Después de un proceso de selección cuestionado por la falta de transparencia y en medio de dudas sobre su probidad, este domingo asumieron los 13 nuevos jueces de la Corte Suprema de Guatemala. RFI entrevistó al diputado del oficialismo Samuel Pérez y al profesor José Antonio Melville (UNAM).  Los nuevos magistrados, que integrarán la Corte hasta 2029, fueron juramentados y tomaron posesión de sus cargos en una solemne ceremonia celebrada este domingo en el Teatro Nacional de Ciudad de Guatemala.El presidente Bernardo Arévalo, quien asistió a la ceremonia, considera que el poder judicial guatemalteco ha estado "secuestrado por las mafias".Al igual que Arévalo, analistas y activistas denuncian que el llamado "Pacto de Corruptos", una supuesta red de políticos, fiscales, jueces y poderosos empresarios, maneja desde las sombras los hilos del poder e influye en las decisiones judiciales.Existe una gran incertidumbre sobre el rumbo que tomarán los jueces. Muchos albergan la esperanza de que se detenga la tendencia a criminalizar a los rivales políticos en el contexto del “Pacto de Corruptos”, cuya cara visible es la fiscal general, Consuelo Porras.Desde 2021, Porras ha abierto causas contra decenas de fiscales, jueces, periodistas y otros críticos del anterior presidente, el derechista Alejandro Giammattei (2020-2024). Giammattei extendió hasta 2026 el mandato de Porras, sancionada por "corrupta" y "antidemocrática" por Estados Unidos y la Unión Europea.Porras también abrió polémicas investigaciones contra Arévalo y las elecciones de 2023, lo que puso en riesgo la transición presidencial en enero pasado. Le preguntamos al diputado del oficialismo Samuel Pérez qué podría pasar con el caso Porras."Ese tema todavía hay que tratar de consensuarlo en el Congreso. De parte de nuestra bancada, seguimos permanentemente insistiendo en él. Sin embargo, hay que lograr los consensos dentro del Congreso. Eso todavía estará por verse y aún hay temas importantes pendientes de discutir, como la elección de la nueva Junta Directiva o el presupuesto para el próximo año", sostiene Pérez.José Antonio Melville, profesor de la UNAM y autor del libro La Formación del Estado en Guatemala: élites, corrupción y un auto en llamas, se muestra reservado sobre las designaciones, citando algunos casos específicos."Estas designaciones, al tratarse de personas que han estado dentro de los ensamblajes de poder en Guatemala, es normal que estén vinculadas con algún grupo de poder. Lo que es un hecho es que hay varios magistrados y magistradas que tienen una relación cercana con grupos que han sido señalados como corruptos. Es el caso de Roberto Alejos, por ejemplo, o del Rey del Tenis", quien me parece que tiene un familiar dentro de esta nueva magistratura. No sé si es prima o hermana, pero es de apellido Villatoro", señala Melville.En efecto, Carlos Rodimiro Lucero Paz, un magistrado cercano a Sergio Roberto López Villatoro (alias el “Rey del Tenis”), asumió temporalmente como presidente de la Corte Suprema.Para algunos analistas, la actitud de los nuevos jueces de la Corte Suprema dependerá en buena medida de la consolidación de la agenda "anticorrupción" del mandatario guatemalteco. Una debilidad de Arévalo no incentivaría a los magistrados a tomar una postura firme en ese frente. Sin embargo, también es posible una Corte Suprema distinta a la que han conocido los guatemaltecos, según Samuel Pérez."Hoy no existe una aplanadora dentro de la Corte. Hay ciertos contrapesos que van a permitir que se puedan llegar a consensos entre la mayoría. Esto siempre es positivo. Antes, en cambio, estábamos acostumbrados a ver una Corte Suprema que actuaba como una aplanadora, con el 100 % de las personas respondiendo a una visión completa e inadecuada de la aplicación de justicia, protegiendo a los amigos y persiguiendo con cárcel a los enemigos", concluye Pérez.

Una noche de julio de 2022, el joven Hernández estaba en su casa después de una jornada de trabajo en un restaurante local y se disponía a comer su cena. Esa noche, los soldados irrumpieron en su casa y pidieron que todos los hombres salieran. Solo se llevaron a Hernández a quien los militares amenazaban de muerte en el camino hacia el centro de detención local.  Hernández vive en una zona rural de Usulután y es el primer testimonio  de un menor de edad que El Faro ha logrado documentar desde el inicio del régimen de excepción. Durante 20 meses estuvo detenido al lado de algunos que como él eran menores de edad.  Vivió el castigo de la suspensión de alimentos. Cuando había requisas en las celdas, los custodios les robaban el dinero que sus familiares de escasos recursos recolectaban para que pudieran comprar algo en la cárcel. A Hernández le robaron dos veces un total de 60 dólares, eso significaba dos semanas de trabajo para  sus padres.  Obtuvo su carta de libertad en diciembre de 2023, pero fue liberado en febrero de 2024.  Días después de que Hernández regresó a casa, el ministro Villatoro dijo en una conferencia de prensa que 1194 menores de edad habían sido capturados desde marzo de 2022 y que muchos de ellos pagarían condenas de hasta 20 años de prisión.
