His argument is simple and hard to answer. If ICE and Border Patrol were detaining dozens of violent criminals, carjackers, traffickers, members of Tren de Aragua, this administration would put them in front of cameras every single day. It has not done that once. What the cameras show instead are car accident victims, longtime residents, and families. One case Hawk returns to: a sailor serving aboard the USS Abraham Lincoln whose father, here 30 years with a Social Security card, a license, and no criminal record, was detained while his son was deployed. Two genuinely ridiculous things crossed Hawk's desk today, and they rhyme. First, The Atlantic reports that with his approval parked in the low thirties, the president sat his advisors down to figure out how to spend a roughly $400 million super PAC war chest, and the master plan they landed on is more of himself. The diagnosis from his own team is that voters just haven't been properly introduced to his accomplishments yet, which is a bold thing to say about the most photographed man alive. The cure is ads. About him. Problem solved. Then there's the convention. Parties hold conventions in presidential years. Everybody knows this except, apparently, the people planning a two night Trump convention in Dallas on September 9th and 10th, keynote speaker both nights, him. It lands on NFL opening night, which is a fight with the NFL that the NFL does not know it is in and will win anyway. And the cover charge is the punchline: House candidates reportedly pay their own super PAC to walk in, tiered all the way up to a six figure package Hawk reads out with the delight it deserves. His take, more or less: if you were trying to lose on purpose, it would look a lot like this. The center of it is expert testimony. When a defendant's mental state is the whole question, both sides bring in psychologists, and everything those witnesses say is opinion, not fact. Hawk walks through what it takes to qualify an expert, why the phrase to a reasonable degree of psychological certainty matters, and why cross examination is where these witnesses are really tested. One clip shows a prosecution expert asked repeatedly what he was paid, and struggling to give a number, which is a moment juries tend to remember. The sharpest sequence is the defense attorney taking a line from the prosecution's own opening statement and reading it back to one of the prosecution's own witnesses, who then undercut the prosecution's theory of motive and mental state. Hawk explains why an opening is a promise to the jury, and what it costs when that promise is not kept. Closing arguments are expected next, after jury instructions, with deliberations to follow. The Downballot ran the numbers on 110 special elections since January 2025. Democrats are outrunning Kamala Harris's 2024 margins by 12.5 points on average and Joe Biden's 2020 numbers by 8.4. That implies a roughly 12 point environment in House and Senate races, slightly better than what the same measure showed heading into 2018, when Democrats gained 40 House seats. Brandon Dukes just flipped Pennsylvania's 12th, the 31st legislative flip of the cycle. Democrats have won every one. Ron Brownstein's piece for CNN gets at the other half. The risk to Republicans is subtraction rather than addition: low propensity Trump voters who turn out only when his name is on the ballot, and it will not be on one again. Meanwhile Democratic primary turnout is hitting numbers not seen in decades. Nearly 800,000 in Wisconsin, 1.5 million in Michigan, surges in Texas and Georgia. Angie Nixon is running the same play everywhere it works: populism and affordability, gas and groceries and rent and utility bills.
