Last year 185 people, charged with 729 offences, were deemed unfit to stand trial. 

A core tenet of the U.S. legal system is that an accused person must be competent to stand trial, which means a defendant can understand the charges against them and assist their lawyer in preparing a defense. In practice, defendants who need to be evaluated for competency often spend long periods in confinement because of a shortage of behavioral health services. When they are finally released, it's usually without ongoing care. On this episode, we spoke with three people who are involved in efforts to reform the process used to determine a defendant's mental competency: Indiana Supreme Court Chief Justice Loretta Rush and two Colorado legislators, Senator Judy Amabile, a Democrat, and Senator Byron Pelton, a Republican.Chief Justice Rush explained the dimensions of the problem and discussed how a national task force on the issue developed. During the 2022 legislative session, the Legislature established what's called a competency attainment board and a program of forensic navigators. The program, which aims to connect people found mentally incompetent to stand trial with services, has now been in effect for a year. The board was created following a KARE 11 investigation that revealed thousands of people charged with a crime were found mentally incompetent to stand trial but did not receive mental health treatment. Many of these people would go on to commit more violent crimes. Ryan Flynn, the chair of the Competency Attainment Board, and Kim Larson, who oversees the forensic navigator program, joined Minnesota Now to talk about what they've learned in the first year of the program.

​In the case of Jane Doe 1 et al. v. Government of the United States Virgin Islands et al., the plaintiffs—six anonymous women—allege that they were coerced into commercial sex acts by Jeffrey Epstein and his associates. They claim that the defendants, including the Government of the United States Virgin Islands (USVI) and several USVI political figures, facilitated Epstein's sex trafficking operations by providing various forms of assistance and, in return, received financial benefits such as loans, payments, and campaign donations. The plaintiffs assert violations of the Trafficking Victims Protection Act (TVPA) and New York tort law.Upon review, the court dismissed all claims except those against Stacey Plaskett, the USVI's delegate to the U.S. House of Representatives. The court found insufficient evidence to establish personal jurisdiction over the other defendants or to substantiate the claims against them.
