A judge found Officer of the Year Adam Feaman not guilty of second-degree assault and armed criminal action. Feaman struck Jamal White in the face with his flashlight and broke his jaw. The officer was fired and charged after the incident but was found not guilty by a jury last week. The judge ruled that Feaman's actions were reasonable to subdue White and that his actions were justified. The strike to White's jaw was caught on a bystander's camera and went viral at the time of the attack, and the officer's lawyer argued it was in self-defense. #adamfeaman #jamalwhite . . . . . . Last week the Supreme Court heard oral arguments in the Case of Caniglia v Strom. What makes this case remarkable is the current Administration filed an "Amicus" (friend of the Court) brief which argues that the position of the US Government is that a search warrant should not be "presumptively required" IF the government agents actions (the search and seizure) are considered to be "grounded in "the public interest." Once upon a time, the Supreme Court decided that search warrants were only needed for Federal agents, not the State ones. So how did we get a whole bunch of Federal convictions during that time frame? Well... when the evidence presented was received on a silver platter, it was considered admissible. And if the 1st Circuit Court has its way, it will be again.

Loud music has never been and never will be a reason to kill! Feeling scared but your life is not in eminent danger is not a reason to kill. Having black skin is not a reason to be killed! Change has to come. My prayers and heart goes out to Aidan Ellison, Jordan Davis, Trayvon Martin and Tamil Rice's family. We are determined to Intentionally Make A Difference.

In this episode I talk about the senseless murder of unarmed 19 year old Aidan Ellison in Ashland Oregon. Robert Keegan was staying at the Stratford Inn after being displaced due to a fire at his home. Aidan Ellison was homeless and playing loud music in the early morning of November 23rd 2020, just days before Thanksgiving when the 2 encountered one another. Mr Keegan couldn't take the music anymore when he approached the teen. The got into a dispute and the 47 year old shot the black teen in the chest. CDC SUGGESTS AMERICANS DITCH SINGING, LOUD MUSIC, ALCOHOL, FOR HOLIDAYS DUE TO PANDEMIC The holidays will be a lot quieter this year if you follow the latest guidelines suggested by the U.S. Centers for Disease Control and Prevention (CDC). Published yesterday (November 18th), the organization says to minimize the spread of COVID-19, people should avoid singing or shouting (especially indoors), avoid close contact with others from outside one's household (you still should be socially distancing, keeping six feet apart), and avoid drinking alcohol. The CDC also warns against drinking as, “Using alcohol or drugs that may alter judgement [could] make it more difficult to practice COVID-19 safety measures.” And if you can’t avoid having a holiday gathering, the organization recommends wearing face masks and having hand sanitizers or hand washing stations available for guests. A new study revealed that young people who attend loud music events are more prone to having early signs of hearing damage than those who do not. Scientists from the University of Manchester have found a link between signs of hearing damage and exposure to loud recreational noise like music at clubs or concerts. Although the damage is not bad enough to be recognized as hearing loss, it may have a cumulative effect over the years and negatively affect one's hearing later in life. The scientists conducted detailed assessments and interviews with 123 participants aged 18 to 27 years. They found that the hair cells in the cochlea—a part of the inner ear that helps detect sound—functioned poorly in participants who were exposed to high-level noise. Sam Couth, a doctor from the Manchester Centre for Audiology and Deafness, explained that these hair cells naturally decrease as a person ages, but listening to loud music can speed up the process. The scientists also speculated that the damaged hair cells slowed down the transmission of sound signals from the hearing nerve to the brain. Following the study's findings, the scientists believe that avoiding noisy environments or reducing the volume of music can minimize the risk of hearing damage. If avoiding noisy situations is not possible, the scientists recommend wearing earplugs designed to offer protection for the ears while still preserving sound quality. In addition, they urge those who are frequently exposed to loud music to have regular hearing tests.

How much activity can we cram into one day? Well, listen to this episode and find out. It was a hot, summer day and a day of contrast. We started out by going to Warrensburg to a Hamfest. While there, Robert had a long conversation with fellow hamvangelist Brooks all about their black powder guns. We left the Hamfest to play tourist and explore a part of Missouri we hadn’t been to yet. That led us to Higginsville to visit the Confederate Memorial State Historic Site. It a nice park with nice grounds. The only problem was…it was extremely HOT that day. Our tour didn’t last long. Hunger took over and we made our way to Marshall, MO for some BBQ. As we traveled, I occupied my time with some travel crochet. I started my sand dollar beach bag. Then we switched back into keeping with the hamvangelist theme by visiting our friends Jeff and Tracy while in Marshall. Robert and Jeff tucked themselves away in the ham shack talking about who knows what. All I know is that Robert came home with a new-to-him radio. We left Marshall and headed toward Lake of the Ozarks. Our day of contrasts ended as Robert played a gig with the Tri County Hair Club for Men Musical Ensemble (yes…that’s the name of the band. Follow them on Facebook). Contrasts…Amateur Radio, Black Powder & Civil War, BBQ, and Loud Music…a fun-filled day. In this episode of "In Self Defense", Don West and Shawn Vincent talk about the "Loud Music" case involving Michael Dunn.   Dunn fatally shot seventeen-year-old Jordan Davis at a convenience store parking lot after an argument over the loud music Davis and his friends were listening to in their red Dodge Durango. While Dunn claimed Davis made death threats, displayed a shotgun, and attempted to get out of his car to attack him, no evidence or witness testimony corroborated his account.  Dunn fled the scene and failed to contact law enforcement. A witness memorized Dunn’s license plate number, and detectives apprehended Dunn at his home the next day. He was eventually charged with one count of first degree murder for the shooting of Jordan Davis, and three counts of first degree attempted murder for firing at a car full of teenagers as they sped away. The state threw in a charge of throwing or firing “deadly missiles” for good measure.     During the first trial, scrappy criminal defense attorney Cory Strolla, operating on a shoestring budget, made an impassioned argument that the state failed to disprove, beyond a reasonable doubt, Dunn’s claim that he shot Jordan Davis in self-defense.  According to a juror who spoke to reporters after the trial, Strolla convinced two members of the jury that state had not met their burden.  They refused to convict Dunn on the murder charge and forced a mistrial on the central count.  The jury was unanimous, however, on the three counts of attempted murder, although the opted for the lesser charge of second degree, telling the state they believed the act was done in the heat of the moment, not as a premeditated plot to kill. They found him guilty for the “deadly missile” charge as well.   The mandatory minimum sentence for second-degree murder in Florida is 20 years -- each.  Dunn would get 60 years in prison for the shots he fired that hurt no one, and he’d have to stand trial a second time to resolve the question surrounding the shot that took Jordan Davis’ life. During the second trial, experienced public defender Waffa Hanania represented Dunn and worked methodically to convince the jury that “Jordan Davis escalated this situation until he ended up dead.” The jury didn’t buy it.  After a short deliberation, they gave the state exactly what they asked for: a guilty verdict for first degree murder.  The verdict meant that the jury didn’t just reject Dunn’s self-defense claim -- they felt that at some point in the argument, Dunn made a deliberate decision that he was going to kill Jordan Davis, and then he did. Don West, veteran criminal defense lawyer and National Trial Counsel for CCW Safe said that the Dunn trial provides a “list of how not to act” as a concealed carrier.  Here’s a list of some of Dunn’s biggest mistakes: When Dunn pulled into the convenience store, he heard the loud music. He could tell it was coming from the red Dodge Durango, and he chose to park right next to it anyway.  Had he chosen any other parking spot, Davis would be alive, and Dunn would be free. Dunn chose to confront the teenagers in the SUV about their loud music.  While it was within his rights to so, a grown man shouldn’t be surprised that cocksure teens out with their friends might take umbrage at a request to turn down the radio. Dunn invited the argument that ensued. Once Jordan Davis got angry and started shouting obscenities, Dunn could have disengaged.  He could have looked away or moved to a different parking spot. Instead, he rolled down his window and, stealing a line from Robert De Niro in the film Taxi Driver, he said, “Are you talking to me?” Dunn told investigators, “I went over this a million times, and what I should have done is put the car in reverse . . . it was fight or flight. I don’t think there was any time for flight at that moment.”  Dunn did have enough time, however, to reach across the passenger seat, open the glove box, grab his holstered pistol, draw the weapon, and rack the gun before firing. Dunn fired too many times.  The fact that the first jury failed to convict on murder says that the first round of bullets Dunn fired could have been considered justified.  But everyone agreed that the final burst of gunfire was without justification. Dunn fled the scene and failed to report the shooting to investigators, Don West says there was no plausible scenario to explain why Dunn left the scene without reporting the shooting to authorities -- unless he had done something wrong. Dunn spoke to police investigators without the advice of an attorney. His voluntary testimony was used against him in court. Clearly there are many lessons here for the concealed carrier, but perhaps this is the most important: don’t confuse anger for fear. No one could present any solid evidence or witness testimony to bolster Michael Dunn’s claims that Jordan Davis produced a shotgun and was starting to get out of the SUV to attack him.  Without such evidence, combined with that fact that Dunn fled without calling the police, it must have appeared to most jurors that Dunn was inventing facts to justify the shooting. The second jury, with their first degree conviction, said that Dunn’s actions amounted to pre-meditated murder.  Perhaps that’s true.  The jurors with dissenting votes on the first jury must have felt that Dunn’s fear could have been reasonable.  Perhaps that’s the truth. Or perhaps the truth is somewhere in between, in a murky gray area where fear and anger mix.  Self-defense is a matter of life and death, but it’s not often black and white.  Should you ever find yourself suffering the tragedy of having to defend yourself with deadly force, people are going to look into your heart to determine whether its filled with fear or anger. Before you ever pull the trigger and take a life, you’d better be sure about what those people will find.
