Today, Forrest Valkai and Justin discuss Hinduism, the morality of God, and alien intervention.Lily from the UK asks the hosts if they think Hinduism is more ethical because it lacks a hell concept. The hosts explain that when they talk about the dangers of religion, there's a spectrum. Even in their most benign state, religious and magical thinking is harmful. Hinduism, as far as the hosts understand, seems more tolerant than Christianity, but at the end of the day, it's all still dogma, just more or less progressive dogma.Caleb calls in from Ohio to discuss the morality of God. If the hosts believed in the God of the bible, would they think he was immoral? When the hosts ask him if he agreed with the morality of an unfair punishment by God, Caleb hung up.John from California calls to say that no one knows what the Lord's prayer means, but he has figured it out by watching AXP. He considers himself a biblical literalist. He says that the Lord's Prayer as said by Jesus in the bible contains a Greek word that was never used anywhere else, so we don't actually know what the translation means. But we have good resources to know how a word was used based on our knowledge of similar languages. John got dropped because he's a troll.Mike from South Carolina believes that the world is too finely tuned to not have been designed by a creator. The hosts ask him if there is a reason for natural disasters if they were designed that way. Mike says that they're punishment because of a fallen world. The hosts point out that his original argument of a finely tuned world fell apart since he had to jump to God's mysterious reasons for creating things like natural disasters. When the hosts push Mike on all of the terrible things that God has done, like murdering people, he says that it's not that bad since the people who died went to heaven. Nick from NC says that science and the bible work well together and that religion was like the first science. While the hosts can concede that ancient religions were ways to explain the world, they don't agree that current scientific knowledge and the bible complement each other. Nick says that the Adam and Eve story shows that some actions can impact future generations and others besides the individual. You have to really read into the story to get that conclusion. In the bible, it's straightforwardly about punishment. Nick mentions that he thinks that gods have been misinterpreted and that they're actually aliens.John from Ohio asks what evidence we have for the nonexistence of God. He says that if there was polytheism, chaos would ensue. But the hosts can't agree with that, because there's no way to support that claim. How could we know that there would be chaos? John claims that the hosts are militaristic atheists and extremists. John lays out a false dichotomy of the universe being created by a god or the universe was always here. Why isn't there a third choice? Why can't we say we don't know how the universe started? He misunderstands modern physicists and thinks that the big bang theory says that nothing gave rise to something. I ask the philosopher Palle Yourgrau five questions about himself. Palle Yourgrau is Harry A. Wolfson Professor of Philosophy at Brandeis University. He is the author of several books, including “A World Without Time: The Forgotten Legacy of Gödel and Einstein” (2005), “Simone Weil” (2011), and most recently, “Death and Nonexistence” (2019).
Defenses. In a conversion suit, it is no defense to claim that the defendant was not negligent or that the defendant acquired the plaintiff's property through the plaintiff's unilateral mistake, or that the defendant acted in complete innocence and perfect good faith. The following are traditional defenses to an action in conversion: Abandonment. Abandonment of the property before it was taken by the defendant is a complete defense. Authority of law. A conversion cannot occur if it is done by authority of law, a court order or valid process. Consent or approbation. Consent by the plaintiff can be either express or implied. Delay in bringing action. Statutes of limitations are defined by legislative jurisdiction. Some cases are based on "reasonable knowledge". Paintings purchased from a third person became the subject of an action in conversion, even though the incident had occurred 30 years prior. The action accrued based on when the plaintiff reasonably knew or should have known the identity of the possessor of the converted paintings. See also the doctrine of laches. Fraud of the plaintiff. Conveying property to a third person for purposes of evading creditors is a complete defense to a subsequent action in conversion. interest of defendant. If the defendant has ownership or partial ownership to the property, it cannot be converted. Cases revolve around the specific facts concerning ownership. Value of property. A provisional defense can be made if the property converted has no value. Nevertheless, it is well established that it is not necessary for property to have a commercial value in order to maintain an action in conversion. This argument can be used to mitigate damages. Writings. A bill or debt obligation can be converted. However, if it has been paid or otherwise satisfied, then it has neither value nor existence in the eyes of the court. Nonexistence or lack of identity of property. Something that was not in existence at the time of the alleged conversion cannot be converted. Privilege. Finders of lost property may be entitled to use or ownership if the real owner cannot be identified. This is an overlap into the rules of trover. Unlawful and illegal acts. Unlawful contracts, illegal ownership and illegal activities on the part of the plaintiff can be a defense to an action in conversion. A counterfeit coin cannot be converted, nor can a note issued in an illegal manner. Waiver, ratification and estoppel. An action in conversion can be dismissed if the right to treat the action has been waived by the plaintiff. By receipt of proceeds of a sale. Accepting the proceeds of a sale of the converted property is a defense against further action. By accepting return of goods. In this episode of Functional Philosophy, I answer the following questions: 00:38 - "In episode 32, talking about how to think about the universe, you suggested the existence of an ether filling otherwise empty space. You glossed over this as a given without much explanation. Since the existence of an ether is not common knowledge, I assume that you believe there is some metaphysical necessity for it. Could you please clarify this? FWIW, I understand that "nothing" does not exist. "Nothing" is only the absence of something. It is only in reference to something that "nothing" has any meaning. The same can be said about empty space. Empty space does not exist -- it is only the space between existents. It is only in reference to other objects in space that one can refer to empty space. But I don't see this as necessitating a plenum. It seems to me to be a false dichotomy to claim that, because empty space does not exist, then there is no empty space between anything. I’d like to hear your arguments for the existence of an ether or the universe as a plenum." 08:07 - "I'm just wondering what the nature of the rights of children is from the perspective of objectivism, and what the moral relationship between a parent and a child is like. I haven't seen this issue properly addressed - that's not to say it hasn't been, certainly I could have missed it - but I am curious about when rights and responsibility begin. It seems Rand herself concluded children do not have full rights, but in any case I'm curious about the obligation to care for your child, if any exists." 13:55 - "My question relates to the death penalty, and whether or not it should exist in a free society. I recently read an article in the New York Times which reported that the Pope had declared the death penalty to be inadmissible in all cases. This got me to thinking, is it moral for the State to execute a violent criminal? I am currently reading OPAR for the first time and have just completed Chapter 8 – Virtue in which Leonard Peikoff, among other things, describes the Objectivist position on the concept of ‘Justice’. Although the Objectivist position on the death penalty is not stated explicitly, it is my moral estimate that Ayn Rand’s vigorous advocacy of the good and condemnation of the evil implies a need for having the death penalty available for the most egregious instances of rights violations; mass murderers/serial killers etc. Is this your understanding of the Objectivist position? And if so, what are the Objective facts which give rise to this idea? And finally, what do you think are the ideas underlying those people who say “we can’t resort to the level of the murderers or terrorists, we must be better than them and lead by example”? Gangaji shares a simple message-This is an invitation to shift your allegiance from the activities of your mind to the eternal presence of your being. Born in Texas in 1942, Gangaji grew up in Mississippi. After graduating from the University of Mississippi in 1964, she married and had a daughter. In 1972, she moved to San Francisco where she began exploring deeper levels of her being. She took Bodhisattva vows, practiced Zen and Vipassana meditation, helped run a Tibetan Buddhist Meditation Center, and had a career as an acupuncturist in the San Francisco Bay area. Despite her successes, Gangaji continued to experience a deep and persistent longing for fulfillment. She pursued many paths to change her life including relationship, motherhood, political activism, career, and spiritual practice, but even the greatest of her successes ultimately came up short. In the wake of her disillusionment, she made a final prayer for true help. In 1990, the answer to her prayer came unexpectedly, taking her to India and to the meeting that would change everything. There on the banks of the river Ganga, she met Sri H.W.L. Poonja, also known as Papaji, who opened the floodgates of self-recognition. In this meeting, Gangaji's personal story of suffering ended and the promise of a true life began to flower and unfold. Today, Gangaji travels the world speaking to seekers from all walks of life. A teacher and author, she shares her direct experience of the essential message she received from Papaji and offers it to all who want to discover a true and lasting fulfillment. Through her life and words, she powerfully articulates how it is really possible to discover the truth of who you are and to be true to that discovery.
