A 37-year-old Woodford County man faces 21 counts of possessing child pornography following an extensive investigation and a search of his home. After the state's attorney requested to deny pre-trial release, a judge, citing the Pretrial Fairness Act, ruled the defendant could not be detained but imposed strict conditions, including no internet access and no contact with minors. On the House floor in Springfield, Representative Dennis Tipsword criticized the system, questioning who would enforce these restrictions. Tipsword argued that blame lies with lawmakers themselves, not with police, attorneys, or judges, pointing to legislative responsibility for the outcomes. Today on the House floor in Springfield, State Representative Dennis Tipsword (R-Metamora) asked “Who is going to enforce these ridiculous conditions?”  He went on to say that it is not the police officers' fault, it's not the state's attorney's fault, and it's not the judge's fault.  He said, “Look around this chamber…it is our fault.”

This lecture covers lawful arrests, pretrial procedures, and confession/interrogation law, building on Fourth Amendment search and seizure. Key topics include constitutional standards for stops, frisks (reasonable suspicion), and arrests (probable cause); pretrial steps from initial appearance to plea negotiations; and Fifth/Sixth Amendment safeguards concerning Miranda warnings, waiver, invocation, and right to counsel at critical stages. A seizure occurs when a reasonable person wouldn't feel free to leave, distinguishing temporary stops (reasonable suspicion, limited pat-down) from custodial arrests (probable cause, full procedures). The Terry stop allows brief stops and pat-downs based on articulable suspicion of criminal activity and a reasonable belief of being armed and dangerous, limited to weapon discovery. Arrests generally require a warrant based on probable cause from a neutral magistrate, with exceptions for exigent circumstances (fleeing suspect, public safety). Warrantless felony arrests in public are permitted with objective probable cause, respecting the individual's dignity and avoiding excessive force. The pretrial process begins with an initial appearance (charges, counsel, release). Bail is considered under the Eighth Amendment (no excessive bail), balancing offense seriousness, criminal history, and community risk, potentially involving release on recognizance, bonds, or preventive detention. Federal felony cases often require a grand jury indictment (probable cause), while other jurisdictions use prosecutorial information and preliminary hearings as a screen against unfounded prosecutions. Prosecutors have broad charging discretion and utilize plea bargaining (guilty plea for reduced charge/sentence) which raises concerns about coercion and unequal power. Pretrial motions, especially to suppress illegally obtained evidence (Fourth Amendment challenges), are crucial. The Sixth Amendment guarantees a speedy trial. The Fifth Amendment protects against compelled self-incrimination during custodial interrogation (Miranda warnings: right to silence, use of statements, right to counsel, appointed counsel if indigent), requiring knowing, intelligent, and voluntary waivers based on totality of circumstances. Invoking the right to counsel or silence requires ceasing interrogation. Exceptions to Miranda include public safety and non-custodial questioning (voluntariness still applies). The Sixth Amendment guarantees counsel at critical stages after formal charges (indictment, arraignment, etc.), such as plea discussions, lineups, and hearings, requiring knowing and intelligent waivers. Massiah prohibits deliberate elicitation of incriminating statements from an indicted defendant without counsel. Elstad allows subsequent admissible statements after defective initial Miranda warnings if later warnings are proper and waiver is valid. Edwards' "bright line" rule requires ceasing interrogation upon invoking Miranda counsel until counsel is present or the suspect initiates further communication. The lecture concludes by summarizing these themes, leading to discussions on trial, sentencing, and post-conviction in the next session.

The primary purpose of discovery is for parties to exchange information and evidence before trial, ensuring fairness and preventing "trial by ambush" by requiring both sides to have access to relevant facts and witnesses.The three key elements are relevance to a party's claim or defense, non-privileged matter, and proportionality to the needs of the case; proportionality involves balancing factors like the importance of issues, the amount in controversy, access to facts, and the burden of discovery.Discoverable information is any non-privileged matter relevant and proportional to the case, while admissible evidence is information that meets the rules of evidence for presentation at trial; for example, hearsay might be discoverable if it could lead to admissible evidence.Attorney-client privilege protects confidential communications between a lawyer and client made for the purpose of legal advice, while the work product doctrine safeguards materials prepared in anticipation of litigation; these protect the attorney-client relationship and the lawyer's preparation from adversarial scrutiny.Two primary functions are to help each party prepare for discovery by providing a roadmap of key information and to set the stage for potential settlement negotiations by outlining case strengths and weaknesses; an example of required disclosure is the names and contact information of individuals likely to have discoverable information.Expert witness disclosures must include the identity and qualifications of the expert, a summary of their opinions and their factual basis, and any prior testimony; failure to adequately disclose can lead to the exclusion of the expert's testimony at trial.A deposition is a pretrial examination conducted under oath to ask detailed questions of witnesses or parties, while a request for production of documents compels the opposing party to produce relevant documents, electronic files, or tangible items; depositions primarily seek testimonial evidence, while requests for production seek documentary or physical evidence.A party might file a motion to compel if the opposing party fails to respond to discovery requests or provides incomplete or evasive answers; a potential sanction under Rule 37(b) includes ordering that certain facts be taken as established against the non-complying party.The purpose of a protective order is to limit or prohibit the production of information that is overly burdensome, duplicative, or infringing on privacy rights; a court might issue a protective order to limit the scope of a deposition to prevent harassment.Summary judgment is granted if there is no genuine dispute as to any material fact and the moving party is entitled to judgment as a matter of law; the moving party must demonstrate the absence of a genuine dispute of material fact, and the non-moving party must then come forward with specific evidence showing a triable issue exists.

Send us a textFor the first time on Fairfax, northern Virginia criminal / DUI defense lawyer Jonathan Katz's podcast, we have one of his former clients joining us. Susan Crane has engaged in four Plowshares peace actions and calculates that she has spent nearly a total of seven years of her life in jails and prisons. Jon Katz was honored to have co-counseled with Ramsey Clark and Anabel Dwyer in defending Susan, Jesuit Father Stephen Kelly, Elizabeth Walz, and Father Philip Berrigan in Susan's third Plowshares action, in 1999 hammering on two A-10 military aircraft, to convert them due to the depleted uranium missiles they were equipped to fire. Pretrial, Jon convinced the judge to dismiss the sabotage and conspiracy to commit sabotage counts against the defendants, leaving pending property destruction and conspiracy to commit property destruction counts, and an assault count against Susan that she got dismissed when the jury could not reach a verdict on that count. When the judge prevented the jury from hearing testimony from defense depleted uranium expert Douglas Rokke, the defendants dramatically shut down their participation in the trial. When prosecuted, Susan and all other Plowshares activists admit her actions, but insists that they were necessary and permitted under international law. We hear Susan's lessons for beating the prosecution from her heart-centered, engaging approach that cares deeply about everyone, including those who arrest her. She was ready to share information about depleted uranium with a soldier who was exposed to it. When hammering on material at a Lockheed Martin facility, Susan's fellow Plowshares activist Steve Kelly suggested that the employee in the room call security, lest he face job repercussions otherwise. That employee whispered to them that their action was courageous, and a circle of employees arrived and observed their actions, without stopping them, until security arrived. That is engagement. Susan is an active member of the Redwood City Catholic Worker. She has devoted her life to helping others, from peace actions, to Peace Corps work, to helping renovate squats.
