The widow of a motorcyclist who died after being hit by a disqualified driver is appealing for longer sentences to be imposed for dangerous driving causing death. 54-year old Maurice Feehily was fatally struck by a van driven by Daniel Phillips in 2020, who was jailed for five years and nine months in March. The mother of a young man who was killed in a hit-and-run is urging the Government to introduce stiffer sentences for dangerous driving causing death. 21-year old Dylan Killalee Maher died in 2023 after Cameron Cooper hit him. On a day of a resignation at a fairly high level, we also have a confession in court from another high profile operator. The problem with "high profile" is it tends to be high-wire. More is expected of you because of your role. Or is it? From the details available, which aren't many, Andrew Bayly didn't commit a sackable offence as far as I can work out. Putting your hand on the arm of a person you are having a “lively” discussion with isn't very cool, or acceptable, but in and of itself it's not the end of a career. But the trouble with Bayly is the "loser" thing in some way, shape or form was going to haunt him. So a small infringement, by way of a follow up misdemeanor, was always going to be larger than it would have been with a clean sheet. Also, Luxon has set the behaviour bar high. The precedent is there, so any trouble and you're out. Contrast that to Caleb Clark, who has pled guilty to dangerous driving and failing to stop for police. The max sentence, with sentencing happening in June, is many thousands of dollars, or months in prison. His lawyer wants him discharged without conviction. Unlike Bayly he hasn't offered to quit, so the question becomes: is it a sackable offence? Drink driving has been established with a number of incidents over the years with high profile convictions as not being sackable, so the precedent is set there. But what about dangerous driving, and more worryingly, with the message it sends of failing to stop for the police? Failing to stop with a view to what? Scarper? Not get caught? Evade the law? Get away with it? Law and order has been a major election issue and the polices rolling in to get on top of law breaking has been a major focus for most of us of late. If I, as a high profile operator, was up on charges of failing to stop or dangerous driving, would you expect me to be sacked? Would this workplace, beyond whatever happens in court, expect to see some sort of resignation? Or does profile only count in politics, where no law was broken but emotions get you sacked? Japan's Justice Minister Keisuke Suzuki asked the Legislative Council on Monday to consider numerical criteria to bring the charge of "dangerous driving resulting in death or injury" against reckless drivers.
The head of roads policing in Clare claims a failure to comply with new speed limits could result in a dangerous driving charge, if motorists are deemed to be driving at excessive speeds. As of midnight last night, speed limits for local roads across the county now stand at 60 kilometres per hour, having been reduced from kilometres per hour. The move has sparked criticism in some quarters, amid claims the new limit is too restrictive and will result in greater volumes of motorists failing to adhere to speed limits. Head of the Roads Policing Unit in the Clare-Tipperary Garda Division, Superintendent Eddie Golden, has been telling me that regardless of opinions on the new limits the responsibility lies with the driver not to accrue points on their license.

In 1980, three friends were travelling on the South Western Highway from Perth to Harvey. They encountered a slight bend in the road and crashed into a tree. One of the friends, Terry, died at the scene, the two others escaped with minor injuries. Investigations to find who was responsible began, but, both friends denied being the driver. The case was strange, and investigator Hadyn Green was unable to make an arrest until the appearance of a surprise piece of evidence. One commentator says enforcement is critical for road safety. The Government's announced it wants 3.3 million roadside alcohol breath tests a year, with a $1.3 billion budget over three years. $7 million is for incentives for police - for when they meet targets. Greater Auckland transport blog director Matt Lowrie says police haven't done enough breath tests for a long time. "It's only in the last year that they've actually started doing it - the numbers that they kind of need to do to be able to get that down. Yesterday 33-year-old Bohdan Bezverkhyi, a native of Ukraine but with an address in Ballinhassig, Co Cork, was sentenced for dangerous driving causing the death of broadcaster, Paudie Palmer. Mr Palmer was from Blackwater but had lived in Cork for many years and was GAA broadcaster for C103 and Cork’s 96FM. Jerry spoke to Ralph Riegel who’s southern correspondent with the Irish Independent.

The head of the Clare Garda Division is urging young people in particular to say no to dangerous driving practices. 61 people have now lost their lives on the country's road so far this year which is 16 more than this time last year. Clare has seen one road fatality so far in 2024 but driving without insurance and driving under the influence are both down 13% on the same period in 2023, while speeding has seen a 10% fall. Speaking at yesterday's meeting of the Clare Joint Policing Committee, Chief Superintendent of the Clare/Tipperary Garda Division Aileen Magner insists young people need to be aware of their responsibility to keep others as well as themselves safe on the roads.
