A memorandum in support of a request for dismissal of a complaint is a legal document submitted to a court that outlines the reasons why a complaint should be dismissed. This type of memorandum is typically prepared by the defendant or their legal counsel and presented to the court as part of the pre-trial proceedings. In this document, the defendant usually provides legal arguments and evidence to support their request for dismissal. This could include demonstrating that the complaint fails to state a valid legal claim, that there is a lack of jurisdiction, or that there are other legal grounds for dismissal. The memorandum serves as a persuasive tool for the court, aiming to convince the judge that the complaint does not have merit and should not proceed to trial. It is important for the memorandum to be well-researched, clearly written, and supported by relevant legal precedent. In this episode we begin our look at the UMG memorandum in support of dismissing the complaint filed against them by Rodney Jones. to contact me:bobbycapucci@protonmail.comsource:gov.uscourts.nysd.616406.41.0.pdf (courtlistener.com)Become a supporter of this podcast: https://www.spreaker.com/podcast/the-epstein-chronicles--5003294/support.

In the lawsuit filed by Rodney "Lil Rod" Jones against Diddy and associated entities, Universal Music Group (UMG) and its representatives, including Martha Brathwaite, have made significant moves to distance the label from the allegations. Jones accuses Diddy of various forms of misconduct, including an alleged shooting incident at a 2022 writing camp. In response, UMG's legal team, supported by Brathwaite's declaration, asserts that UMG and Motown Records were not responsible for organizing or providing security for the camp where the alleged shooting took place.Brathwaite's declaration clarifies that Diddy's Love Records, not UMG or Motown, oversaw and financed the camp, arguing that UMG should not be held accountable for any security failures or incidents that occurred. The label's legal filings aim to have UMG dismissed from the case, contending that Jones is inappropriately attempting to involve the label despite its lack of operational control or direct involvement in the events under dispute.Additionally, the legal strategy seeks to prevent the lawsuit from being amended further, with UMG lawyers arguing that any additional claims would be futile. The case exemplifies how UMG and other corporate entities named in the lawsuit are seeking to limit their exposure and sever any implied connections to Diddy's alleged misconduct during these events. This legal push reflects the complexities of liability when artists manage multiple companies across overlapping spheres.(commercial at 8:36)to contact me:bobbycapucci@protonmail.com

Universal Music Group (UMG) and its CEO Lucian Grainge were dismissed from a lawsuit involving Sean "Diddy" Combs after the plaintiff's lawyer admitted there was "no legal basis" for the claims. The lawsuit, initially filed by producer Rodney "Lil Rod" Jones, accused Diddy of sexual assault and harassment during the production of Diddy's 2023 "The Love Album." It also implicated UMG and Grainge in a broader conspiracy under the RICO statute and sex trafficking laws.UMG's legal team had argued the claims were baseless and intended to seek legal penalties against Tyrone Blackburn, Jones' attorney, for including them in the suit. In May 2024, Blackburn acknowledged the lack of legal foundation for the allegations against UMG and Grainge, requesting their dismissal with prejudice, which prevents future refiling. UMG's lead attorney, Donald Zakarin, criticized Blackburn for bringing unfounded accusations that he described as "recklessly false" and potentially libelous outside the context of a legal complaint.Despite the dismissal of UMG and Grainge from the lawsuit, Diddy continues to face multiple abuse allegations, which he has strongly denied. In this episode, we take a look at the timeline relating to the Rule 11 sanctions.(commercial at 7:04)to contact me:bobbycapucci@protonmail.comsource:gov.uscourts.nysd.616406.61.1.pdf (courtlistener.com)Become a supporter of this podcast: https://www.spreaker.com/podcast/the-epstein-chronicles--5003294/support.

This legal push reflects the complexities of liability when artists manage multiple companies across overlapping spheres.(commercial at 9:05)to contact me:bobbycapucci@protonmail.comBecome a supporter of this podcast: https://www.spreaker.com/podcast/the-epstein-chronicles--5003294/support.
Tom Stingemore is one of the most knowledgeable minds in music sync licensing. He was President of Sync at Hipgnosis, the multi-billion dollar music catalog fund that owns thousands of No. 1 songs. Before that, he was SVP of Sync at BMG and Creative Director of Sync at Universal Music Group. In this episode, we link up in London to talk about Tom's new company, Alloy, and his mission to fix one of the biggest problems in sync: bad data. We break down what music sync is, how it works, what's broken in the current system, and how it can be improved. Whether you're a music supervisor, artist, producer, or just curious about how songs get placed in film, TV, ads, and games—this episode will give you a deep understanding of the sync world today and where it's going. The Commonwealth has filed motions asking for things she said to reporters during interviews and the Discovery ID Docuseries. The Federal Appeal is pending as well as a decision on the Motion to Dismiss the entire case. 911 calls in the Bryan Kohberger case have been revealed as well as Amazon purchases in the Motions in Limine. UMG filed a motion to dismiss Drake's case ultimately stating that he lost a rap battle that he willingly participated in. The concept of defamation in rap music, hyperbole, and opinion versus factual statements are challenged in this filing and it's a great read. The Lively and Baldoni cases have been getting more movement as many parties filed motions to dismiss. We'll see what happens next. The latest, most brutal entry in the rap battle between Kendrick Lamar and Drake comes in the form of a motion to dismiss. Drake, you will remember, sued Lamar's record label (which is also Drake's record label) for defamation, alleging that Lamar's hit single “Not Like Us” defames him by calling him a pedophile. But as UMG's attorney Rollin Ransom points out, rap battles are well known to feature hyperbolic accusations and insults that are not necessarily factual, which means they are unlikely to be defamatory. Plus, Drake explicitly dared Lamar to call him a pedophile — or, more specifically, Drake released a track in which he used an AI-generated Tupac Shakur voice to urge Lamar to “talk about [Drake] likin' young girls.” It's all very embarrassing, but as Ken notes, while UMG has a strong argument that it did not assist in defaming its own client, their argument is one a judge might not agree to consider in its entirety at this stage in the case.Plus: Trump tries to give Paul Weiss the Perkins Coie treatment, several of Trump's major executive actions are facing new roadblocks in the courts, Nancy Mace faces a defamation lawsuit where the speech or debate clause is likely to provide her an important shield, and Ed Martin continues to Ed Martin.Visit serioustrouble.show to find a transcript of this episode, relevant links and to sign up for our newsletter.
