On today's episode of Show Cause, we're focusing on one of Memphis' extremely important non-profit legal services provider in the Community Legal Center, or as most everyone in the legal community here refers to it, the CLC. 2024 is the CLC's 30th anniversary and as such, it seemed a great time to have some of their folks come on to talk about the important work that they are doing in the Mid-South, as well as what they have lined up for the year. This episode features two guests from the CLC, Executive Director Diana Comes and Immigrant Justice Program Director Colton Bane. Both Colton and Diana lend some amazing insight into the work that the CLC is doing here in Memphis and why the organization is so important, not only just in Memphis but regionally and even across the state. Colton gives some really great insight into the massive amount of immigration related work that the CLC handles and how that area has greatly expanded over the years and its impact on the community.
Slam the gavel welcomes Jessica Sarfaty to the podcast. Jessica is a Domestic Violence Survivor and Parental Alienation Victim. She too is battling the Yonkers, NY Family Court system. Her judge is Mary Anne Scattaretico-Naber, for Westchester County Family Court in Yonkers in the Ninth Judicial District of New York. However, Yonkers, New York is known to be called, "City of Hell," for many reasons. As Jessica told her story of perjury and exparte communications with opposing attorneys and AFC (Attorney For Child), David Peck, the whole thing was sketchy from the beginning. The judge disregarded policy and procedure and Jessica asked the judge and the AFC to recuse and they would not. Apparently, David Peck stated her 'son's therapist said her son needed more time away from her.' This was not true as per counselor. That's perjury. When Jessica confronted this bald-face lie, Scattaretico-Naber defended him saying that she has worked with David Peck for over 10-20 years. There was an order to Show Cause for two months that the judge didn't answer - but she was supposed to answer it in 30 days. What she did do was send it in the evening before trial..... How convenient. Jessica's son is 18 and alienated from his mother as the father has turned the son against his mother. There was also Custodial Interference involved as well, but everything went unchecked. Yonkers is who can pay the most. It is a MONEY COURT. Earlier this year, the Fifth Circuit Court of Appeals ruled that individuals with orders of protection against them must be allowed to keep their guns. This overturned a federal statute that prohibits firearm possession by individuals who a court determined pose a credible threat to the safety of an intimate partner or child. This episode of Show Cause focuses on United States v. Rahimi, the first major Second Amendment case that the Court has taken up since its notorious decision last summer in the case of New York State Rifle and Pistol Association vs. Bruen, which stated that restrictions on the right to bear arms are presumptively unconstitutional unless they are, in a judge's opinion, consistent with the nation's “historical tradition of firearm regulation.” From the moment the Court agreed to hear the Rahimi case, advocates hoped it would provide an opportunity for the court to limit the sweep of last year's blockbuster decision expanding gun rights. We discuss the ramifications of the case with Sara Beth Myers, a Nashville-based attorney who has been a prosecutor at the federal, state, and county levels, who also has a long history of specializing in domestic violence cases at every level.
