In one of their most professional efforts ever (even with Alfredo's audio sounding like a Jack in the Box drive-thru speaker) the HBTG boys visited with Samantha Swindler -- features reporter, videographer, chronicler of all things weird, intriguing, and off-the-beaten path for The Oregonian/OregonLive -- to learn more about her recent efforts to determine the oldest continuously operating bar location in Oregon. It was a search that ultimately came down to the Rainbow Cafe in downtown Pendleton and a place called Pioneer Saloon in the tiny ranching community of Paisley in South-Central Oregon. Both claimed 1883 and, as we revealed in the interview, neither turned out to be correct. But one eventually stood alone as the undisputed oldest bar in Oregon. He is prepared to go to trial if that is what the case requires. Cody has been first chair at over 40 trials. He leads Stoll Berne's team in the class action lawsuit against PacifiCorp for starting fires across Oregon during the Labor Day 2020 storm. He was co-lead trial counsel in an 8-week trial where the jury found PacifiCorp liable to a class of several thousand people for gross negligence, punitive damages, and other claims. The jury awarded on average approximately $5 million to each of the 17-named plaintiffs. He was also co-lead trial counsel in the first and second damages-only jury trials on behalf of 19 more class members. The juries awarded several million dollars per person. The trials and litigation, including the work by Cody and his colleagues at Stoll Berne, have been featured in national and local news, including NPR, the Washington Post, Oregonlive, the New York Times, Bloomberg, Reuters, and the AP. Along with representing wildfire survivors and their families, Cody advises investors who lost money because of fraud and other misconduct and plaintiffs in class actions. His class action experience includes securities, consumer, ERISA, food labeling, and fire cases. Cody's practice also includes commercial and complex litigation. He is an active member of the Oregon Trial Lawyers Association. Cody previously worked as a deputy district attorney at the Multnomah County District Attorney's Office. Before that, Cody represented individuals and businesses in cases involving investment fraud and a wide range of business disputes at a large Northwest firm. He received the Haglund Award in 2016 from the Multnomah Bar Association. He was selected as a Future Star in Benchmark Litigation and also named in The Best Lawyers in America and Oregon Super Lawyers. During law school, Cody interned for U.S. District Court Judge Kimberly Mueller and U.S. Magistrate Judge Carolyn Delaney. Elected to Order of the Coif, he received the Clinical Legal Education Association Award and a Witkin Award. Cody also represented clients as a law student at the Civil Rights Clinic and Prison Law Clinic and earned a Public Service Certificate. The backstory to the mystery of ‘Cosmo the talking crow'

Any newspaper editor will tell you readers love animal stories. The Oregonian/OregonLive's Samantha Swindler took that axiom to the next level this spring with a 12-part video series on the mysterious disappearance of Cosmo, the talking crow. She joins Editor Therese Bottomly on “Beat Check with The Oregonian” to discuss the narrative, which also was published on Instagram, Facebook and, of course, OregonLive. Cosmo first came to the newsroom's attention after a viral story out of Williams about a talking crow that had “befriended” an elementary school. Swindler, who works on the Here is Oregon features team, reached out to obtain audio or video of this supposed talking crow. She quickly learned Cosmo was missing and the crow may not have been the beloved local fixture we first envisioned. Originally conceived as a podcast, “The Mystery of Cosmo the Talking Crow” quickly morphed into an experiment in creative multimedia storytelling on TikTok, the social media platform so much in the headlines these days. In this episode of Beat Check, we talk about: --Why Swindler was drawn to the quirky story --The reporting challenges she faced --The question of whether Cosmo really did talk --Why humans can't resist anthropomorphizing animals -- that is, attributing human behaviors and motives and emotions to our pets Within the episode, Swindler refers to “Serial,” the groundbreaking and hugely popular true crime podcast (We are careful to note nothing about the Cosmo story involves actual true “crime.”). She also makes reference to a “milkshake duck” moment, a reference to a fictional duck that is cute and beloved until it is revealed to be racist. Like that internet meme, Cosmo, too, was cute on the outside but perhaps had a touch of evil within, depending on who is talking. And Swindler still hopes for “The Jinx” reveal, as in the HBO docuseries hot-mic moment where Robert Durst appears to confess. Coming into her senior season, Lake Oswego's Mia Brahe-Pedersen already has the things many of her Oregon high school peers are seeking. She's already a 12-time state champion (three each in the 100-meter dash, 200-meter dash, 4x100-meter relay and 4x400-meter relay), a two-time Oregon Gatorade Player of the Year, an 11-time national champion and a 22-time All-American. She holds the Oregon high school record in the 100 (11.00 seconds), 200 (22.43), 4x400-meter relay (3:48.49) and the 4x200-meter relay (1:39.86), she's signed a name, image and likeness deal with Nike and she's already committed to run for USC. Though police originally claimed they did not believe that the cases were connected, similarities emerged between four of the women, and one man linked them all. Maxine Bernstein has covered a lot of stories in her more than two decades with The Oregonian and now OregonLive. A recent Saturday run along the waterfront quickly gave way to a long day's work when she heard reports of a shooting at Legacy Good Samaritan Medical Center, not far away in Northwest Portland's Nob Hill District. In this episode of Beat Check with The Oregonian, Bernstein and Editor Therese Bottomly walk listeners through the chaotic day, which took Bernstein from Good Sam to the Stadium Fred Meyer to Gresham and then home, where she confronted an unusual ethical challenge. Bottomly recently wrote about challenges that day, July 22, in getting solid and accurate information from official sources to reassure the public, which had been told an assailant was on the loose and Good Sam under lockdown. The Portland Police Bureau gave detailed responses explaining their reasoning in releasing what information they did and describing what they must consider before letting information out to the public. When you hear perennial, you probably think of peonies rather than pines. Mayorkas Texas Republican Rep. Pat Fallon has filed impeachment articles against Homeland Security Secretary Alejandro Mayorkas, delivering on a promise he made last week before the 118th Congress was officially sworn in. The articles of impeachment against Mayorkas for "high crimes and misdemeanors," known as House Resolution 8, were introduced by Fallon in the House on Monday and have been referred to the House Judiciary Committee. Last week, Fallon vowed to file impeachment articles against Mayorkas after the Congress was sworn in. The effort from Republicans in the House is one of many that the new GOP majority will take as it works to fight the Biden administration on issues related to immigration and the southern border crisis. While there is currently no text available for the impeachment articles filed against Mayorkas, Fox News reported last week that Fallon's first article alleges that Mayorkas has failed to faithfully execute the "Secure the Fence Act of 2006." The article says that law requires the secretary of Homeland Security to "maintain operational control over the entire international land and maritime borders of the United States." The second article alleges that Mayorkas, "in violation of his constitutional oath, willfully provided perjurious, false, and misleading testimony to Congress." To back up that charge, the article quotes Mayorkas' testimony during April 26 and Nov. 15 congressional hearings in which he said the border was secure. The final of the three articles charges that Mayorkas "publicly and falsely slandered" border agents who were accused – but later cleared – of whipping Haitian migrants in Del Rio, Texas, in 2021. In February, McCarthy told the Daily Caller that if he is elected Speaker that he intends to strip Omar from the Foreign Affairs Committee and Swalwell and Schiff from the Intelligence Committee. On Monday, McCarthy confirmed to The Associated Press (AP) that he would be moving forward with that decision, saying both Swalwell and Schiff should not have seats on the committee. McCarthy has said Swalwell’s reported relationship with a Chinese spy and Schiff’s defense of the Steele dossier are some of the reasons they should be removed from the committee. McCarthy has said Omar’s anti-Semitism is a reason she should be removed from Foreign Affairs. “Swalwell can’t get a security clearance in the private sector. I’m not going to give him a government security clearance. Schiff has lied to the American public…,” McCarthy told The AP. According to Oregon Live, "A staggering 61 percent of third graders and 54 percent of seventh graders aren’t fully proficient at reading, including 30 percent of seventh-graders found to be substantially below grade level" in the Beaver State. The measures of success according to the guidance include telling students, "You have the ability to change your first name in your school record and student information system, without legal documentation" and "You have the ability to change your sex/gender marker in your school record and student information system." "You have the ability to use school restrooms and changing rooms that align with your gender identity or safety needs," according to the guidance. The guidance also includes informing students they can "date who you want, if you want" and can form student groups focused on LGBTQ2SIA+. The plan offers textbooks and guidance to students so they can learn "inclusive and affirming information about the LGBTQ2SIA+" community and inform the students they can participate in "sports, PE, and school activities according to your gender identity." "If you are 15 or older, you have the ability to seek gender-affirming healthcare from an Oregon medical provider," according to the list of resources, which also remind students they can seek mental health resources if they are 14 or over and get birth control if they are "any age." The guidance provides a detailed list instructing students where they can receive "gender affirming care" that includes details on "tucking" and "chest binding." The recent guidance release is part of Oregon's larger LGBTQ2SIA+ Student Success Plan that was developed in 2020 "amidst the global COVID-19 pandemic."
