This episode features two guests from the CLC, Executive Director Diana Comes and Immigrant Justice Program Director Colton Bane. Both Colton and Diana lend some amazing insight into the work that the CLC is doing here in Memphis and why the organization is so important, not only just in Memphis but regionally and even across the state.     Slam the gavel welcomes Jessica Sarfaty to the podcast. Jessica is a Domestic Violence Survivor and Parental Alienation Victim. She too is battling the Yonkers, NY Family Court system. Her judge is Mary Anne Scattaretico-Naber, for Westchester County Family Court in Yonkers in the Ninth Judicial District of New York.      However, Yonkers, New York is known to be called, "City of Hell," for many reasons. As Jessica told her story of perjury and exparte communications with opposing attorneys and AFC (Attorney For Child), David Peck, the whole thing was sketchy from the beginning. The judge disregarded policy and procedure and Jessica asked the judge and the AFC to recuse and they would not. Apparently, David Peck stated her 'son's therapist said her son needed more time away from her.' This was not true as per counselor. That's perjury. When Jessica confronted this bald-face lie, Scattaretico-Naber defended him saying that she has worked with David Peck for over 10-20 years.     There was an order to Show Cause for  two months that the judge didn't answer - but she was supposed to answer it in 30 days. What she did do was send it in the evening before trial..... How convenient.    Jessica's son is 18 and alienated from his mother as the father has turned the son against his mother. There was also Custodial Interference involved as well, but everything went unchecked. Yonkers is who can pay the most. It is a MONEY COURT. Earlier this year, the Fifth Circuit Court of Appeals ruled that individuals with orders of protection against them must be allowed to keep their guns. This overturned a federal statute that prohibits firearm possession by individuals who a court determined pose a credible threat to the safety of an intimate partner or child. This episode of Show Cause focuses on United States v. Rahimi, the first major Second Amendment case that the Court has taken up since its notorious decision last summer in the case of New York State Rifle and Pistol Association vs. Bruen, which stated that restrictions on the right to bear arms are presumptively unconstitutional unless they are, in a judge's opinion, consistent with the nation's “historical tradition of firearm regulation.” From the moment the Court agreed to hear the Rahimi case, advocates hoped it would provide an opportunity for the court to limit the sweep of last year's blockbuster decision expanding gun rights. We discuss the ramifications of the case with Sara Beth Myers, a Nashville-based attorney who has been a prosecutor at the federal, state, and county levels, who also has a long history of specializing in domestic violence cases at every level.

In this episode of Show Cause, we are joined by two of our very own Memphis Law professors (Associate Dean Jodi Wilson and Professor Jennifer Brobst) to talk about the fears, implications, applications, ideas and future of AI programs like ChatGPT and the broader concept of technology's impact in the classroom. ChatGPT is a new chatbot program developed by OpenAI and which is capable of writing convincing essays, solving science and math problems, and producing functional computer code. It's already caused quite the stir in the world of higher education, with students using it to write their assignments, passing off AI-generated essays as their own and professors and administrators scrambling to keep up. There has been an initial wave of widespread concern among academics about the impact this has in the classroom and what it means for the future of teaching, learning, ethics in the classroom, and much more. But, as with all new technologies, there is more here than just the initial fear. Within weeks of ChatGPTs unveiling, new anti-plaguarism programs were developed and adopted across the country. Many teachers went from feeling hopeless to utilizing the new AI programs as tools for idea generation or conversation starters. In short, a middle ground seems to be forming. But the technology is still new and it's repercussions are still being felt out, especially in the worlds of legal education and the larger legal industry, where change has been traditionally slower to take hold.    Slam the Gavel welcomes Stacey to the podcast for an update. She was last on the podcast November 18th, 2022, Season 3, Episode155.  Stacey's family's story goes back to the year of 2013 when she filed for divorce to protect her children from a variety of abuse.  However, her ex is an attorney formerly for CPS and current Public Defender.      While she knew sometimes law enforcement and the courts might cut some slack for "friends or family" on things like minor traffic infractions, Stacey never thought things would turn out to be so dirty when presented with life and death matters of children.  So she trusted her high-paid attorney to do the "right things."  Unfortunately, she literally served Stacey right into the "conflict of interest" courts where her ex appears regularly and is known by everyone.     Stacey explained that she is being called vexatious litigant for filing meritless petitions. The Supreme Court Judge read all the applications but didn't give the content of the applications and he mentioned three motions in particular the previous disqualified for cause, one application was for custody and the other was to vacate orders from the previous judge and that judge did step down, which is proof of merit. This has caused retaliation for asking the prior judge to step down and also perceived as a favor to the ex to silence Stacey in January 2022.       In July 2022, regardless that Stacey was ordered precluded from filing but Stacey filed an Order to Show Cause for Custody again because of things happening in the household of the ex with her children and police were involved. The judge stated he would still entertain that Stacey was precluded from filing despite the fact that her ex now had four CPS indications against him....When Stacey received the letter of the four indications, Stacey asked the judge to please do a hearing on the Order to Show Cause, but he held a conference and yelled at Stacey the whole time. Stacey, a PA of 23 years, asked him if she could take her children to the doctors and he did not give her any relief.  Her kids are still in his custody even though there is one of four indications and one is lack of medical care. Stacey said to the judge, that this would be better dealt with in Family Court where the kids could be better represented. However the ex said that she was precluded from filing, so she can't file in Family Court. All Niagara County judges recused themselves as they had a conflict of interest with her ex and a visiting judge came in and creating an order appointing the same attorney over her children and was never signed nor served it. Her children's interests were never protected.     We discussed 18 USC 2071,  and Stacey discussed how important it is when filing for divorce, to file in another jurisdiction and why. We also talked about the importance of court watching and how powerful affidavits are and how powerful a Non-Party Witness Affidavit is.
