John is joined by his business partner, fellow attorney and wife, Alicia Campbell. John and Alicia discuss their forthcoming book, co-authored with Attorney Sean Claggett, in which they present both the science and practical uses of big data to help trial lawyers make better decisions and achieve better trial results. In this episode, John and Alicia discuss some of the lessons learned from years of jury research and big data studies; how the data is best used to maximize value at trial; and some of the common mistakes trial lawyers make in case presentation and jury selection that can impact the win rate and verdict value in the case. About John and Alicia Campbell John and Alicia Campbell, Campbell Law John Campbell, JD is a trial and appellate lawyer turned law professor turned jury researcher.John trained as a trial lawyer under John Simon, a member of the Inner Circle of Advocates, and then went on to become a successful consumer attorney. John's verdicts and settlements exceed $350 million. John has also handled appeals in the Eighth, Second, Tenth, and Fourth Circuit, as well as the United States Supreme Court and a variety of state courts. Most recently, John served as lead counsel in a series of class actions against municipalities, including Ferguson, Missouri, who engaged in policing for profit. The cases led to the eradication of many predatory fees targeted at minorities and the working poor. John remains a member of Campbell Law LLC.For eight years John served as a professor at the University of Denver Sturm College of Law. While there, he founded the Civil Justice Research Initiative, dedicated to better understanding jury behavior through rigorous empirical research. He continues to run CJRI at the University of Denver and teaches as an adjunct professor.John's academic work led to demand for him to study individual cases for plaintiff attorneys. He ultimately founded Empirical Jury. In only a few years, Empirical Jury has emerged as a cutting-edge firm that uses big data and scientific approaches to equip attorneys to obtain the best result possible for clients. Empirical Jury has been involved in verdicts in excess of $550 million and is routinely called on to analyze some of the most complex consequential cases in the country.During the Covid-19 era, Empirical Jury is also leading the way on understanding the Covid Effect through careful data gathering and analysis. To date, Empirical Jury has surveyed over 1,200 jurors on topics relating to Covid-19, virtual trials, and jury duty. Alicia CampbellAlicia started Campbell Law, LLC, in 2009. Prior to that, she worked for a legal services law firm representing people in Social Security and consumer claims. Alicia decided to create her own firm so that she could handle the cases she wanted and give her clients a personal and positive experience.Since opening Campbell Law, Alicia has tried a mortgage fraud case to verdict in 2010, and she has argued before the Court of Appeals in 2011 and 2013 about mortgage issues. In 2015, she settled a mortgage fraud case in Missouri for $1.5 million dollars. And in 2016, Alicia settled a mortgage fraud and wrongful foreclosure case in Missouri for $4 million dollars. Alicia has also appeared in front of the Missouri State Supreme Court in 2012 and 2013 arguing on behalf of homeowners, in an attempt to change the unlawful detainer statute in Missouri. She has argued before the 8th Circuit, and she has also argued before the Missouri Court of Appeals in 2011, 2013, 2014, 2015 and 2016.In 2018, Alicia was lead counsel in certifying a class action against the City of Ferguson for its use of illegal and excessive fees in municipal court to generate profit.Alicia takes on mortgage companies and banks, as well as other types of financial fraud. She has pursued mortgage fraud claims for the last 5 years and understands people's struggles when it comes to their homes. She has been voted one of the best lawyers to call "if the bank wants your house." She has filed individual and class cases that involve predatory lending practices and schemes by banks and small lenders. She also sues debt collectors, auto dealers, and payday lenders, and has had considerable experience in the employment context, handling employment discrimination claims. Big Data is a fundamental part of Campbell Law.More than perhaps any other firm in the country, Campbell Law believes that better information makes better decisions. In only five years they were honored to participate in over $1 billion in verdicts and more than $2 billion in settlements.Empirical Jury was a wonderful experience, but it was only a first step. Over the last five years, as the plaintiff bar has embraced big data, so too has the defense. PhDs in social science and statistics are now common hires at large defense firms.So, John and Alicia decided that more was required. “Amazing Race” Season 33 contestant Ryan Ferguson spent nearly 10 years in prison after being wrongfully convicted of a 2001 murder in his hometown of Columbia, Missouri. Ryan was a 17-year-old high-school student at the time of the murder he was wrongfully accused of murder and was sentenced to 40 years imprisonment. On November 1, 2001, Kent Heitholt, sports editor for the Columbia (Missouri) Daily Tribune was murdered in the newspaper's parking lot around 2:10 am. Two years later, a young man named Charles Erickson began publicly sharing recurring dreams that he and his former classmate Ryan Ferguson were involved. What followed was viewed by many as a series of finger-pointing, confusing confessions, questionable police work, awkward eye witnesses and a prosecution team hell-bent on solving the case. The result: Ryan Ferguson was sentenced to 40 years in prison based almost exclusively on “eye witness” accounts from teenage dreamer Erickson and Tribune janitor Jerry Trump who, at trial, miraculously gained the ability to positively identify Erickson and Ferguson. Both witnesses later recanted their testimony, claiming that police and prosecuting attorney Kevin Crane, now a circuit court judge, had coerced them to lie. The 2005 conviction was vacated on November 5, 2013, by the Western District of the Missouri Court of Appeals, and Ferguson was released on the evening of November 12 after spending nearly a decade in prison. He won $11 million in a civil suit against Missouri police. A documentary entitled “dream/killer” chronicles the story of how Ryan's father, Bill Ferguson, embarked on a 10-year campaign to prove Ryan's innocence. Some frustration with the bar exam comes not just because it's a hard test. Differences in state licensing requirements can mean attorneys may have to take the bar exam multiple times. In the final episode of [Un]Common Law's three-part look at the bar exam, we ask why can't there be one bar exam for all U.S. jurisdictions? A national bar exam that eliminates the need for a patchwork of state tests? The answer turns in part on the test called the Uniform Bar Exam or UBE. Developed by the National Conference of Bar Examiners to solve the issue of portability, the UBE allows participant jurisdictions to accept exam scores from other participating jurisdictions. Still, some critics, such as the New York State Bar Association, have taken aim at the UBE for being “too universal,” and now recommend that their state withdraw. Michael Young, a St. Louis partner in HeplerBroom’s Insurance Coverage Group, joins the show to discuss the Missouri Court of Appeals’ decision in State ex rel. Shelter Mutual Insurance Company v. Wagner. Wagner is the first significant case to address attorney-client privilege in the wake of Grewell v. State Farm Mutual Auto Insurance Co., where the Missouri Supreme Court held that a plaintiff in a bad faith action has a right to access its liability insurer’s claim file. As Mike explains, Wagner clarifies whether this right of access extends to privileged communications in a claim file. He also explains why the Wagner rule is superior to adverse rulings in other jurisdictions.
Better late than never they say, and that's very accurate on my end here. I interviewed Jorge now more than 2 years ago in Chicago, and I had a ball. His story (personal and business) is very inspiring, and his earlier book (Burn Zones) is one for the ages - and most definitely highly recommended. He's an entrepreneur at heart, has failed and come back, and went on to bigger things, all to the benefit of not only himself and his investors, but primarily to the cause. And what a cause it is indeed. I'm looking forward to have an updated conversation with Jorge soon, but in the meantime, enjoy my conversation with him, now nearly 2 years ago. From his bio: Jorge P. Newbery is a successful entrepreneur, distressed debt and real estate investor, endurance athlete, and author. He turned around some of the country's most troubled housing complexes in amassing a portfolio of 4,000 apartments across the USA from 1992 - 2005. However, a natural disaster triggered a financial collapse in which he lost everything and emerged over $26 million in debt. He never filed bankruptcy. Instead he developed strategies to gain leverage over creditors to settle debts at huge discounts, or simply did not pay them at all. He is a veteran of dozens of court battles, once fighting a creditor to the Missouri Court of Appeals. The entire debt (over $5,800,000) was inadvertently extinguished due to sloppy legal work. As an athlete, Newbery raced bicycles for a living from 1986 - 1990 as a Category 1. He competed in the 1988 Olympic Trials and was 4th in the Spenco 500, a nonstop 500-mile bike race televised on ESPN. He also raced for the Costa Rican National Team in the Tour of Mexico, was 2nd in the 1987 Southern California State Championship Road Race, plus held the Green Jersey in the 1987 Vulcan Tour. Newbery also runs and has completed over 70 marathons and ultramarathons. In 2012, he was the overall winner of the Chicago Lakefront 50K. At 46-years-old, he was double the age of the 24-year-old second-place finisher. Today, Newbery helps others crushed by unaffordable debts rebuild their lives. Kansas City is home to an existing and a new replacement nuclear weapons parts plant that have been and will be responsible for 85% of the components of US nuclear weapons. The new plant is owned by the Kansas City Planned Industrial Expansion Authority (PIEA), described in a 2010 Missouri Court of Appeals decision as "a statutory agency that was created by a vote of the City Council of Kansas City, Missouri (“the City”) under section 100.320.1," and whose members are appointed by the Kansas City mayor. The plant will be operated by Honeywell for the National Nuclear Security Administration in a complicated leasing scheme, involving the General Services Administration and private developer Centerpoint Properties, that was criticized by the GAO in a 2009 report Rachel MacNair is the Campaign Coordinator for KC Peace Planters, a group responsible for getting a measure on the ballot on April 2, 2013 in Kansas City, Missouri, that would preclude the city from engaging in any such nuclear weapons involvement in the future. Willie Jackson worked in the old Kansas City nuclear weapons parts plant in the 1970's, 80's and 90's, where he was exposed to hundreds of identified toxic substances.
