Light The Way is a victim-centered volunteer organization dedicated to reuniting missing persons with their loved ones, fostering positive relationships between families and law enforcement and advocating tirelessly for victims of unresolved cases, missing individuals and their families. The Gabby Petito Foundation's mission is to address the needs of organizations that support locating missing persons and to provide aid to organizations that assist victims of domestic violence situations, through education, awareness, and prevention strategies. We're honored to welcome Nichole Schmidt to Toxic today — a friend of the pod and a fierce advocate for survivors, especially young survivors of dating violence. In 2021, her 22-year-old daughter, Gabby Petito, was murdered by her boyfriend, Brian Laundrie, during what was supposed to be an idyllic cross-country van trip — and instead became a national tragedy. This past February, Netflix released American Murder: Gabby Petito, a docuseries featuring never-before-seen details about how Gabby's story unfolded. Ultimately, she became yet another preventable victim of dating violence, strangulation — and, yes, femicide. Just two weeks before her death, police in Moab, Utah, pulled the couple over after a witness saw Brian hit Gabby. Despite clear signs of abuse — and officers even identifying it as assault — Laundrie wasn't arrested. Instead, they named Gabby the primary aggressor and gave Brian a hotel room usually reserved for domestic violence victims. The incident laid bare just how much law enforcement — and society — still doesn't understand about abuser tactics. A little over a month later, Brian strangled Gabby to death in Wyoming. He later scribbled a confession in a notebook before dying by suicide — because, of course, accountability was never on his itinerary. Today, Nichole shares what life has been like since Gabby's death — and how she's working to keep her daughter's memory alive, one survivor at a time. We want to hear from you. Almost four years after her murder, Petito's parents continue to uncover new insights into her relationship with Laundrie, revealing chilling warning signs. Gabby Petito, a young woman from Blue Point, New York, set off on a road trip with her fiancé, Brian Laundrie, in 2021. With aspirations of becoming a travel influencer, she documented their journey through social media. However, behind the carefully curated images and videos, her relationship with Laundrie was deteriorating. The couple's travels took a dark turn in Moab, Utah, when a witness called police after seeing a man striking a woman. Bodycam footage from the encounter showed a distressed Petito, while police ultimately determined she was the aggressor. Officers separated the couple for the night, but no arrests were made, and they continued their trip. On August 27, Petito's mother, Nichole Schmidt, received an unusual text from Gabby's phone: “Can you help Stan? I keep getting his voicemails and missed calls.” Gabby never referred to her grandfather by his first name, raising red flags. Gabby Petito's parents have longed believed that Chris and Roberta Laundrie knew Gabby was dead long before her body was found. In trying to prove it, mother Nichole Schmidt, and father, Joe Petito, have sued the Laundries and their attorney Steve Bertolino for intentional infliction of emotional distress. They claiming the trio were aware that Gabby Petito was dead but chose to do nothing. In depositions for the upcoming civil trial, we learn two days after Brian Laundrie is believed to have killed Gabby Petito, he makes a frantic call to his parents. In the August 29, call, Laundrie tells his parents that Gabby is "gone" and he needs a lawyer. According to Petitio family attorney Pat Reilly, Chris and Roberta Laundrie did not admit to knowing Gabby was killed, only that they were told by Brian that she was "gone". A retainer was sent to attorney Steve Bertolino six days later. Reilly, however, believes the family was told more than they are now admitting. This revelation emerged during depositions conducted for the upcoming civil trial, shedding new light on the events surrounding Gabby Petito's tragic death in August 2021. While Chris and Roberta Laundrie confirmed that Brian told them Gabby was "gone" in the phone call, they did not admit to knowing that she had been killed, emphasizing only that Brian had used the term "gone." In response to this development, attorney Pat Reilly stated, "I want to know what [Brian] told Bertolino. He probably admitted more. And did [Bertolino] know where Gabby's body was located?" Reilly has filed a motion to compel Steven Bertolino, the Laundries' longtime lawyer, to reveal any additional information he may have received from Brian during the aftermath of Gabby's disappearance. A hearing on this motion, as well as the question of whether Brian's attorney-client privilege should be upheld, is scheduled for December 20 in Sarasota County Circuit Court. Ryan Gilbert, the attorney representing the Laundries in the Petito civil suit, has not responded to the requests for comment regarding this revelation. Similarly, Steven Bertolino has declined to make any statements on the matter. A Florida judge has allowed the parents of Gabby Petito to pursue a lawsuit against Brian Laundrie's parents over a statement that allegedly gave the Gabby's family false hope that their daughter was still alive. Brian confessed to his diary that he killed Gabby on Aug. 27, 2021, while the two were traveling in a van through the western U.S. According to Gabby's parents, Brian sent text messages to Gabby's mother while posing as his fiancée after killing her. According to the lawsuit, Brian returned alone to his parents' home in North Port, Florida, on Sept. 1 and is believed to have vacationed with his parents at Fort DeSoto Park between Sept. 6 and Sept. 7. Joseph Petito and Nichole Schmidt, Gabby's parents, further allege that the Laundries ignored their frantic requests for information about their daughter; the Laundrie parents allegedly went so far as to block the text messages from — and the social media accounts of — Gabby's parents. Judge denies Laundrie's motion to dismiss gabby Petito lawsuit #Petito #Laundrie#CivilSuitGabby Petito's family filed an amended lawsuit against Brian Laundrie's parents – claiming they went on vacation with their son, all while knowing he had killed the 22-year-old Long Island native and the whereabouts of her body, according to a local report. The amended complaint was filed in Sarasota County after a judge there noted “procedural deficiency” in the suit originally filed in March by Joe Petito and Nichole Schmidt against Chris and Roberta Laundrie, a local NBC affiliate reported. Notably, according to the report, the new lawsuit claims the Laundries took Brian to a Florida campground in September 2021 while knowing he had killed Gabby, the report states. The suit claims the Laundries were also aware of the location of Gabby's body, which was missing for nearly a month until authorities tracked it down in Grand Teton National Park in Wyoming. “While Gabrielle Petito's family was suffering, the Laundrie family went on vacation to Fort DeSoto Park on September 6-7, 2021,” the suit states, according to the report. “They went on vacation knowing that Laundrie had murdered Gabrielle Petito, it is believed that they knew where her body was located, and further knew that Gabrielle Petito's parents were attempting to locate her,” it adds. The suit does not provide evidence as to how they knew the Laundries knew the whereabouts of Gabby's body, according to the report. Their attorney declined to comment in an email to The Post Friday. On Sept. 19, Gabby's body was found at the Wyoming campground. A medical examiner later ruled she'd been bludgeoned and strangled to death. The FBI did not directly say Brian murdered her, but they found he was the sole suspect in her demise. Shortly after Brian returned to his parent's home in North Port, Fla., he went missing inside of a massive nature reserve until his remains were found in late October. It was later determined he died by a self-inflicted gunshot wound.

The legal maneuver comes after Petito's parents filed a lawsuit March 10 accusing Laundrie's parents, Christopher and Roberta Laundrie, of hindering the search for their murdered daughter. In the new civil complaint, filed in Sarasota County, Florida, Petito's mother, Nichole Schmidt, acting as the administrator of her daughter's estate, is targeting Laundrie's estate for "damages which exceed $30,000." The action, targeting the estate, is not likely to result in any monetary damages, said Steven Bertolino, an attorney for Christopher and Roberta Laundrie. One of the final messages that Gabby Petito's family is believed to have received from her was in the form of an "odd text" sent at the end of August, when loved ones began to grow concerned about her wellbeing, according to the state search warrant released Monday. Gabrielle Petito, 22, sent her mother, Nichole Schmidt, a text message on August 27, in which she wrote: "Can you help Stan, I just keep getting his voicemails and missed calls," states the search warrant, filed in the Sarasota County Circuit Court on Friday and made public Monday.
