EVERYONE IN THE tiny Harney County town of Westfall knew something bad was going to happen after City Marshal Asa Carey was fired for the second time. Carey had been an odd pick for city marshal, but maybe he'd been given the job because he wanted it badly — and Carey was a dangerous man to say “no” to. Basically, he was the “Bad Bad Leroy Brown” of Westfall ... right down to the “.32 gun in his pocket for fun,” about which more in a red-hot minute. And the town council really should have known better. This was not Carey's first time being entrusted with the town marshal's baton. His first term in office had gone a long way toward demonstrating to everyone in Westfall that giving the “meanest man in the whole damn town” a badge was bad for business. In fact, Carey appears to have been one of the main reasons the town had a regional reputation as a nest of hooligans. In 1906, while serving as marshal, Carey had gunned down fellow Westfall resident Frank Cammeron in a fight. He was acquitted on a plea of self-defense; but three years after that, he got in a fistfight with 80-year-old Dan Brady and beat the frail octogenarian to death. Both of these little incidents had made headlines statewide. The Brady incident appears to have been the point at which the town council replaced Carey as town marshal, ending his first term of office by appointing a hardware-store clerk named Ben Corbett to the position. Doubtless the town's business leaders breathed a sigh of relief. But 'Bad Bad Asa Carey' wasn't going to go quietly .... Last week I alluded to Malheur—a French word which translates as “misfortune”—having a kind of name-place irony, back in 2016. It was national news. Maybe you recall?But, before I go further I want to take a moment to say that telling this story makes me a bit uncomfortable. On the surface it has little to do with the sound of Malheur, with music, with a connection to nature. And, because it involves the US Government, it has political overtones. Birds aren't political, right? Why dredge it all up? Aren't we all overburdened with current events as it is?Literally speaking, birds are not political. But, birds have symbolic resonance. “Hawks” want war, “doves” seek peace. Consider the phrase “canary in the coal mine”. What does it mean, exactly? It's a metaphor that relies on the sensitivity of birds to detect danger. Canaries are more sensitive to toxic air than humans. Sometimes stories from the past can help bring the present into focus. Posting about politics just seems exhausting and unproductive, right? It's usually just preaching to the choir in an echo chamber. Meanwhile, reading political articles often just leads to feeling a pit in one's stomach. I know I'm not alone, and I know it happens across political divides. While I do feel timid, learning about the history of the landscapes I visit makes me to feel more connected to them, and gives me a little courage to bring up uncomfortable, but worthwhile topics. The Malheur Wildlife Refuge OccupationIn January of 2016, a far-right militia led by Ammon Bundy, averaging maybe a two to three dozen in number, occupied the Malheur Wildlife Refuge. Their demands? That the Federal Government cede ownership of refuge lands to “the people of Harney County”, and for ranchers to be allowed to graze their cattle as they see fit, unencumbered by federal permits. It was a stunning move, coupled with unusual imagery: video clips of AR rifle-toting men shuffling around in cowboy hats and winter coats, speaking in soft voices. Their enemy, the federal government, was an off-camera abstraction, seemingly immutable as the snow-covered landscape. It was a strange spectacle. The backstory for this flashpoint goes back many years, involving episodic tensions over federal land use in the western US. The reason it played out at Malheur National Wildlife Refuge seems like, well, bad luck—misfortune. The spark was the re-sentencing of two local ranchers, the Hammonds (father and son) to serve out the remainder of a minimum five year prison term for a conviction of arson. (An exhaustive Wikipedia entry on the arson cases does not paint a sympathetic portrait of the Hammonds' actions.) A small protest rally for the Hammonds in nearby Burns, OR in December 2015 was co-opted by Bundy and others—who all lived out of state—when they attempted to galvanize resentments, and escalate the protest. This took shape as the occupation of the nearby Malheur Wildlife Refuge, which lasted for 41 daysIn the aftermath, one occupier, LaVoy Finicum, was shot dead in a climactic altercation with FBI and law enforcement. The federal government tallied over six million dollars in costs for repair and restoration to the refuge facilities, while state and county agencies attributed over three million dollars in costs related to the dust-up. The vast majority of county residents, and the Hammonds themselves, did not approve of the occupation. In a surprise legal conclusion, Ammon Bundy and six other occupiers were acquitted of conspiracy to impede federal officers, the charge the government brought in the wake of the ordeal. The verdict seemed to be chalked up to: 1) A thin presentation with scant evidence meeting the specific requirements of the charge, and 2) far-reaching defense arguments, including revelations FBI informants may have overstepped with behaviors that smacked of entrapment. Together this appeared to sow reasonable doubt in the minds of the jurors.The verdict was a bitter pill for most people following the story to swallow. How is it possible that a small number of people could take over a wildlife refuge—involving breaking and entering, aggravated trespass, and trespass with a firearm—for well over a month and face no consequences? Some observers see a loose connection between Malheur and the January 6th attack on the US Capitol. Malheur was arguably a precursor, emboldening extremist groups by reinforcing the idea of taking over government property as a viable form of protest.In this way the president's broad pardons given to over 1200 individuals convicted for their involvement in the 2021 Capitol riot does not bode well.So…?So where does that leave us today? Well, for starters, Malheur Wildlife Refuge (and the nearby Steens Mountains, and Alvord Desert) are wild, beautiful, wide open places. If that sounds interesting, consider making the trip! You'll be happy you did!But what else is it about the 2016 Malheur occupation that seems uncannily similar to right now? Is there a canary in a coal mine here?Let's think…A small number of people…taking over government buildings…wielding power like self-righteous vigilantes…with a disdain for bureaucracy…a hostility toward government oversight…a belief in private control over public resources…a belief that their actions represent the will of the people, when it's far from clear that they do. Sound familiar?I have an answer in mind and maybe you do too. But, I don't want to dignify the annoyingly-named entity by mentioning it here.Any conclusions one can draw from the Malheur occupation are blurry, unsatisfying, and when tallied up in a ledger, offer more losses than gains. From a more detached point of view—perhaps closer to that of a migratory bird—all that remains when you subtract out the egos, the surprise plot twists, the courtroom dramas, the short-sightedness, the logic and the absurdity of it all, is the wordless landscape. The habitat.Is the habitat more or less functional? Water, food, shelter—is it easier or harder to come by? For some, or for all?Habitats like Malheur can appear simple at a glance. Wet basin, scrubby uplands, big sky. Boring. But if you bear witness to the land, if you just listen to it in the spring, you can hear it. It's complex. It's structural. The sound has order. The wildlife voices fit together, they make room for one another. I would go so far as to say it's musical. It's a complexity forged over time. Oregon archaeologists have found evidence of human occupation in the state that dates back more than 18,000 years. University of Oregon students and faculty working at the Rimrock Draw Rockshelter in Harney County found stone tools and fragments of camel and bison teeth beneath a 15,000-year-old layer of volcanic ash. Radiocarbon dating of the tooth enamel revealed that the fragments were 18,250 years old. Due to their position in the ash, the tools are thought to be even older — making them some of the oldest evidence of human civilization in North America.Joining us with more details about the discovery is Pat O’Grady, a staff archaeologist at the University of Oregon Museum of Cultural and Natural History.
In 2019, the remote plains of Harney County, Oregon made national news. Scattered amongst groves of ponderosa pine were a handful of mutilated cattle. The cows had an almost surgical removal of their tongues and other organs. But the most astounding thing is that the scenes where these cattle were found were pristine. No tracks. And not one drop of blood – the carcasses were drained dry. That detail became the inspiration for a documentary by co-directors Jackson Devereux and Lachlan Hinton, and reporter Anna King. Their documentary film – three years in the making – is titled “Not one Drop of Blood,” and it’s being announced as the headliner today for the Film Fort festival – part of Tree Fort in Boise. Soundside was joined by Anna King, alongside co-directors Lachlan Hinton and Jackson Devereux, to discuss the film and the mystery haunting Harney County, Oregon. AS EVERY SENSIBLE person knows, there is pretty much no such thing as being “cruel to be kind.” Sometimes it does work the other way around, though. Every now and then you run across a story in which someone did something that was intended as a kindness, but turned out to be anything but. Such a case happened in the office of Oregon Governor Oswald West, sometime in 1912. It had to do with a little shooting scrape that Z.H. Stroud, an acquaintance of West's, had gotten into in the little frontier town of Harney City, where he was the town marshal. Reading between the lines of the story, it's clear that the governor's well-intentioned intervention was probably the worst thing that could have happened to Marshal Stroud, and precipitated the closest thing Oregon history has to Arizona's famous O.K. Corral gunfight. Which, as I'm sure you've gathered, the lawman lost.... Philanthropy talks about collaboration regularly - Brenda Smith with High Desert Partnership lives it every day. She and her colleagues work to build common ground and relationships between seemingly disparate stakeholders in rural Harney County, Oregon. Collaboration is fostered and supported from the ground up; and comes from all sides. This was especially evident in the occupation of the Malheur Wildlife Refuge in 2016. The narrative of that event as well as the story about rural Harney County and it's residents, was told in mainstream media, yet the local perspective was not included.
LONG SYNOPSIS: Last month, the girls and boys basketball teams at Crane Union High School in Eastern Oregon won state championship titles at the Oregon School Activities Association 1A tournament in Baker City. The smallest schools in the state compete in this division, including Crane, which is located in Harney County and currently has 84 students. It’s the third consecutive state title for the boys basketball team, and the fourth state title in the past five years for the girls team which ended their season undefeated. Oregon archaeologists have found evidence of human occupation in the state that dates back more than 18,000 years. University of Oregon students and faculty working at the Rimrock Draw Rockshelter in Harney County found stone tools and fragments of camel and bison teeth beneath a 15,000-year-old layer of volcanic ash. Radiocarbon dating of the tooth enamel revealed that the fragments were 18,250 years old. Due to their position in the ash, the tools are thought to be even older — making them some of the oldest evidence of human civilization in North America.Joining us with more details about the discovery is Pat O’Grady, a staff archaeologist at the University of Oregon Museum of Cultural and Natural History.

On January 2nd, 2016 a far right group calling themselves the Citizens For Constitutional Freedom, lead by Ammon Bundy, took control of the Malheur National Wildlife Refuge in Harney County, Oregon. They were seeking the release of 2 men convicted of arson of federal land as well as demanding the release of federal land back to the state. This event made headlines with the shooting of Lavoy Finicum by Oregon State Police which was captured on video. By February 11th it was over with 9 of the occupiers ending up in prison. Two Republican state lawmakers from Eastern Oregon are pushing Oregon Gov. Kate Brown to allow broad exemptions for health care workers, teachers and other state employees who will soon have to show proof of COVID-19 vaccination or a documented exemption to keep their jobs. The lawmakers say requiring vaccines will not lead to more shots in arms and will only fuel distrust from rural Oregonians who are already skeptical of government mandates. Meanwhile, a doctor in Harney County is hesitant to recommend the vaccine to patients, instead encouraging them to “read both sides and make a decision.” OPB's Central Oregon Bureau Chief Emily Cureton spoke to the lawmakers and the Harney County doctor. We get details from her.
Cameron Sanders is a man of many hats. He's worn a spelunking helmet, a bicycle helmet, a race directors cap, and a work hat as the VP of Product Development and Marketing for Wren Sports. On this episode we focus on the Stetson hat he donned as a Park Ranger shortly after a armed group of far-right extremists seized and occupied the headquarters of the Malheur National Wildlife Refuge in Harney County, Oregon. Cameron went into a very difficult situation where tensions were high and a community was divide and, as a good outdoorsman, he left it better than he found it. Cameron used his love for public lands, the people who use them, and his love for exploring the world on his bike to help a community heal. That healing came by way of a gravel bike race that showcases the this region of Eastern Oregon in a whole new light. This armed takeover of a government building is complicated with a history that goes deep. On today's episode of the Resistance Library Podcast Sam and Dave discuss the Oregon Standoff and why it's important. When one talks about the Bundy Family, the first thing that springs to mind is the standoff in Nevada in 2014. However, perhaps even more important is the standoff and occupation at Oregon's Malheur National Wildlife Refuge in 2016. Indeed, the two events are often conflated because Ammon Bundy is the son of Cliven Bundy, the man who stood up to the federal government over “grazing fees” on Bureau of Land Management land. The occupation was a highlight for both the militia and the sovereign citizen movement as well as proponents of states' rights. The main argument from those occupying the land is that the federal government is mandated by law to turn over the land that they manage to the individual states in which the land sits. This, they argued, was particularly true of the Bureau of Land Management, United States Forestry Service, and United States Fish and Wildlife Service land. The 2016 Oregon standoff was over two ranchers convicted of arson on federal lands – despite the fact that the men, a father and son pair named Dwight and Steven Dwight Hammond, did not want their support. Harney County in rural eastern Oregon is one of the largest counties in the United States by land mass, but one of the smallest when it comes to population. With a mere 7,700 people, cows outnumber humans in Harney by a factor of 14-to-1. Nearly three quarters of the land in the county is federally managed. The Malheur National Wildlife Refuge was established by then-President Theodore Roosevelt in 1908. It's a large area of the county and surrounding area at 187,757 acres. For the last four years, community members from Adel, Oregon and Lake and Harney County have collaborated with a broad group of stakeholders to determine how, together, they could best assist the growing list of uses on the 437,120-acre Beaty Butte Herd Management Area (HMA). From these meetings came a ground-breaking commitment to create a first-of-its-kind, combined public and private wild horse program. A cooperative agreement between BLM and the Beaty Butte Wild Horse Training Facility, a non-profit organization, was created in efforts to resolve over population of Wild Horses in the Beaty Butte area, which has been funded by a 5-year One Million Dollar BLM Grant.
