Send us a textFairfax criminal defense lawyer Jonathan Katz named this podcast Beat the Prosecution in sync with his teacher SunWolf's watchword that reality is no obstacle. By shooting for the stars, great outcomes be achieved in court. Nonetheless, plenty of criminal defendants get convicted, requiring all criminal defense lawyers to be great at sentencing. Recently, Jon Katz's fellow criminal defense lawyer Bret Lee told Jon of his and lawyer Marvin Miller's Northern Virginia federal criminal defense client Felicia Donald, saying she was willing to be on Jon's podcast. Dr. Donald is a physician who in 2020 entered a guilty plea to one prescription drug violation count involving opioids and one health care fraud count. Despite the prosecution's request for a fourteen year prison sentence and to include obstruction of justice in her sentencing guidelines, Dr. Donald's legal team obtained a sentence that was half of that, and that avoided a finding of obstruction. Dr. Donald is Jon Katz's second former inmate to appear on the Beat the Prosecution podcast. A big difference between the two is that the first such guest, Susan Crane, engages in peace actions against armaments and military facilities, admits her actions and asserts their justification under international law. Most other criminal defendants, including Dr. Donald, never seek any prosecution nor attention to their prosecution. Where most convicted criminal defendants would prefer to keep a low profile about their cases, Dr. Donald does a big service to current and future defendants by here discussing step-by-step her oversight in not securing a lawyer before she reported alleged wrongdoing by one of her employees to law enforcement officers (LEO) and before she turned over her cellphone and business documents to LEO, how she chose her initial and subsequent legal team, how she weathered the storm of incarceration during the pandemic and found opportunities to help fellow inmates, how she witnessed seriously inadequate health care for numerous inmates and dealt with her own serious health issues as an inmate, and how she obtained a sentence commutation under the CARES Act. For this episode, then, beating the prosecution is about obtaining the best possible sentence and being as resilient as possible from the point of arrest to the time of release from incarceration. In 2023, Anna and On The Media's Micah Loewinger traveled to Montana to talk to Tasha Adams, the ex-wife of Stewart Rhodes, who founded the far-right paramilitary group, the Oath Keepers. Stewart had been charged with seditious conspiracy for his participation in the January 6 Capitol riots, and Tasha was eagerly awaiting sentencing: “I need him to stay locked away so my kids can legally cut contact with him when they're 18.” Tasha described their decades-long marriage, from their courtship in a ballroom dance class in Las Vegas, to abuse and isolation as Stewart became transfixed on politics and apocalyptic ideas. She and her six kids managed to escape in 2018. And shortly after our conversation there was some good news for Tasha: her divorce was finalized, and Stewart got a long sentence – 18 years.  Then Trump was re-elected, and on his first day in office he issued nearly 1,500 pardons and commuted the sentences of 14 of his supporters in connection with Jan. 6. Anchor's Aweigh: New Policies and New Proposed Guidelines Find Us Unmoored in 2025

I call this episode “Anchor's Aweigh” for two reasons.  First, there is a potential seismic shift in federal sentencing coming, which would go far to eliminate what we call the dreaded “anchoring effect” of the draconian and deeply dysfunctional sentencing guidelines. If this passes, it will likely be the biggest change in guideline sentencing since Booker was decided twenty years ago. The other reason for the title is because the achor's up on the new ship of state, and anyone paying attention should feel deeply unmoored.  The vessel is powering through dark and dangerous waters, with seemingly nothing other than doom on the horizon, particularly when it comes to our criminal system.  If you are not a guidelines nerd, and you'd like to hear our take on recent pardons and relevant executive orders from the new administration, then fast forward to 24:30.   Lastly, please excuse the bad quality of the recording.  I had the pleasure of being in the same physical space ("IRL" as the kids call it) with Mark Allenbaugh, which is a very rare occurrence.  So we hunkered down in a booth at Jack's Steakhouse and Seafood in Bismark, North Dakota (https://jackssteakhouse.net), and recorded this episode. It's January 2025, and we're in the final days of the Biden administration.  He has had a busy last month or so issuing pardons and commutations.   This unfettered power is rightly scrutinized but often misunderstood.  The bigger problem is, the whole damn process appears to be broken.  And although Pres. Biden has done some good things with his power, it still represents a small fraction of those languishing in prison who deserve action. Margeret Love was the head of the US Pardon office from 1990-97, she had a front row seat to the pardon process, and continues to represent clients seeking pardons. McLean County State's Attorney Ladd Erickson has not been mincing words in his reaction to some of President Joe Biden's pardons that impact our region. He's called them "ridiculous" and "despicable," though he wants to be clear that this didn't have anything to do with politics. "Some of the stuff that President Trump said he's going to pardon is despicable," he said on this episode of Plain Talk. But at least one of Biden's pardons is very, very personal to him. Erickson was involved in bringing Hunter Hanson to justice. Hanson defrauded dozens of people to the tune of about $11 million, but as Erickson explained to us on the show, his victim pool is larger than that. Whole businesses, some of which were the pillars of their small, rural communities, collapsed as a result of Hanson's actions. And President Biden commuted his sentence. Why? "I have no idea," Erickson told us, "and that's one of the frustrations." Also on this episode, Sen. Dale Patten, a Republican from Watford City, weighs in on the controversy over the proposed Maah Daah Hey National Monument. A group of activists are pushing hard to get President Biden to create this monument with an executive order on his way out of office, but Patten says it's far too big a decision to be made unilaterally in Washington D.C. "This is 140,000 acres," he said. "This is twice the size of Theodore Roosevelt National Park." He also said that Biden using the authority of the Antiquities Act would be in appropriate. "It's a circumvention of congressional intent when wilderness is declared a national monument." Patten said his criticism of the project isn't political. "As the proposal sits, I don't care who the president is, there would be opposition." He would prefer that local stakeholders in North Dakota -- from agricultural interests to industrial interests to tribes and all levels of state and local government -- work together on a plan to address whatever protections these lands need. This episode is optimized for video.    James was born and raised in Dallas, Texas and is the youngest of 8 children in his family. Despite both of his parents working, his family was always involved in illegal activity. At a very young age, James began selling drugs. He saw the benefits it brought to those who did it. He was arrested at the age of 20 for this very behavior. By the time he was 21, James was convicted by a jury and was sentenced to 40-years in Federal Prison.  His life changed in his first year of incarceration. He heard about the Lord and committed his life to Christ in 2000. He spent the next almost 21 years growing in his faith and relationship with God and changing his perspective on what is good in this world. Miraculously, 10 days shy of 21 years, his sentence was commuted.
