In contracts, parties typically seek to limit their liability to each other, both in terms of the types of damages or actions for which a party will have liability and the amount of damages that can be recovered, as well as, in certain cases, the remedies that can be pursued. The parties often negotiate exceptions from these limitations, including for gross negligence or willful misconduct. During this podcast, Chris Houpt, Linda Rhodes and Anja Watt along with host Julian Dibbell will examine the definitions of gross negligence and willful misconduct, recent court holdings on the ability of contracting parties to limit liability and the implications for contracts. For purposes of this podcast, we focus on New York law, commonly selected as the governing law in contracts.

Using the Kyle Rittenhouse trial as a means to discuss how the jury system works and the current unwarranted criticisms against it, this episode walks through pre-trial reaction to the events that led to the indictment of Rittenhouse, what was reported, what the facts actually turned out to be, and how unwilling so many were to allow our judicial system to operate as intended or to accept when the verdicts were announced that it had done just that despite efforts to sway the jury and others throughout the process. --- Support this podcast: https://podcasters.spotify.com/pod/show/solis-veritas/support

On this week's episode of The Podvocate, Olivia & Lenny explore the topic of “the legal imagination” with nationally-renowned Harvard Law professor and author Randall Kennedy. This is the first episode of a three-part series exploring the role of imagination in the law and how it might be used to rethink “objective” legal principles, processes and methods we rely on. This project has been inspired by Derrick's Bell’s book "And We are Not Saved" and Patricia Williams’ book "The Alchemy of Race and Rights." In this episode, Professor Kennedy speaks to the history that has created these principles, their implications and his own vision on what we might reimagine in the legal system and beyond. Professor Kennedy also speaks about his relationship with Derrick Bell and their disagreement about what can be what is possible given the realities of the world we live in. If you are interested in knowing more about Professor Kennedy, check out his recent article entitled "Derrick Bell & Me" available at https://papers.ssrn.com/sol3/papers.cfm?abstract_id=3350497 or one of his many other publications: Race, Crime, and the Law; Sellout: The Politics of Racial Betrayal; For Discrimination: Race, Affirmative Action, and the Law; The Persistence of the Color Line: Racial Politics and the Obama Presidency.
Thomas More Society Chief Counsel Tom Brejcha saw Justice Ginsburg as a jurist who applied laws as a set of principles apart from policy preferences and political partisanship.

Barry Weingast, professor of political science at Stanford University and senior fellow at Stanford's Hoover Institution, talks with EconTalk host Russ Roberts about the nature of law. Weingast takes issue with some of the standard views of law, and proposes a better way to understand law. The two discuss the fundamental principles of law, how it can emerge in a decentralized way to resolve disputes over property and other commercial and social interactions. Examples include Iceland, Ancient Greece, and California during the gold rush. Also considered are how laws coordinate expectations and the way that social pressure can be used to enforce law in a decentralized fashion.
