La semana pasada ingresó en una penitenciaría federal situada en Texas Elizabeth Holmes, fundadora de la empresa Theranos y protagonista de uno de los mayores escándalos corporativos de los últimos años. Holmes fue declarada culpable hace año y medio por un jurado de engañar a los inversores de su empresa, una start-up californiana ya desaparecida que afirmaba haber revolucionado los análisis de sangre. Meses más tarde, en noviembre del año pasado, un juez federal la condenó a once años y tres meses de cárcel. Holmes recurrió la sentencia para retrasar su ingreso en prisión, pero de nada le valió, el juez decretó que antes del 30 de mayo tenía que presentarse en la cárcel. Aparte de eso tendrá que pagar 452 millones de dólares a las víctimas del fraude. La caída de Holmes, la empresaria de moda en Silicon Valley hace menos de diez años, estuvo provocada por una serie de reportajes que publicó el Wall Street Journal entre 2015 y 2016. El diario neoyorquino detalló como la máquina de análisis que había patentado Theranos no sólo no funcionaba, sino que además ponía en riesgo la vida de los pacientes. Theranos negó rotundamente lo que contaba el Journal y amenazó al periódico con acciones judiciales que quedaron en nada. Entre tanto hizo desaparecer pruebas y se apresuró a llegar a un acuerdo con los que habían invertido millones de dólares en la empresa y los reguladores federales. Pero el acuerdo no evitó el juicio. Holmes y su socio, el programador pakistaní Sunny Balwani, fueron encausados en junio de 2018 por nueve cargos penales y dos de conspiración. Ambos negaron de plano haber hecho nada mal, pero la empresa se vino abajo rápidamente. Sólo tres meses después se disolvió en medio de un gran escándalo ya que gente muy significada de la política y las finanzas había apoyado a Theranos y, especialmente, a su fundadora, a quien tenían como una especie de genio empresarial de nuestro tiempo al nivel de Steve Jobs o Jeff Bezos. La prensa adoraba a la empresa de Holmes y a la propia Holmes. En su mejor momento, justo antes de que estallase el escándalo, la revista Time la incluyó en la lista de las cien personas más influyentes del mundo. La revista Forbes le concedió un premio y la colocó en su lista de las mujeres más poderosas del planeta. La cadena Bloomberg no quiso quedarse atrás y le franqueó la entrada al exclusivo ranking de los 50 más influyentes cuando no había cumplido aún los 30 años. Holmes estaba muy bien conectada y se había fabricado incluso un personaje público. Se presentaba como una persona fría y distante siempre vestida de negro. Esa imagen cuidadosamente trabajada la catapultó a la fama. No era para menos, el sistema que había creado para hacer análisis de sangre era revolucionario, bastaba con unas gotas de sangre que una máquina diseñada al efecto se encargaría de analizar en poco tiempo y arrojar resultados. Los inversores se entusiasmaron empujando a la empresa a una valoración altísima, de más de 10.000 millones de dólares en su momento álgido. Gracias a eso Holmes se convirtió en una multimillonaria jovencísima. En 2015 su patrimonio ascendía a 4.500 millones de dólares y su compañía se la rifaban empresarios, periodistas, universidades, políticos y grandes inversores. Todo el dinero y la fama se evaporaron en sólo unos meses. It was a long wacky December in the world of federal sentencing. I can't remember a month with more high profile proceedings, and Mark Allenbaugh (www.sentencingstats.com) and I covered all of it in a marathon, 4-hour session. Here is part 3, dissecting the sentencings of Julie and Todd Chrisley, the star of USA Network's reality shitshow, "Chrisley Knows Best." This husband and wife duo were convicted after trial of multiple fraud charges. After a lackluster performance from the defense, Todd received a 12-year sentence, his wife received 7.  So, what went wrong? Let's call this part-two of our long days journey into the night of several recent high profile federal setnencings.  Continuing our conversation from last week (Sunny Bulwani), we dig in to the sentencing of the very public and tragic fall of attorney Michael Avenatti.  We did most of the stats in last week's episode, but this week (see links below).  In today's episode, we first focus on some statistical missed opportunities, particularly when it come to life expectancy.Tnen, we really dig in on the narrative shortcomings of Avenatti's sentencing presentation. Avenatti did himself no favors when, acting as his own attorney, he plead guilty without any agreements in the last of his three federal cases. In this case, we deal with the "ABCs" of federal fraud sentencing, meaning, we're doing a deep comparative analysis of three recent high profile cases: MICHAEL AVENATTI, SUNNY BALWANI, and JULIE & TODD CHRISLEY. I never ceased to be amazed by the miraculous work Mark Allenbaugh does with sentencing stats, but, maybe more so than any of our previous collaborations, this one is chock full of so much practical advice for every lawyer and litigant facing sentencing.  Besides the comparative overview we do a deeper dive into Balwani's sentencing proceeding, and Doug digs in to the sentencing memoranda here to grade the performance of the government and defense lawyers in presenting their written narrative to the court. The main takeaway from the statistics, is that when it comes to how the guidelines are applied, the only thing that seems certain is uncertainty.  The real lesson here, therefore, is that telling a compelling a sentencing story is far more important than the seemingly random and irrational, dehumanizing sentencing guidelines. In other words, a client gets far more traction using 18 USC 3553 to build their powerful and persuasive sentencing narrative. Founder Elizabeth Holmes' ex-boyfriend Ramesh "Sunny" Balwani, former COO of failed blood testing startup Theranos, was found guilty of defrauding investors and patients. The jury deliberated for four days following a lengthy trial that began in March with opening statements. Almost four years ago, Balwani and Holmes were indicted for allegedly defrauding investors and patients at Theranos. Holmes' legal team stated in legal filings that she intended to make accusations about their relationship as part of her defense. A jury found Balwani guilty of four of 11 federal fraud and conspiracy charges against Holmes, the founder and former CEO of a failed blood testing startup. During Balwani's trial, the government called two dozen witnesses - many of whom had previously testified in Holmes' trial - to prove that he had intentionally deceived investors and patients. Only two witnesses testified for the defense. During the defense's arguments, Balwani was portrayed as acting in good faith and believing in his company's technology. Furthermore, the defense questioned whether the government had sufficient evidence to convict Balwani. During a summer program in Beijing to learn Mandarin in 2002, Balwani and Holmes met. In addition to his successful career in the software industry, Balwani was an entrepreneur nearly 20 years older than Holmes. Holmes testified in her own defense that their friendship eventually turned romantic. The pair moved in together by 2005, the year after Holmes dropped out of Stanford to work full-time on Theranos. Following a $10 million loan guarantee, Balwani took on a formal role at the startup. On each count of wire fraud and conspiracy, Balwani faces up to 20 years in prison and a fine of $250,000 plus restitution. Not guilty, he has pleaded. In late September, Holmes will be sentenced.
