In this episode of the Matheson Employment Law Podcast Series, Bryan Dunne, Head of Employment, reviews the Irish High Court decision of Philip Nolan and Science Foundation Ireland from last June. This was an application for an injunction to restrain a dismissal, following an investigation into certain allegations against the plaintiff. The case, however, addressed the question of whether an employer can dismiss an employee arising out of an investigation without applying fair procedures, so long as it can show the basis for the dismissal was not misconduct. Bryan takes a look at the various employment law issues arising out of this case, including further clarification on when an employer must apply fair procedures, and whether there are circumstances where an employer is better off strategically to call out performance or other workplace issues relating to the employee, rather than take a pure no fault termination approach.

I am feeling #blessed and #grateful to be sharing today's interview with our listeners. Brian Dunne is one of my dearest pals in the music biz, not to mention one of my favorite songwriters working today. Brian's songs are always clever and sincere, dark and fun, honest and imaginative. He's got a way with words, a killer voice, and big time rock star vibes. These are a few of the reasons why “Loser On The Ropes,” Dunne's Kill Rock Stars debut, is earning this indie rocker critical acclaim and a ton of new fans.Brian is a New York-born artist who knew he wanted to be a musician from the first moment he saw Bruce Springsteen on television. After graduating from Berklee College of Music, Brian started making records and figuring out his sound. He's become a stalwart in the New York music scene both with his own music and as a member of the super-silly supergroup Fantastic Cat [shoutout to bandmate and Basic Folk alum Anthony D'Amato!].In 2022, Brian got word that a live recording of his song “New Tattoo,” which had been recorded during a 2018 soundcheck, was climbing the charts in the Netherlands. His unexpected European star turn has not gone to this working artist's head one bit; in fact he has delved even deeper into themes of failure and humility in his recent songs. The existing protected disclosures framework was significantly enhanced by the recent enactment of the Protected Disclosures (Amendment) Act 2022 which came into effect on 1 January this year. This case, although heard under the previous legislation, illustrates how extensive the protection is for whistleblowers against acts constituting penalisation. Given the broader definition of penalisation under the 2022 Act, employers should take particular note of this case!

Joining me today for an On Tour Special episode are the drummers from Hall & Oates and Squeeze - Brian Dunne from the USA and Simon Hanson from the UK. they have been touring the USA together for the last 2 months after Covid brought the original tour to a grinding halt in 2020! Join Simon, Brian and myself as we talk about what its like touring post lockdown, we also talk about Squeeze and Hall & Oates, The incredible back catologue of songs to choose from and the magnificent list of drummers that have played for both great bands in the past! We of course had to touch on Live From Daryl's House where Brian of course is the drummer - Daryl Hall invites some of his musical friends along to his house to jam. The results are stunning! This was such a fun interview to do - this was just after Soundcheck on Friday 24th September 2021 from the Ameris Bank Amphitheatre, Alpharetta Georgia. These 2 fabulous drummers are clearly good friends and lots of fun to talk to - I thank to them both for giving up their time so generously.
