Constitutional Conventions: Theories, Practices and Dynamics (Routledge, 2025) is an excellent edited volume exploring the various ways in which governments and constitutional structures operate in the spaces that are not necessarily articulated in law, edict, or formal documents. This is not a text about the folks who gathered together in 1787 in Philadelphia, or even those who wrote new constitutional structures after the fall of the Berlin Wall. Conventions means the rules that govern the interactions between political actors and the governments they inhabit. In many ways, this refers to the kinds of norms that have grown up around different parts of the systems of government. The strength and endurance of those rules or norms can change over time and in response to crises or dynamic changes. Constitutional Conventions: Theories, Practices, and Dynamics explores these thick and thin dimensions of the governing structures from a comparative perspective, taking up Anglo and American systems in the United States, the United Kingdom, and Australia. The book also examines the cases of Hungary and Czechia (the Czech Republic), two post-Cold War systems; and finally, also, China. In considering these constitutional conventions, we can think of them as structures or engagement that is not enforced by the courts, since these are not, per se, written constitutional laws. In long standing liberal democracies, there is an inclination towards adhering to conventions. But when these conventions are under strain, how they work, or maintain “regular order” becomes a critical test within the established governmental systems. Constitutional Conventions provides another dimension of significant interest in the discussion of how China works within these kinds of conventions within the process in which political individuals come up through the governmental and party systems and move into leadership roles. The comparative case study of Hungary and Czechia indicates that even in somewhat similar structures, the conventions and norms are not always the same. Constitutional Conventions: Theories, Practices, and Dynamics is an important analysis of the ways in which governmental structures work beyond what is written or built as the official system. The discussions cover theoretical, practical, and comparative dimensions of our understandings of the processes and functions of governments. Lilly J. It's been nearly 8 years since Samantha aka LiliAvacyn has been on the podcast. A lot has changed since their first episode, and now they're back for a second one! Send us a textAs part of the 75th anniversary series on the Gevena Conventions, Lauren Sanders speaks to André Smit - the ICRC Regional Legal Adviser on Maritime Matters (Asia-Pacific) when he visited Australia in September 2024. They discuss the applicability of Geneva Convention II (GC II) on the Amerlioraton to the region and challenges for states in applying their obligations under GC II in the event of a maritime conflict in the region. André supports the work of the International Committee of the Red Cross (ICRC) in Asia and the Pacific region from the ICRC Regional Resources Network (RRN) in Thailand. The role focusses on advancing the regional understanding of international humanitarian law applicable to armed conflict at sea, strengthening the application of other legal protection regimes at sea, supporting the work of other ICRC métiers and ICRC Delegations on related files, and supporting the ICRC institutional thinking on its future positioning in Asia and the Pacific. His work experience includes practising law; serving as officer in the South African National Defence Force; and service in the South African Foreign Ministry as counsel to Government on International Law. In the military, he served at unit-, training-, Joint Operations-, and Defence Headquarters-levels retiring as a senior officer supporting policy and international law. He provided operational legal support to operations and supported the force preparation of naval infantry, maritime air operations squadrons (helicopter and fixed wing), the submarine service. The culmination of his time as an instructor was serving as Director of the Departmental Course on International Humanitarian Law. After military service, as State Law Adviser (International Law) in the foreign Ministry, he fulfilled legal and diplomatic functions (at the level of counsellor), represented the Government in various bilateral and multilateral diplomatic forums, and co-drafted South Africa's submissions to the International Court of Justice. He was a long-standing member of the South African National Committee on International Humanitarian Law. He lectured at various universities and other training institutions on topics including air and space law, law of the sea, the interfaces of human rights and international humanitarian law in military operations, and at different diplomatic academies with minor publications on related topics of maritime operations.

Le drapeau blanc est aujourd'hui reconnu dans le monde entier comme un symbole de reddition, de trêve ou de demande de cessez-le-feu. Qu'il s'agisse d'un chiffon improvisé ou d'un tissu officiel, il signifie une intention pacifique : celle de ne pas attaquer et de vouloir dialoguer. Mais d'où vient cette pratique, et pourquoi avoir choisi précisément un drapeau blanc ?Une origine ancienneL'utilisation du drapeau blanc remonte à l'Antiquité. On en trouve déjà des traces dans les chroniques chinoises du Ier siècle. Durant la dynastie Han, les soldats agitaient des tissus blancs pour indiquer leur soumission ou pour signifier qu'ils voulaient négocier. Les Romains, eux aussi, utilisaient parfois un voile blanc pour demander la paix.Mais c'est surtout à partir du Moyen Âge en Europe que le drapeau blanc se généralise comme signe de reddition sur les champs de bataille. Les soldats qui abandonnaient le combat devaient montrer clairement qu'ils n'avaient plus l'intention de se battre. Le blanc, couleur neutre et visible de loin, était parfait pour cela. Contrairement aux drapeaux colorés des armées, le blanc n'était pas associé à une faction, ce qui évitait toute confusion.Pourquoi la couleur blanche ?Le choix du blanc n'est pas anodin. D'un point de vue symbolique, le blanc évoque la pureté, la paix et l'innocence dans de nombreuses cultures. Mais surtout, c'est une couleur neutre, non affiliée à un camp particulier, ce qui renforce l'idée de non-agression.Une reconnaissance par le droit internationalL'usage du drapeau blanc a été codifié par le droit international, notamment dans les Conventions de Genève et les Conventions de La Haye au début du XXe siècle. Il est reconnu comme un symbole protégé, qui indique qu'un combattant souhaite parlementer, rendre les armes ou évacuer des blessés.
