Local vape shop owners say that the flavored tobacco ban Mayor Johnston signed into law last year represents an existential threat to their businesses and a major blow to the City of Denver's sales tax revenues. But will that be enough to convince Denver voters to repeal the ban this November? Producer Paul Karolyi sits down with two local vape shop owners — Kristen Hensel of Rusty's Vape and Smoke Shop and Philip Guerin of Myxed Up Creations — to talk about how kids get access to vapes, the Zyn plant being built in Aurora, and what the flavored tobacco ban means for their businesses. Paul talked about the Geek Bar website, this CU Anschutz report on Denver's flavored tobacco ban, the surge in nitrous oxide, aka “whippets,” in Denver, and Gov. Jared Polis' position on a statewide flavored tobacco ban, which he said he opposed in 2022. He also cited reporting on the repeal campaign's 17,000 signatures and $328,000 raised. We've reached out to the Food & Drug Administration for comment on Phil's claim of regular attempted busts at his shop and haven't heard back. And I say that because not a single Republican voted to raise taxes on small business, and every bill brought forth by Republicans was killed on the very first day of the session. So what happened? The Denver Gazette has this wrap up:Five tax bills passed along party-lines in both chambers, offered by the majority Democrats in the House. The measures are designed to raise general fund revenue to cover a portion of the shortfall. The fiscal notes said they could raise as much as $253.2 million. But the rest is now up to Gov. Jared Polis, who will present a spending reduction plan to the Joint Budget Committee on Thursday afternoon that could cover another third of the shortfall. The state's general fund reserve, set at 15% of general fund spending, or $2.33 billion, will cover the last third.Those dollars, however, will have to be recovered in the 2026-27 budget — and, already, the June 2025 revenue forecast showed that budget would start with about $700 million in the red.Hmmm, why, if they "fixed" the issues that were "created" by HR 1 would be we starting the next budget year in the red? Could it be that it ISN'T HR1, it is the massive overspending we've seen since 2019 when Democrats took everything over? Member of the Joint Budget Committee Barb Kirkmeyer joins me at 2:30 to talk about it all. Here is a list of the eleven bills, only one of which got any Republican votes, that were passed by Democrats this year.DEMOCRATS CONDEMNED A PRIVATE CITIZEN And in the process impugned the character of House Minority Leader Rose Pugliese. This all goes back to a childish photo taken of a Democrat lawmaker who chose her outfit poorly for the House. The photo was then shared on a Signal chat among GOP lawmakers who made nasty comments about her appearance in the chat. Someone then leaked the photo to someone on X and it became public and typical internet nastiness ensued. The Representative who started the whole kerfuffle had already announced he was leaving the House in September, so when Ryan Armagost heard he was going to be censured for it, he dipped early. But the Democrats can't miss a chance to be drama queens and act like this is beyond the pale in politics so they decided to have a "resolution" saying what a bad, bad man Armagost is and the Republicans were like what? Then Dem leadership said Rose Pugliese was part of the problem even after she showed evidence that she wasn't. If this reads like a middle school soap opera good, that's what it is. I know Rose as a person, and I'm here to tell you she is one of the nicest people you will ever meet. The Dems did her dirty and they know it.

A senior state employee filed a lawsuit last week alleging that Governor Jared Polis has violated state law by cooperating with a subpoena for information from ICE. Anti-ICE protesters have been marching in Denver's streets all week and Polis was already in hot water with Democrats after he set his personal record for vetoing bills, so why would he do this now? David Seligman is a candidate for state attorney general and the executive director of Towards Justice, a non-profit law firm that just joined the lawsuit against Polis, and he's on with host Bree Davies to break down the case and try to imagine what the governor is thinking. After we recorded this conversation, we heard back from Governor Polis's spokesperson. She send us the following statement: “The Governor is committed to preventing the illegal exploitation and trafficking of children. This lawsuit is unfortunately delaying an investigation focused on looking into child exploitation and trafficking. The decision to respond to this federal subpoena to support the investigation into crimes against vulnerable minors was carefully considered in accordance with Colorado law, which allows for sharing information to support timely criminal investigations. Keeping kids safe is a top priority, child exploitation is a deeply concerning issue, and has no place in our state. Complying with this federal subpoena meets the requirements laid out in state law and providing this information is in service of investigating and preventing criminal activity, which Governor Polis is deeply committed to.” What do you think about this lawsuit? Dan is apopolectic and aghast at just one minute of an answer from Governor Jared Polis in an interview by KOA's Ross Kaminsky on his rationale behind signing the radioactive House Bill 25-1312 into law to compel Coloradans to acknowledge the gender identities of trans individuals.

What you have been told by news organizations – even ones that still have good reporters – that this is part of the Trump Racism Orgy. The fired Joint Chiefs Chairman Charles Q. Brown is black. The Chief of Naval Operations was a woman. Their identities are cover stories and red meat for the Trump cult. Trump looked at the top lawyers at the Army, Navy and Air Force, the ones who would tell him, no, you can’t have the Army shoot civilians, and you can’t have the Navy blockade Vancouver and Greenland and the Panama Canal, and you can’t bomb the next Democratic convention… and he fired them. At least six different reporters and commentators on the military beat said the same thing. Firing the Chairman of the Joint Chiefs is bad and a red flag. Firing the T-JAGS, the Judge Advocates, the lawyers who tell you when something you are going to do with the military is illegal… can mean only one thing… you are planning to do something with the military that is illegal.
