Riker Danzig partners Stuart Lederman and Rudy Randazzo were our special guests for the 5th episode of Season 3, moderated by our co-hosts Michael O'Donnell and Bethany Abele. Stuart and Rudy practice in Riker's Governmental Affairs and Litigation practices with extensive experience in Eminent Domain and Condemnation Law as well as Construction Law, regularly navigating issues of title, and frequently interacting with our title insurance attorneys at the intersection of title law and real property condemnations. Stuart and Rudy represent both governmental entities who are acquiring properties, and also property owners whose properties are targeted to be taken for particular government projects. What You Will Hear on This Episode: What are the key stages of the condemnation process? Is it important for property owners to attend early meetings on government projects that may impact their properties? What are the public purposes for which a property may be taken? To whom may the government delegate the power of condemnation? Does the governmental entity have the right to conduct a property title search in advance of a taking? How is fair market value determined? Is lost business taken into consideration? What are bona fide negotiations and when can a condemnation complaint be filed? Whose interests are important in properties being taken? What is a “quick take”? Can a property be taken and put to public use even while litigation over rights and fair market value is pending? What are critical defenses to a real property taking? How do you prove a pretextual purpose (improper motives, bad faith or abuse of power)? (Essex Fells v. Kessler Institute and Atlantic City v. Trump Casino) What constitutes failure to negotiate, and can this prevent the taking? What is the role of condemnation commissioners, and who has the burden of presenting evidence to establish value at trial? What are the implications if it is not a “full” taking? Is the government required to pay for another party's environmental damage to the property? What are the special implications for lien holders of a property being taken? Are judgments final, and can the property owner appeal? What is an inverse taking? In addition, Stuart and Rudy shared some interesting anecdotes from their wide-ranging experience representing government agencies tasked with taking property, including allowing a “jury view” of the condemned property during a trial on the taking, and another case where the property owner resisted the taking by hiring private militia to face down the bulldozers, creating a standoff between the armed militia and the local National Guard brought in by the governmental entity. They also touched on their related Construction Litigation practice and the dovetailing of the two practices, particularly when temporary easements are recorded on taken properties for large construction projects, and construction delays ensue with adverse effects. Next, Bethany interviewed our newest associate in the Title Insurance practice, Shelley Wu, who discussed Moldovan v. Long, No. 1 CA-CV 23-0470, 2024 Ariz. App., Unpub. LEXIS 460 (Ct. App. May 30, 2024). In this case in the Arizona Court of Appeals, the court affirmed a summary judgment in favor of a settlement/escrow agent, finding no breach of duty where the agent sufficiently disclosed to the seller the existence of a potentially fraudulent deed but did not further investigate or determine its validity. Bethany and Shelley discussed many of the noteworthy statements in the appeals court's ruling that sheds light on the responsibilities of disclosing additional deeds, and concerning negligent misrepresentation claims. Key questions addressed in Moldovan v. Long: What are the responsibilities of escrow agents and where are those responsibilities outlined? Episode 7 features one of Riker Danzig's impressive retired judges, the Hon. Travis Francis, who was Assignment Judge for Middlesex County, Superior Court of New Jersey before joining Riker Danzig. Judge Francis is now an active mediator and discovery master in the Firm's Alternative Dispute Resolution Practice. Co-Host Bethany Abele interviews Judge Francis about some of the intriguing title insurance and real estate cases that came before him when he was on the bench, including issues of quiet title, specific performance and adverse possession. Co-Host Michael O'Donnell joins Bethany and Judge Francis in the discussion, which headed “into the weeds,” literally, as cases involving farmers and fences kept “cropping” up. Keeping us on track, Judge Francis provides insights and best practices for counsel bringing title insurance cases, including guidance on pursuing orders to show cause and motions for relief to provide for a good experience with the deciding judge. Next, Mike invites Riker Danzig attorney Kevin Hakansson to unpack the Cherry v. Ziad Hadaya case, 2021 N.J. Super. Unpub. LEXIS 2571 (App. Div. Oct. 29, 2021), in which the NJ Appellate Division held that neighbors could enforce deed restrictions tracing back to a 1928 deed to prevent another neighbor from subdividing their property. In Cherry, Defendants owned a plot of land on Jefferson Road in Princeton that was originally part of a larger parcel conveyed in 1928. While the 1928 deed contained restrictions on the land regarding subdivision, the 2004 deed did not. After the defendants received approval from the Planning Board in 2008 to subdivide its property into two lots, and later applied to subdivide the larger resulting lot into two more lots, the plaintiffs, who owned neighboring properties, filed a complaint seeking to void the 2008 subdivision and to enjoin further subdivision based on the 1928 deed restrictions relating primarily to the frontage of the lots. The Chancery Court dismissed some neighbors' claims for lack of standing as they were not in the chain of title of the 1928 deed. But it granted summary judgment for the other plaintiffs whose properties were within the 1928 deed chain of title and ordered the Defendants to re-convey the plots back to their 2004 dimensions. On appeal, the Appellate Division affirmed, agreeing that enforcement of the 1928 deed restrictions was reasonable, and that plaintiffs in the chain of title were among those intended to be incorporated into the neighborhood scheme.

Part 2 How to screw up your Kickstarter project with Fabio Redivo.As a continuation of our previous conversation, Fabio outlines the other five things he did to contribute to the failure of his Kickstarter campaign.These are:6 - Not having a playthrough video7 - Not having a PNP8 - Rely on artwork only9 - A lot of money for the first project10 - Count on friends and family6, 7, 8 - Are in the same bucket. Fabio is a graphic designer and works as a brand director for a digital agency in NYC. He used to be in the comic book industry for 8 years as an artist and did a little bit of everything there. He worked for big companies, and self publish, allowing art and design to become a part of his life. When he thought of his game, that's where his focus was. Art and design. He confesses that he had ideas for how the game plays, that it was so simple that he put it on the back burner and laser focused on showing his art style for the cards. He didn't bother to explain how to play with the beautiful cards he was designing.His lesson learned?: WRONG! A game is a game first, if it's not fun, doesn't play well, doesn't matter how good it looks. Art and design enhance the experience, but it doesn't dictate. How he says he will be writing the ideas, testing his next game, going to Unpub events monthly, playtest, playtest, playtest. Then he'll go draw pretty cards.9 - H set 15K for his first project. That looks like a lot of money for a first-time game designer. That would cover print and shipping cost plus the fees for Kickstarter. With 15K he would not make money back at all, just a couple hundreds. That is because he only quoted with AD Magik. He went full premium on the cards, 310gsm, linen finish, black core... So it was costly to produce. He wanted to give the backers high quality, no compromise. But you can't give backers anything if you don't get funded. He also was planning to have 300 cards. It's a lot of cards to produce. 300 cards need custom boxes, and those are very pricey. The whole budget was a disaster.In the other end of the high price, he wanted to sell games + custom cards for $100. He quickly realized that nobody will spend THAT kind of money on a nobody's game. Lesson: Start small. Have a fun thematic card game that doesn't cost much to print. Quote an MVP and work your way up with stretch goals to make the game better. Be aware of press sheets to reduce the cost of productions. 280gsm blue core is a good start. Have fewer pledges tiers. Keep goal lower than 5k and game price lower than $20. 10 - Friends and family are great, but will not get you far. At all. AT ALL. Many friends and family members didn't even bother to check his page. Or they shared on facebook but didn't donate a buck. Or forgot about it. So counting on pledging and marketing through friends and family was a bust.Lesson: DON'T count on friends and family. Simple as that!These are all great lessons for a first-time creator to learn. We are grateful to Fabio for his willingness to share his failure to help others succeed.
