In this conversation, Dr. Joel Zinberg discusses the complex relationship between health insurance and health outcomes, arguing that while insurance provides financial security, it does not significantly improve measurable health outcomes. He critiques the focus on government insurance programs like Medicaid and the Affordable Care Act, highlighting issues with access to care and the effectiveness of preventive measures. The discussion also emphasizes the importance of behavioral factors and medical innovation in improving health, suggesting that a shift in focus is needed to address the root causes of health issues, such as obesity and chronic diseases.
Join host Joe Grogan as he chats with Dr. Joel Zinberg, a senior fellow at the Competitive Enterprise Institute, in this insightful episode. Dr. Zinberg brings a unique perspective with his dual background in medicine and law. He shares his fascinating journey of pursuing both an MD and JD simultaneously, and how he balanced the demands of a surgical residency with law school. In this episode, Dr. Zinberg provides valuable insights into his work in organ transplantation, highlighting the ethical and legal challenges involved. The conversation then explores the rapidly evolving fields of telehealth and artificial intelligence (AI) in healthcare. Dr. Zinberg expresses his skepticism about the widespread enthusiasm for telehealth, calling for a deeper analysis of its effectiveness and cost-saving potential. Regarding AI, he discusses how, despite its administrative benefits, AI cannot fully replace human physicians in diagnosing and recommending treatments due to its inability to assess crucial factors like a patient's demeanor and psychological state. Dr. Zinberg also critiques recent Federal Trade Commission (FTC) decisions, particularly concerning pharmacy benefit managers (PBMs), arguing that these actions are based on insufficient evidence and unproven legal theories, lacking empirical support. Tune in for an enlightening conversation that delves into pressing issues in healthcare today! For many years FDA has claimed the authority to regulate Laboratory Developed Tests, that is tests that are designed, produced, and used in a single lab – never being put up for sale. This authority, however, has been contested, and the FDA itself has traditionally practiced “discretionary enforcement,” wherein it has regulated LDTs very little. A change occurred in October 2023 when the FDA issued a notice of proposed rulemaking wherein it indicated its intention to codify its claim of authority and begin enforcing oversight of LDTs. Dr. Joel Zinberg, M.D., J.D., joined us to discuss the history the FDA’s regulation of LDTs, the proposed rule, and what the ramifications may be. Featuring: Dr. Joel Zinberg, Senior Fellow, Competitive Enterprise Institute

This past year, the House Select Subcommittee on the Coronavirus Pandemic, chaired by Rep. Brad Wenstrup (R-OH), has conducted several outstanding oversight investigations into the performance of federal agencies that failed to respond effectively to the national medical emergency. These investigations revealed that federal officials failed to provide compelling information on the origin of the pandemic. They confused the public with mixed messages on the rationale and effectiveness of masking and provided weak scientific justifications for comprehensive vaccine mandates and extended school closures.Three federal agencies that have major responsibilities in responding to a national health emergency are the Centers for Disease Control and Prevention (CDC), the National Institutes of Health (NIH), and the Food and Drug Administration (FDA). Congress needs to reassess these agencies, clarify their roles and missions, and retarget funding, enabling them to cope more effectively in a future medical emergency.HHS former General Counsel Robert Charrow, American Enterprise Institute's Dr. Brian Miller, and Paragon Health Institute's Dr. Joel Zinberg will address these and related issues. Since the identification of the “Omicron Variant” of COVID-19, the left and paternalist factions of the right at home and abroad have returned to their favorite policy packages: Harsh lockdowns and tyrannical mandates. And while the American President has ruled out lockdowns “for now,” his party comrade Bill de Blasio, who remains Mayor of New York until the New Year, instituted the most severe vaccination passport regime this side of the Atlantic. No one over the age of five will be permitted to engage in almost any public activity without showing their papers in the so-called “greatest city in the world,” and a harsher edict on workers than President Biden's OSHA vaccination mandate that has been enjoined by federal courts will take effect before the end of the month.
