Sam hosts William Forbath, Associate Dean for Research at the University of Texas at Austin Law School, and Joseph Fishkin,  Professor at the UCLA School of Law, to discuss their recent book The Anti-Oligarchy Constitution: Reconstructing the Economic Foundations of Democracy. Sam first runs through recent updates, from AOC and progressives pushing the White House to take action on Roe and the discovery of 46 dead migrants in an abandoned San Antonio trailer, to the GOP's insistence that, no, fundamentally undermining reproductive rights in the country ISN'T important, and everything is basically the same. Then, he's joined by William Forbath and Professor Joseph Fishkin as they dive right into the state of the public's relationship to the US Constitution, with the left lacking a vision of how it functions within the political society and the right having successfully ingrained it as central to how the constitution shapes policy, before situating our political era as a second Gilded Age defined by economic and political inequality, and why the left's lack of a constitutional vision means that these are not seen as constitutional issues. Next, they trace the recent history of how the two US parties relate to the court, with the institutionalist liberals basking in the afterglow of the Warren court while the GOP, since at least Nixon, has seen opposition to the Court's “progressive” nature as central to their victories. Forbath and Fishkin then jump back to the founders, assessing how they weighed their beliefs of a judicial system as central to a functioning democracy while understanding that it had no right to overrule the will of the people via the legislature, seeing the constitution as a check on the concentration of power to be used against governmental institutions, and thus puts forward a duty to legislate against economic and political concentration. They then shift to the rise of the anti-slavery Republican Party in the mid 19th Century and their vacation of the South as any semblance of a base until they had begun to dismantle the concentration of economic and political power in the region with the prevalence of slave owners and the electoral role of the 3/5ths clause, moving into an era of egalitarian constitutionalism emphasizing checks on concentrations of economic and political powers and a distribution of opportunity that extends across race gender, that saw the Reconstruction amendments (despite clear loopholes) attempt to reshape the role of the constitution. Next comes the 20th Century, as they walk through the rise of federal courts in the wake of the industrial revolution and the simultaneous populist political movement that came out against the rising concentration of wealth, with Taft attempting to build up the Court's stature as it became clear they were on the side of the corporation, only for his (physical and meta) attempts to culminate during the reign of FDR after he forced the anti-democratic court into lockstep with him. They wrap up the interview by looking at the lasting effects of the post-FDR Warren Court, and the current shattering of the view of the courts as apolitical, before looking forwards to the upcoming judicial attacks against legislative capacities and how we can move forwards in a way that bolsters the will of the people rather than the deification of the Courts. Welcome back to Becoming the Hero. I'm your Development Master, Justin Lewis, and together you and I will add more adventure to your life, help you level up in specific ways, and help you be the hero of your own story. If you've ever played Dungeons & Dragons you're very familiar with the Charisma score. It's the number that describes how well you interact with other people whether in a persuasive way or in an intimidating way. It dictates deception and shows your savvy in social situations. If you're like me, you've probably asked, “Why can't I have a good charisma score in real life?” In D&D you can get feats, items, or abilities that naturally improve your charisma score. Today, I want to talk about a few ways to boost your charisma score in real life without the use of magical items. Before we get to that, I want to share a specific announcement. My goal is to make episodes that actually make a difference in your life. To further that goal I will now be shifting to one episode a month. This should allow me to make very good content, laser-focused on moving the needle in your life. I'm extremely grateful for all the support you've given me and I want to ask you if there's anything else I can do for you, let me know via Instagram. For now, the episodes will come out on the first of every month. But until then, let's get back to charisma. Here are 6 ways to boost your charisma score in real life. Wonder and Curiosity The world is full of wonder and few things make as little sense as people. Behind every person is a history of experience and story. The absolute best way to boost your charisma score in real life is by getting curious about people. Honestly, that's one of the biggest benefits I've earned from doing podcasts is a natural growth in the skill of being curious. Naturally, I'm nervous about social encounters because I never know what to say or how to interact. This might make me say stupid things or speak rather quickly. When I change tactics and instead ask questions about the other members of the social interaction the encounter becomes much more interesting. In the next conversation you have with someone else, ask them a question you are genuinely curious about. You'll be surprised what happens. Practice Small Talk “Big gulps huh…. Alright…” If you've seen Dumb and Dumber, you are very familiar with this particular line. It comes at a point in the movie where the heroes have begun their adventure. Jim Carrey's character Lloyd says it to a few gentlemen waiting at a gas station and we, the audience, have a good laugh. We're laughing because it's such an awkward situation and Lloyd is unaware of the awkwardness or unable to circumvent it. I don't know about you, but I've been in situations exactly like that.  That's because I didn't understand the value of small talk. In my estimation, small talk forms the bridge from “stranger danger” to “let's be friends”. If you don't construct that bridge effectively, it might lead you to stand on a partially constructed bridge hovering over the awkwardness. To do small talk right, I think you need a few things. 1. You need to give the person you're talking to a reasonable belief that a conversation or relationship would be worthwhile.2. You need to match their current conversation expectations (I.e. if they are completely closed off then small talk won't happen, a bridge has two sides). 3. You need to set yourself up for better personal topics. A great one is your name. As I said before small talk should be a preface for deeper topics. Selective Vulnerability Speaking of deeper topics, You aren't just a person. You're a story. Every person with whom you come in contact with gets an opportunity to immerse themselves in the story that is you. Just like with books, if you don't interest people or hook them they won't be interested in reading your story. I've found that one way to do this is by sharing selective parts of yourself....

This is one of those podcasts where after it's done, I think "that's it. We've finally shown beyond a shadow of doubt that people can talk to the flipside."  Then I format the show, listen to it - listen to myself make mistakes (often) and listen to Jennifer channel people no longer on the planet. Let's start with the stuff that will stop people in their tracks. Bob was not 67 years old.  I am 67 years old. Bill Paxton (who shows up later on, is 67 years old, and both he and Bob Saget share a birthday of May 17th.  I asked Bob to tell her what age he passed and she said "67."  She reported the number accurately that she heard - for those who don't want to believe that she can communicate with people off the planet, Bob is 66. (After this recent birthday.) So if you want to jump off the flipside boat, reject the Hacking the Afterlife premise, now is your chance.  Again - she reports "what she's getting."  I don't know why he reported a year off - maybe like Luana he always "shaved a year off the bio." I know that Luana did because I discovered it one day when she got a ticket and I had to hand the driver's license to the cop.  There is was in print. A year shy of the actual date.  Officially (but not officially.)  Somehow she got them to accept the date she preferred. But I digress. The podcast started off with a general discussion of Pride month - this was filmed before the Supreme Court announced they were tossing out 50 years of women's rights - so the reference to "abortion" is not because of the decision. I filmed this on Thursday, and for the record, the decision came out on Friday. But the folks on the flipside wanted to reference it.  Human rights. Love your neighbor as yourself - it's really the most important thing said in the bible, or in any book of scripture. If you don't love your neighbor - UNCONDITIONALLY then you're missing the point of being on the planet. There's an angry diatribe in her, coming from yours truly about the hypocrisy of a church I grew up in.  But that aside - people are going to watch this for mainly one reason. Bob Saget has messages for his friends and family. Honestly, for whatever reason, I was aware of Bob through his pals - people who talked about him, his generosity. Jeff Ross talking about him, John Stamos and John Mayer telling stories about how generous he was with spirit and love - and that inspired me to watch the special on Netflix. But I had no desire to interview him.  As stated in the podcast, he "showed up" as a voice in my head, saying his name, and I said to him what I've said to others before (in the books "Backstage Pass to the Flipside.") "I don't talk to people on the other side, but Luana Anders does.  So find Luana and she can facilitate a conversation.  I was going out of town the next day, so I promptly forgot about it - then Jennifer was unavailable last week, so I didn't bring it up. And then a few days ago - he showed up again.  As you can see and hear in the podcast. I won't belabor the point here. Your loved ones exist.  You can communicate with them using hypnotherapy, mediumship or meditation. All three work. Clearly. Bob can testify to that. And Jennifer really does pro bono work with law enforcement agencies nationwide, and she really does help people.  To those who knew and loved him - I apologize in advance for something that may seem treading on toes. I don't know what else to say then, it's not they want to speak to Jennifer or me - they want to speak to YOU and they're showing you how simple it is.   Say their name. Ask them questions. When you get a response before you can ask the question you'll know you've made a connection.  He has direct messages for his wife, for his children and for Jim Carrey, someone I met over drinks at the "Little Door" and we talked about Andy Kaufman, because his sister lived across from my parents in Northbrook. Not hard. Simple. They are NOT GONE. They are just NOT HERE. Give them the opportunity to connect, to let you know life does go on, and they're happy to talk if it's something desired. Jim Carrey was contractually obliged to make 1995's Ace Ventura: When Nature Calls, and it'd put him off sequels for the bulk of his career.
