Organizational alignment is not accidental. Leaders define their organization's mission and vision and are responsible for creating the roadmaps to get there. Attaining alignment is dependent on the leader's ability to inspire his or her followers to pursue a common purpose with energy and zeal. It's up to the leaders to help employees see the vision clearly. Leaders need to develop their skills to include a variety of ways to communicate, encourage teamwork, and drive accountability. They need to set clear and ethical goals for themselves and others. And they need to give honest and timely feedback with the objective of enabling individuals to increase their own performance levels — not criticize or lay blame when plans fail. When leaders have done their work of alignment well, the organization runs like a well-oiled machine and there's little need for the leader to be in the trenches. This episode, Insights from the Bench: A Panel Discussion with High Court Justices, features three Minnesota Law alumni who serve on the highest court in their state who will participate in a moderated discussion on timely and critical judicial topics. The three featured Minnesota Law alumni panelists are: Justice Barry Anderson served on the Minnesota Court of Appeals from 1998 until his appointment to the Minnesota Supreme Court in 2004. Prior to serving on the bench he was a partner in the law firm of Arnold, Anderson & Dove, PLLP and served the City of Hutchinson, MN as City Attorney from 1987 to 1998. Justice Natalie Hudson was appointed to the Minnesota Supreme Court in 2015. Prior to that, she served on the Minnesota Court of Appeals. Hudson's professional experience also includes serving as a staff attorney with Southern Minnesota Regional Legal Services, associate attorney at Robins, Kaplan, Miller & Ciresi, Assistant Dean of Student Affairs at Hamline University School of Law and an attorney for the City of St. Paul. Until her appointment to the Court of Appeals, she was employed with the Office of the Minnesota Attorney General, primarily in the Criminal Appellate Division. Justice Janine Kern was appointed to the Supreme Court of South Dakota in 2014. Prior to serving on the court, Justice Kern worked in the Attorney General's Office serving in the appellate division, drug prosecution unit, and as Director of the Litigation Division. She was appointed a Circuit Court Judge in 1996 in the Seventh Judicial Circuit and served 18 years on the trial court bench. The event was moderated by Judge LaJune Lange '78. Judge Lange began her legal career with the Hennepin County Public Defender's Office until appointed to the bench. Judge Lange served as a Fourth Judicial District Court Judge in Minnesota handling complex civil and criminal cases until her recent retirement after 21 years on the bench. In her retirement, Judge Lange is Honorary Consul of South Africa in Minnesota; President of the International Leadership Institute; serves as Senior Fellow with the Roy Wilkins Center for Human Relations and Social Justice at the Humphrey School of Public Affairs; and is an adjunct faculty member at St. Thomas School of Law. FASD Hope is a podcast about Fetal Alcohol Spectrum Disorder (FASD), through the lens of parent advocates with over 18 years of lived experience.Episode 36 is titled "FASD Legislation Update" and features Susan Shepard Carlson. In addition to being Minnesota's First Lady from 1991-1997, Susan Shepard Carlson is an attorney and a retired Hennepin County Juvenile District Court judicial officer. It was through her experience in juvenile court that led to Minnesota's efforts in combating the harmful effects of prenatal alcohol exposure. In 1997, Susan launched an initiative to promote Minnesota's effort on FASD education and prevention and co-chaired the Minnesota Governor's Taskforce on FAS resulting in almost $7 million annual funding for FASD prevention and intervention services.Recognizing the need for the private sector to be involved in FASD in 1998, Susan formed the first affiliate of NOFAS (National Organization on Fetal Alcohol Syndrome) - Minnesota Organization on FAS (now Proof Alliance). For over 20 years, Susan has lead FASD policy, advocacy and training efforts on the national level as a member of the ICCFASD Justice Work Group, which led the effort in getting an ABA (American Bar Association) FASD resolution adopted in 2012. Other FASD achievements include: author of "tools for Success", an FASD training guide of juvenile justice professionals; facilitated "Train the Trainers" conferences on a FASD curriculum for juvenile justice professionals at 4 sites throughout the country; 2006-2007 directed Hennepin County pilot program to screen and assess adjudicated juveniles for FASD; national speaker on FASD, justice issues and its impact on society. Susan currently is on the Board of Directors of NOFAS and chair of the Legislative and Policy Committee leading the effort to pass the "Advancing FASD Research, Prevention and Services Act". National legal experts Tamika Newson and Ellen McCann discuss recent guidance from the U.S. Equal Employment Opportunity Commission (EEOC) on how the Americans With Disabilities Act (ADA) impacts employers in the COVID-19 environment. Early on, the EEOC declared COVID-19 as a “direct threat” to the workplace. This means if an employee with COVID-19 presents themselves in the workplace, employers have an opportunity under the ADA to ask specific questions about their symptoms, direct them to not come to the workplace, and monitor when and how they return to work. We discuss this new guidance and best practices for granting accommodations under the ADA during the pandemic. Key takeawaysIn its recent guidance, the EEOC addressed underlying health conditions, and mental health in particular, noting that this may be an area where potential exposure will require employers to provide accommodations. [03:33]The EEOC recently clarified that employers are permitted to ask for medical information in response to the COVID-19 pandemic. However, it acknowledged that employers may not be able to get the same records as in normal times and encourages employers to make reasonable decisions. [04:34]Employers cannot make assumptions based on who they think is vulnerable — such as people 65 and older or pregnant women. Employees, however, can let their employers know if they have concerns and ask for accommodations. [06:51]What constitutes a reasonable accommodation? The EEOC is encouraging employers to make any accommodations they can to keep people with disabilities in the workforce, but the Commission is also being reasonable in its definition of undue hardship in this economic environment. [08:13]Accommodations granted during this time can be made on a temporary basis. Employers can revisit determinations as the pandemic situation changes. He acquired a Bachelor of Arts in journalism from the University of Minnesota, and a Juris Doctorate from Hamline University School of Law. He honed his creative writing skills through the Master of Fine Arts program at Minnesota State University. In 2014, his debut novel, The Life We Bury, was named the Best Debut Novel of 2014 at the Left Coast Crime Conference.
