However, the special counsel concluded the evidence does not establish Mr. Biden's guilty beyond a reasonable doubt, therefore prosecution would be unwarranted. In not charging President Biden, Hur reasoned it was because he would present to a jury as an elderly man “with a poor memory.” That may hurt in an election year where age is becoming an issue.
