In Part 2 of this deep-dive series, Eric Green is joined again by former U.S. Department of Justice Tax Division attorney John Mulcahy for an unfiltered look at what really happens behind the scenes in a criminal tax case. This episode pulls back the curtain on the critical decision-making process inside the government—from how cases are reviewed and approved for prosecution to the high bar prosecutors must meet under the “reasonable probability of conviction” standard. John walks through what happens when IRS agents submit a case, how DOJ attorneys analyze evidence, and why some cases get sent back for further development before charges are ever filed.Eric and John also tackle one of the most important (and misunderstood) opportunities for defense attorneys: the pre-charging conference with the DOJ. They explain why these meetings matter, how they can change the trajectory of a case, and what prosecutors are really looking for before deciding whether to move forward with criminal charges. The conversation then shifts to strategy—covering proffers, reverse proffers, and how both sides use these tools to either build or defend a case. You'll hear real-world examples of how these interactions play out, including when they lead to declined prosecutions… and when they don't.Finally, the episode explores the realities of sentencing, restitution, and negotiation dynamics—breaking down how numbers drive outcomes, why simplicity matters in front of a jury, and how acceptance of responsibility can significantly impact a client's future.Whether you're a tax professional, attorney, or advisor, this episode delivers practical insight into navigating criminal exposure, advising clients effectively, and understanding how the government thinks at every stage of a case.If you haven't listened to Part 1 yet, start there—this is a continuation you won't want to miss.Want to contact John? What really happens when a tax case goes criminal? In this episode of the Tax Rep Network Podcast, host Eric Green sits down with former federal prosecutor John Mulcahy—now in private practice at Nixon Peabody—to pull back the curtain on how criminal tax cases are built, reviewed, and prosecuted.Drawing on over a decade of experience at the U.S. Attorney's Office and the DOJ's tax division, John walks through the lifecycle of a criminal tax case—from initial IRS investigation to DOJ review, grand jury proceedings, and ultimately, prosecution decisions. Along the way, he explains why the DOJ still plays a critical gatekeeping role and how consistency in tax enforcement is maintained nationwide. But this conversation goes beyond process. Eric and John dig into the real-world dynamics that shape outcomes: the discretion of Assistant U.S. Attorneys, the strategic decisions behind charging (or declining) a case, and the often misunderstood role of “willfulness” in tax crimes. Through candid stories and behind-the-scenes insights, they highlight how cases can turn on a single issue—especially intent—and why listening closely to clients can make or break a defense. Now on the defense side, John also shares what it's like transitioning from prosecutor to advocate—working with clients in crisis, navigating complex facts, and seeing firsthand that every case has more than one side.If you're a tax professional, attorney, or anyone curious about how criminal tax enforcement really works, this episode offers a rare insider perspective you won't hear anywhere else.Want to contact John? My guest on today's show is cofounder of Thriviae and Workplace Performance Strategist, Luke Mulcahy. For the last few years Luke and his team have been developing a revolutionary platform that help support organisations in tackling some of the most pressing challenges of the modern workplace. His recently published academic paper and research report introduces the Periodic Table of Workplace Thriving, which I have to say really spoke to my love of order and organisation. It structures 24 enablers and over 100 measurable elements that shape wellbeing, performance and development across organisations. We began by focusing on the tricky topic of PURPOSE. What this really means, why it's important, and some of the challenges in articulating it as well as creating teams where there is a shared sense of purpose. As predicted, our conversation ran into a number of different topics including belonging, multi-generational workforces, burnout and team cohesion. If you want to find out more about Luke and the work he is doing you can find him on LinkedIn and his website, and I recommend having a read of the white paper and academic paper if it's a topic you're interested in! With the ever-capable journeyman director Mulcahy at the helm, a sturdy script from Die Hard writer Steven E. de Souza, and committed performances from Denzel Washington and John Lithgow, the film finds a way to make every one of its scenes memorable by maintaining its ludicrous energy from start to finish and finding lurid thrills behind every corner. We begin with an appraisal of our experiences with Ricochet, and the delight of finding a film marketed as a boilerplate thriller doing everything it can to shock and disarm you. Then, we examine the deceptively intelligent plotting of the film, pitting Denzel's Assistant DA Nick Styles - an ambitious Black lawyer seeking opportunity in the justice system- against not just Lithgow's psycopathic murderer on a quest for revenge but also the collective biases of the media and elite centers of institutional power that readily see Styles as an interloper in their predominantly white spaces. Finally, we discuss the rare position of Denzel as a movie star, how he stands singularly as both an actor of profound versatility and one that inhabits an intoxicating Movie Star persona.Follow Bilge Ebiri on Twitter....Our Denzember theme some is "Funk" by Oppo.

Are you caught in a never-ending cycle of setting ambitious goals, feeling like you're not making progress fast enough, and ultimately burning out? You're not alone. As high achievers, we've been programmed to define "wins" in ways that actually fuel our exhaustion and feelings of inadequacy. In this revealing episode, Dr. Reana Mulcahy pulls back the curtain on one of the most insidious causes of burnout among high performers. Through a candid coaching session, she exposes the dangerous "worthiness loop" that traps us in the belief that we're only as valuable as our latest major accomplishment. When our projects require a longer timeline—whether that's mindset transformation, weight loss, or career development—we struggle to feel satisfied with our progress because we've been conditioned to only celebrate the finish line. This addiction to accomplishment isn't just uncomfortable—it's unsustainable. Dr. Mulcahy explains why so many of us become slaves to our to-do lists, sometimes even writing down tasks we've already completed just for the satisfaction of crossing them off. This behavior reveals our deeper need for validation and the false belief that productivity equals worth. But what if a win didn't have to mean a completed project or external recognition? What if showing up, taking one small step, and becoming the person you want to be counted just as much?Drawing from her experience of burning out twice and helping countless clients break free from this cycle, Dr. Mulcahy offers a powerful reframe that can transform your relationship with achievement. Discover how the most successful people in the world approach their goals from the inside out, and how you can apply the same principles to experience sustainable success without sacrificing your wellbeing along the way. There can be only one! Well, unless there's a bunch of money up for grabs in making a sequel! Or that was the plan at last. Dave's next entry for the year of the stitch-up is the 1991 sequel to the cult classic, Highlander II: The Quickening. The production of Highlander II: The Quickening is often cited as a masterclass in cinematic chaos. Shot primarily in Argentina, the film was plagued by financial problems from the outset. The country's volatile economy led to massive inflation during production, and the financiers seized control of the project from director Russell Mulcahy. With the original vision compromised, the resulting film veered far from the tone and mythology of the first Highlander, introducing a sci-fi backstory about aliens that baffled fans and critics alike. Mulcahy was so frustrated with the interference that he reportedly tried to have his name removed from the project altogether.Despite returning stars like Christopher Lambert and Sean Connery, the film's confusing script, drastic re-editing, and overreliance on shoddy visual effects left many scratching their heads. The disarray behind the scenes prompted several later attempts to salvage the movie, including the release of the Renegade Version in 1995 and The Special Edition in 2004, both of which removed the alien subplot and tried to realign the story closer to the original's spirit. However, the damage to the franchise's reputation had already been done. Over time, Highlander II has gained a cult following—albeit more for its notorious infamy than its cinematic merit. If you enjoy the show we have a Patreon, so become a supporter.www.patreon.com/thevhsstrikesbackTrailer Guy Plot SummaryIn a world where immortals once battled across centuries, Highlander II: The Quickening takes a wild detour into the future—because why not? Earth is dying, the ozone layer is toast, and Connor MacLeod, now a weary old man, must rise again when an evil tyrant from another planet—yes, another planet—sends assassins to finish what they started. Joined by his resurrected mentor Ramirez, they'll slash their way through sci-fi nonsense, corporate villains, and the laws of continuity itself… because this time, being immortal just isn't confusing enough. Buckle up—this isn't the sequel you asked for, it's the one that leaves you asking, what just happened?thevhsstrikesback@gmail.comhttps://linktr.ee/vhsstrikesback
