U.S. Should Turn Ukraine War Over to Its European AlliesA Long Day's Journey Into Putin's NightBy Ivan ElandInstead of a quick Russian victory, Russia's second invasion of Ukraine seems to be settling into a drawn-out slugfest. After Ukrainian soldiers surprisingly thwarted Russia's offensive on Kyiv, Ukraine's capital city, the gleeful United States rallied NATO nations to provide the Ukrainians with tens of billions in weapons technology.After some Ukrainian battlefield successes in throwing back the Russians in the east and south of Ukraine, which gained back some Russian-occupied territory, the United States and its allies gradually succumbed to the vision of decisively handing the Russian Bear with a stinging military defeat.Yet, Russia still has some advantages. By essentially invading Crimea and parts of industrialized eastern Ukraine in 2014 and combining this conquered territory with that of its initial gains in the east and south in the 2022 invasion, the Russians have given the Ukrainians a Herculean task to recapture such a large land area against a more significant and sometimes well-dug-in occupying force.Unless the reported low morale of the Russian force causes it to suddenly collapse—as German troops did in 1918 during World War I—the war likely will turn into a long, bloody slog.Currently, the United States provides more military aid to Ukraine than all other countries combined. If the Europeans lack some of the weapons needed by Ukraine, they can buy them from the United States and send them on. Through several recent presidential administrations, the U.S. military establishment has been trying to “pivot to Asia” to deal with the much bigger threat of a rising China, but the strategically overstretched United States—U.S. national debt has reached $31.5 trillion—has repeatedly been diverted from this objective by self-inflicted quagmires in the Middle East and providing tens of billions of aid to Ukraine.Second, the Russian fighting force has been shown to be a paper tiger, despite its large mass alone likely being able to lock up the war with Ukraine in stalemate for perhaps years—much like Russia's other foreign conflicts.Third, a better solution would be to reach a settlement that gives both countries a face-saving way out and creates the best chance for long-term stability—that is, the absence of future wars over the same ground.In the longer term, the two exhausted parties might agree to hold a referendum, or referendums, in Russian-speaking areas of Ukraine to let the people decide whether to be part of Russia, Ukraine or even a newly independent country. So says presidential scholar Ivan Eland in his landmark new book War and the Rogue Presidency: Restoring the Republic after Congressional Failure.The presidency no longer simply enforces the laws passed by Congress but literally dominates American political life. Its vast bureaucracy is flush with cash and wields powers never authorized by the Framers. But who do we have to thank for this distortion of the Constitution? Congress.The presidency, says Eland, isn't inherently imperial. It's contingently imperial. Particularly when wars loom and Congress refuses to forestall our engagement in them—with inevitable consequences. Armed conflict bloats armies and emboldens the commanders-in-chief who wield them. Presidents, for instance, now unilaterally start wars and kill Americans (and others) overseas without due process.But wars also lead to massive domestic government interference. Income tax, estate tax, gas taxes, the IRS, public housing, rent control, inflationary money printing, financial bailouts—all have their origins in wartimeThe solution is clear. Congress, says Eland, simply must refuse to fund the undeclared wars presidents seem bent on waging. Yet to do that Congress must first implement reforms detailed in this book: weaken the committee structure; eliminate the seniority system, outlaw covert destabilization of foreign governments, and back federal courts seeking to limit the national security state—and many more.In sum, liberals, conservatives, independents—anybody concerned for personal liberties and good governance—should read this pathbreaking book and grapple with its implications. The last time Congress declared war was on December 8, 1941. In the years since then we have gone from a relatively limited executive branch — as spelled out in James Madison's system of checks and balances — straight through the imperial presidency of undeclared wars in Korea and Vietnam, to a rogue Presidency in which all bets are off.Historian, economist, and foreign policy expert Ivan Eland has written a new book linking the cancerous growth of the military and executive branch to Congress's on-going abdication of responsibility.War and the Rogue Presidency: Restoring the Republic after Congressional Failure is Eland's latest with the Independent Institute. Senator Rand Paul calls it a must-read for “for anyone seeking a safer, freer, and more peaceful world.”I've covered the growth of the administrative state dozens of times on my show, but Eland has a fresh take on how the erosion of checks and balances has taken place — not all at once, but in a ratcheting of executive power during wartime.He shows how most major economic interventions have their origin in war: whether its taxes (i.e., income tax, progressive taxation, double taxation, tax withholding, tax expenditures, the estate tax, gas taxes, etc.) or social programs (i.e., Social Security, expansion of Medicaid, public housing and rent control, grants-in-aid to state).Even government regulation of marriage, as opposed to the common law tradition, arose out of a Civil War interest in monitoring the moral activity of widows receiving pensions from the government.Eland walks readers through this surprising history — including Abraham Lincoln's “inept autocratic” wartime presidency — and the attempts by Congress to push back against growing executive authority. But US President Donald Trump is frustrated with some of his top advisers, who he thinks could rush the United States into a military confrontation with Iran and shatter his long-standing pledge to withdraw from costly foreign wars, according to several US officials. Trump prefers a diplomatic approach to resolving tensions and wants to speak directly with Iran's leaders. All of this while my first guest warns that with the beat of Washington's war drums continuing to grow, particularly following the Monday reports of a government plan to send as many as 120,000 troops to counter Iran, the threat of an “accidental” provocation or a “false flag” is also becoming increasingly likely.Four activists who had been protesting in the Venezuelan Embassy in Washington, DC, for more than a month were arrested Thursday and forcibly removed from the building. Medea Benjamin, co-founder of anti-war organization Code Pink, told the Associated Press that police entered the building early in the morning to arrest the protestors. The US Secret Service confirmed officers had helped agents from State Department's Diplomatic Security Service execute arrest warrants against people inside the embassy: Kevin Zeese, Margaret Flowers, Adrienne Pine and David Paul.Carlos Ron, deputy foreign minister for Venezuelan President Nicolás Maduro's government, tweeted Thursday that US officials entering the building “is an unlawful breach of the Vienna Convention,” an international treaty that created a legal framework for diplomacy between countries. All of this action is taking place in Washington, DC, while it is reported that the Venezuelan government and opposition are preparing to negotiate. After months of protests and a failed opposition attempt to overthrow Maduro, government and opposition representatives are meeting in Norway for talks, Venezuela's ambassador to the United Nations said Thursday. It was unclear whether the sides would meet directly to explore resolutions for the political crisis in the South American nation or if Norwegian officials would serve as intermediaries.US President Donald Trump announced a new immigration plan in a speech Thursday afternoon, the latest attempt by the administration to follow through on a campaign promise to overhaul America's immigration system. "We are proposing an immigration plan that puts the jobs, wages and safety of American workers first," Trump said. "Our proposal is pro-America, pro-immigrant and pro-worker. It's just common sense." The debate over the United States' exit from Iraq is back, with the new wave of violence after a brief (relative) calm. Clearly, the vision of a peaceful, unified, and democratic Iraq has not worked out as proponents of the invasion hoped. But could this relapse have been avoided if we had only stayed longer? Not according to Ivan Eland, Director of the Independent Institute's Center for Peace & Liberty and the guest for the full hour.Just before the draw-down of troops began in 2009, Eland penned a short, prescient tract on what a successful exit strategy for Iraq would entail. Partitioning for Peace: An Exit Strategy for Iraq argued against the Bush administration's attempt to cast the country in the democratic image of the United States. His book laid a foundation for a more realistic political agreement: a negotiated partition of the country among the major factions that would grant each faction autonomy under a weak central government. The Obama administration got the “exit” part right, but its desire to maintain a unified Iraq continues to do damage, as de facto partition and civil war erupt in the absence of negotiation.
