In recent years federal executive branch agencies have enacted a “whole of government” approach to hot-button topics like environmental, social, governance (ESG) and cryptocurrency regulation. This theory of policy administration combines the efforts of multiple executive branch agencies with different expertise and authorities toward achieving a singular objective. Some of the agencies marshaled to address cryptocurrency regulation include the Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), the Treasury Department’s Financial Crimes Enforcement Network (FinCEN), and the banking regulators. Jurisdiction is often complicated by the nature of a particular asset, administration changes, and agency leaders’ personalities and priorities. How does current cryptocurrency regulatory policy align with the statutory authority and original purpose of these agencies? Are the agencies fulfilling legislative mandates to protect investors and promote safety and soundness? Or are they stretching their authority to achieve a policy outcome in the absence of legislative authorization? This panel will examine the issue of cryptocurrency regulation and statutory authority of executive agencies.Featuring:Mr. Brian P. For generations, regardless of which party has controlled the White House, Black leaders have been virtually absent across the federal government's financial regulatory bodies—a state of affairs that has severely limited the representation of Black communities and their interests in financial policy decisions and reinforced the racial wealth gap in the United States. Chris Brummer of Georgetown Law discusses why longstanding racial disparities in financial regulatory leadership continue even today—and what changes might be required to overcome them.Race and Regulation focuses on the most fundamental responsibility of any society: ensuring equal justice, and dignity and respect, to all people. The host is Cary Coglianese, the Director of the Penn Program on Regulation and a professor at the University of Pennsylvania Law School.Send comments and/or questions to podcast@pennreg.org.

Depending on who you ask, Initial Coin Offerings, or ICOs, are a scam, a brilliant new way for cryptocurrency companies to raise startup money, a sneaky way to get around securities regulations, or some combination of the above. What we do know for sure is that ICOs are garnering a lot of attention these days. China outright banned them last year, and the SEC recently launched its own “HowieCoin,” a fake ICO meant to steer potential investors away from scams. To talk about what these things actually are and what they mean for the future of capital markets, we’re joined by three of the best in the field: Brian Knight is the director of the Mercatus Center’s program on financial regulation, and a Mercatus Policy Download veteran Chris Brummer is a Georgetown Law professor, and a leading academic in the financial technology space Lydia Beyoud is a fintech reporter for Bloomberg Law, where she covers the latest market and regulator activity on ICOs and a host of other issues Follow Chad on Twitter @ChadMReese.
