Catherine Tindall is a CPA and partner at Dominion Enterprise Services, a specialty tax advisory practice. She always had a strong sense of a deeper purpose, and really being able to help other people. Catherine shares her insights on Employee Retention Credit so business owners can better understand how to take advantage of this generous program before the time runs out. The employee retention tax credit, otherwise known as the ERC, is a refundable tax credit in the United States, designed to reward business owners for retaining employees through the COVID-19 pandemic. The ERC is available to both small and medium-sized businesses. Taxation is such a stressful thing for business owners to deal with. Dominion Enterprise Services focuses on strategic income tax planning and specialty programs. A lot of the work that is done is for other CPA firms who don't feel comfortable doing the ERC work because it's such a specific niche. One of the interesting things about accounting and US tax preparation being so complicated is that it covers such a broad field and not all accountants come with the same knowledge. Once you become an entrepreneur and earn multiple streams of income, you need to have a professional at your side who understands tax planning, instead of just filing forms and keeping compliant with the government. Catherine saw the gap in this particular program when people who are not tax professionals didn't administer it correctly and lost 40% of their hard-earned income in federal and state taxes, even practitioners were too intimidated to approach it. Her firm started doing them and mastered what was coming down the pipeline. Business owners need to understand that this interacts with their income tax and is not as clear as the PPP where you file pieces of paper with the bank. The mechanics of the ERC is a complex process that can end up being like the third round of PPP. It all depends on how many employees you had and how long they were employed. To know if you qualify for the program, you need to have had at least five W2 employees during the pandemic between 2020 and 2021, along with access to quarterly financial statements like a revenue-based test and if you had certain revenue declines within quarters, you can qualify for it. Also if you were subject to government orders or mandates that forced changes in how you were operating. An example is when most restaurants were subject to state government orders that reduced their indoor dining capacity for a certain period during Covid, which caused a triggering event. The credit itself is capped at $26,000 per employee and when they do the legal footwork of the initial assessment and government orders, it can all be processed between three to four months and you can start receiving your returns in quarterly checks. Are you a business owner who saw your revenues plummet during the height of the COVID-19 pandemic due to government restrictions? Then you could be eligible to receive financial assistance from the government in the form of the Employee Retention Credit (ERC). Unfortunately, because of the complicated procedures in place, many business owners end up filing bad claims or worse, not file a claim at all.    Unfortunately for many business owners, the procedure for submission and evaluating whether you qualify for the credit at all is complex, and may involve digging through government announcements for the exact restriction that may have affected you. There is also the process of determining how much credit you qualify for, based on things like the wages your employees earned, and whether you paid them through the Paycheck Protection Program, among others.   The good news is that you may be eligible for up to $5000 per employee that you paid during the whole year of 2020 and $7000 per employee for three quarters during tax year 2021. The bad news is that there are several exemptions and caveats that apply, and they are enough to make anybody's head spin. But if you have a headcount of more than 10 employees, and feel like government restrictions really impacted on your ability to operate and create revenue, then it's worth having a tax professional evaluate your case.    In this episode, Catherine Tindall, one of the partners at Dominion Enterprise Services, a specialty CPA firm that specializes in helping businesses maximize their tax credits, gives us information about the ERC and whether you might be leaving a very significant number of dollars off the table by not filing a claim. This credit is for employers affected by shutdowns in 2020 & 2021 who retained their employees. These credits can be significant. J Darrin Gross I'd like to ask you, Catherine Tindall. What is the BIGGEST RISK?   Catherine Tindall   I say, you know, the BIGGEST RISK that I see, just from my professional perspective of the kind of cases that I diagnose and deal with on a day to day basis, the the main area of loss I see for people is that they, they do a set it and forget it strategy when it comes to dealing with their tax situation. And a lot of people because it's so technical, they don't have a way of assessing whether or not they're doing everything that they can unless they're going to take the time to learn how to do it themselves. And so I'd say for most people who get involved in real estate or who get, you know, start having a lot more going on economically, that it's, it's worth it to take the time to reassess your situation, get a second set of eyes, to make sure that you're not missing out on things because it can be 20 to 50% of your yearly effort. You're kind of working for the government, right if that's how you deal with, you know, paying your tax. And so to just not re examine that every once in a while, you can really be losing a lot of the effort that you're putting in just for, you know, things that are very easy to change, like just filing paperwork for splitting out entities or adding a kid to payroll or things like that. So that's what I see is the biggest risk. And a lot of the times once, once those things are set, and times gone by sometimes we can go backwards to save the tax. But more often we can't, it's once it's done, it's done. I had someone recently where they, they tried to execute a 1031 exchange on their own. And they didn't do it correctly. And they didn't, they didn't meet the timing requirements involved with it. And so they ended up with like over $200,000 in tax that could have been very easily deferred. You know, they were aware of the strategy, they had an intermediary involved, but they just didn't execute correctly. And so I think that's the biggest risk I see for people is, you know, to try to DIY too long, or to just set it and forget it, and not realizing that this, it's another area of being able to really maximize your wealth is being more strategic with you know, that tax number.
