In this episode of Everyday Injustice, we sit down with Rachel Barkow, a law professor at NYU and an expert on criminal justice reform. We discuss President Biden's final clemency actions, the larger implications of mass incarceration, and her upcoming book, Justice Abandoned: How the Supreme Court Ignored the Constitution and Enabled Mass Incarceration. Barkow offers a critical look at the failures of our criminal legal system, the role of progressive prosecutors, and the Supreme Court's role in shaping mass incarceration. Professor Barkow offered a critical look at the state of criminal justice reform, the failures of the Supreme Court, and President Biden's last-minute clemency decisions. Barkow expressed disappointment with Biden's handling of clemency, noting that while he commuted 37 federal death row sentences and granted some relief for nonviolent drug offenders, he ignored hundreds of cases recommended by the Justice Department. She criticized the flawed clemency process, which requires prosecutors to review their own past cases, making positive recommendations rare. Discussing the political backlash against criminal justice reform, Barkow argued that progressive prosecutors like Chesa Boudin and Pamela Price were vulnerable because they failed to enact structural reforms. While some jurisdictions elected reform-minded prosecutors, the movement faced well-funded opposition and public fear over crime rates. She noted that lasting change requires legislative reforms, not just individual elections. Barkow's upcoming book, Justice Abandoned, examines six Supreme Court cases that fueled mass incarceration, including Terry v. Ohio, which enabled stop-and-frisk policing, and U.S. v. Salerno, which allowed pretrial detention based on “dangerousness.” She argued that the Court has repeatedly ignored constitutional principles in favor of political expediency, contributing to the rise of mass incarceration. Despite setbacks, Barkow remains hopeful that public awareness and political momentum can lead to long-term reforms. She urged advocates to focus on institutional changes that can outlast political cycles and to challenge harmful Supreme Court precedents that continue to shape the justice system today.

A century ago, journalist H. L. In this episode we discuss the following: Leaders can come from anywhere, because leadership is a behavior, not a position, a verb not a noun. We can lead by example, by challenging the status quo, by having difficult conversations, or by listening to others. Ultimately, we get to decide what kind of leader we want to be. Age unnecessarily divides us in many ways, especially given that age is the only universal social category. We will all join each of ages identities and subgroups if we live long enough. But rather than glue us together, age often divides us, whether its younger people saying, “Okay, boomer” or older people lamenting “kids these days.” Generational tensions are not new. There are quotes dating back to 800 BC where the older generation complained about the younger generation in the same way we see today. Although both young and old are discriminated against, sadly young people tend to be viewed most negatively, both from older and younger generations alike. One way to bridge the generation gap is to recognize that advice given by young people is equally as good as the advice given by old people. Just as leadership can come from anywhere, so too can good advice. We probably focus too much on chronological age. When we buy a product off the shelf, we rarely think about how much work went into getting it there. Between initial conception and going to market, life-changing technology requires a rigorous testing and development process. That is especially true when it comes to accessible technology for people who are blind or visually impaired. For this episode, Dr. Cal spoke to Jay Cormier, the President and CEO of Eyedaptic, a company that specializes in vision-enhancement technology. Their flagship product, the EYE5, provides immense benefits to people with Age-Related Macular Degeneration, Diabetic Retinopathy, and other low-vision diseases. But this product didn't arrive by magic. It took years of planning, testing, and internal development to bring this technology to market. This episode also features JR Rizzo, who is a professor and researcher of medicine and engineering at NYU — and a medical doctor. JR and his research team are developing a wearable “backpack” navigation system that uses sophisticated camera, computer, and sensor technology. JR discussed both the practical and technological challenges of creating such a sophisticated project, along with the importance of beta testing and feedback.   The Big Takeaways: The importance of testing: There's no straight line between the initial idea and the final product. It's more of a wheel, that rolls along with the power of testing and feedback. It's extremely important to have a wide range of beta testers engage with the product. Their experience with it can highlight unexpected blind spots and create opportunities to make something even greater than originally anticipated. Anticipating needs: When it comes to products like the EYE5, developers need to anticipate that its users will have evolving needs as their visual acuity deteriorates. So part of the development process involves anticipating what those needs will be and finding a way to deliver new features as users need them. Changing on the fly: Sometimes, we receive feedback we were never expecting. When JR Rizzo received some surprise reactions to his backpack device, he had to reconsider his approach and re-examine his fundamental design. Future-Casting: When Jay Cormier and his team at Eyedaptic first started designing the EYE5 device, they were already considering what the product would look like in the future, and how it would evolve. Is involuntary psychiatric treatment a solution to the intertwined crises of untreated mental illness, homelessness, and addiction? In recent years, elected officials and advocates have sought to expand the use of conservatorships, a legal tool used to require someone deemed “gravely disabled" (e.g.,  unable to meet their needs for food, clothing, or shelter as a result of mental illness) to take medication and/or be placed in a facility (often locked) under the care of a guardian for a defined period (usually one year at a time).    This is Part Two to a conversation with Professor Alex Barnard.  Two years ago, Heart Forward interviewed Barnard who was in the initial stages of his research into California's laws under the umbrella of the Lanterman-Petris-Short Act adopted over 40 years ago.  It would be advisable to listen to that interview first.  Since that time, he has managed to publish a book which is an excellent resource, and that is the focus of this interview.  Conservatorship is an incisive and compelling portrait of the functioning—and failings—of California's conservatorship system. Drawing on hundreds of interviews with professionals, policy makers, families, and conservatees, Professor Barnard takes readers to the streets where police encounter homeless people in crisis, the locked wards where people receiving treatment are confined, and the courtrooms where judges decide on conservatorship petitions. He will make a case that  California's state government has abdicated authority over this system, leaving the question of who receives compassionate care and who faces coercion dependent on the policies and priorities of California's 58 counties, the financial incentives of for-profit facilities, and the constraints of under-resourced clinicians.  He gives a voice to the desperate struggles of families to obtain treatment for their loved ones and the challenges people with mental illness themselves face getting the services they want and need. Growing up, Author Sivan Hong struggled to focus on reading long enough to connect with the text, until she discovered audiobooks and a whole new world opened up for her. Years later Sivan was diagnosed with ADHD and she finally understood why visual reading had been such a challenge for her and had caused so much unnecessary shame.    Sivan's diagnosis opened her eyes to how much easier things could've been if her different learning style had been encouraged and she was inspired to start writing books that show how neurodivergent differences can be turned into strengths if given the right supports.    Her books, which are of course offered in both written and audiobook format, focus on helping neurodiverse children face changes and challenges with courage, and just as importantly, they aim to normalize different behaviors and supports for all children. In her words, “We normalize these differences. And then it becomes okay, right?
