Dallas Drug Crime Defense Attorney, John Helms Answers.It is important to understand that when a person is arrested for possession with intent to distribute drugs or conspiracy to distribute drugs, this does not necessarily mean that the government thinks the person's entire life is being a drug dealer. A person can be charged with a federal drug crime even if they have only been involved in one or two drug deals or if all they have done is carry drugs from one person to another. In other words, people who are not full-time drug dealers can be charged with federal drug crimes. This is because it is illegal to make only one drug deal or to carry drugs for someone even one time. To many people, this does not seem fair. Why can someone who has had little involvement with drug dealing be charged with the same crime as a drug kingpin? The answer is that the crime is the same, but the punishment will be different.The first question, of course, is whether the government can really prove that the accused is guilty of the crime beyond a reasonable doubt. In 2014, then-23 year-old Morgan Godvin sold a small amount of heroin to her friend and fellow drug user Justin DeLong who subsequently overdosed and died. Morgan was charged by the federal government for “drug delivery resulting in death” and served five years in prison––despite Justin's family pleading for leniency. Now out of prison and majoring in community health education at the OHSU-PSU School of Public Health, Godvin is on a mission to raise awareness of the hyper-punitive rise of “drug induced homicide” prosecutions. She joins us this week along with special guest host Leo Beletsky, a professor of Law and Health Sciences at Northeastern University, to discuss what activists are doing to push back against the latest trend in Tough on Drug Crime cruelty.

A key talking point of Gov. Tony Evers' “first step” proposal to legalize medical and recreational marijuana went up in smoke last week. In rolling out his wide-ranging initiative, the governor and fellow Democrats declared “drug-related offenses make up as much as 75-85% of inmate populations.” The claim is patently false - the real stat is 11%.
