservative members of the SC General Assembly are attempting to restrict abortion in the state. A bill that would ban almost all abortions is being fast tracked in the State Senate. In past years abortion bills have been derailed in the upper chamber. But this session, with a new, stronger Republican majority, supporters hope to finally be able to pass the bill and send it to the House where it has passed before. This week the Senate’s Medical Affairs Committee narrowly approved Senate Bill 1 known as the "Fetal Heartbeat Bill." It would make an abortion illegal if an ultrasound detects a heartbeat which can be heard as early as six to eight weeks into a woman’s pregnancy.

This year’s attempt by pro-life members of the state legislature to pass restrictions on abortions is centered in the House of Representatives. A bill that would ban almost all abortions if a fetal heartbeat is detected in a woman passed the House Judiciary Committee this week on a mostly party line vote. Experts say a fetal heartbeat can typically be detected around the sixth week of pregnancy. Similar laws have been enacted by other states as abortion foes hope to get a case before the US Supreme Court to challenge the 1973 Roe v Wade ruling. Georgia passed such a law last week. Democrats on the Republican controlled Judiciary Committee questioned supporters about why the state might ultimately have to spend money to defend a law similar to ones that federal courts have ruled un-constitutional.
