Elder Oaks said “When I say free agency I refer to what the scripture calls agency, which means an exercise of the will, the power to choose. We are here to be tested, and this cannot occur without opposition in all things. If we did not have opposition, we could not exercise our free agency by making choices.” As Richard Rohr says it, “Clear choice and decision gets you started, aims you on the right course, and then if you stay on it, that very path will open you up to subtlety, nuance, shadow, contradictions, inconsistencies, brokenness, and variance in almost everything.” What does this have to do with questions and doubts? If we are denied the opportunity to acknowledge that we have questions and doubts and that there's no shame in having them, we interrupt the natural process of learning and growth that comes with assessing our lives circumstances and determining what we want to do or what decisions to make. As many of you know, at the beginning of May, the United States Supreme Court experienced an unprecedented leak of a draft opinion on the Dobbs v. Jackson case currently being adjudicated by the Supreme Court. The opinion was written by Justice Samuel Alito Jr., and, if it ends up reflecting the Court's decision due this month, would overturn nearly 50 years of abortion law under the landmark Roe v. Wade case, which ruled that many then-current restrictions on abortion were unconstitutional, and guaranteed nationwide access to abortion through the first two trimesters of pregnancy. Roe, and the subsequent Casey v. Planned Parenthood have paved the way for laws that in many states, allow abortion very late into pregnancy. Abortion is a very tricky topic, and a very sensitive one for people on all sides of the issue. But we feel like we have a duty as citizens to become educated on important matters like this, and our faith must have something to say on issues in which life, liberty, and the pursuit of happiness are at stake. Elder Oaks recently stated: "On contested issues we seek to moderate and unify." In that spirit, we explored the issue from several angles, starting from a factual perspective — diving into the specifics of what's going on and what the practical stakes are, then moving into what our faith might be asking of us as we seek to create a world that is just and equitable; one that honors both agency and life. I'm sure we weren't perfect as we navigated this territory, but we did the best we could to show respect to the values and humanity that inform people of good faith on either side. This conversation comes in two parts; in the first, we spoke with Sherif Girgis, a professor at Notre Dame Law School, who also clerked for Justice Alito of the U.S. Supreme Court as well as for our friend Thomas B. Griffith of the U.S. Court of Appeals for the D.C. Circuit. When we asked Judge Griffith who would be the most qualified voice we could bring on the show, he unhesitatingly recommended Sherif. Sherif earned his J.D. at Yale Law School, where he served as an editor of the Yale Law Journal, and is currently completing his Ph.D. in philosophy at Princeton. Sherif helped us understand the current state of abortion law in the US as well as what it could look like after a decision is made on Dobbs. After speaking with Sherif, we spoke with Latter-day Saint scholars Justin Collings and Jenet Erickson. Justin Collings is Associate Dean for Faculty and Curriculum at BYU and a Professor at the J. Reuben Clark School of Law at BYU, where he's been since 2013. He is a scholar of constitutional law, comparative constitutional law, and constitutional history, and received his law degree and his PhD in History both from Yale.Jenet Erickson is an associate professor in the Department of Church History and Doctrine in BYU Religious Education. Her research has focused on maternal and child well-being in the context of work and family life, as well as the distinct contributions of mothers and fathers in children's development. She is a research fellow of both the Wheatley Institution and the Institute for Family Studies and has been a columnist on family issues for the Deseret News since 2013.Justin and Jenet brought this conversation home in terms of what it means for Latter-day Saints. We found them incredibly insightful and empathetic, and helped us see this issue in new ways — we think they'll do the same for you. Jeffrey R. Holland is a senior church leader in The Church of Jesus Christ of Latter-day Saints. In addition, he is the chairman of the executive committee of the church board of commissioners, and a former president of BYU. He recently gave a talk that has since become highly controversial. I'm an alum of BYU, and wanted to discuss more with thoughtful friends. Now, you should note just how tricky a topic this is. It's sensitive and difficult, and I guarantee we didn't handle it perfectly--but we tried to engage honestly, and that's a start. From my background as a school administrator, I saw this more in terms of "we need to do better" than perhaps any other thing--in teaching, in research, and in the basic functions of the university. There have been numerous talks in recent years that have addressed this plainly, and I felt that it's impossible to understand this talk outside the context of the others. Even if you don't agree, I hope you get something from it. And also, I hope that this crowds out the less thoughtful voices out there who share my take. (Updated-Fixed mp3-link) When the Nov 2015 policy was announced, many LDS Church members were hurt to learn that children of gay parents couldn't be baptized, and gay couples were considered in apostasy. Fast forward to April 2019 and the policy was reversed, causing joy among some church members, and pain from other dues to the quick nature of the change. Still others were outraged at the reversal. Some church members may have felt a bit of revelatory whiplash at the sudden changes. Dr. Greg Prince will talk more about the pain caused by the Policy and its reversal. https://youtu.be/pHQPPSIVoi0 GT: I know, some people made an interesting observation last night at your book signing, that there was not a single mention of that [in General Conference]. Why do you think that was? Greg: I think that's because they had good input from Public Affairs, that if you're going to announce something like that, which is not real cheery news for the institution, because you're erasing something that people thought was permanent, when you called it a revelation three years earlier. The way to do it, essentially, is what the government does when it has bad news, you announce it after five o'clock on a Friday afternoon, so that by Monday, people have pretty much moved on. By announcing it a couple days before General Conference, and then not mentioning it, it became non-news. I think that was a good move on their part. GT: So, I know a lot of people, I know that I was very happy with the announcement. But I know a lot of people have been just as upset, and I think the main reason why is because there was no apology. I know Elder Oaks is often quoted as, "The church doesn't apologize."[1] Do you think it would have been a Public Relations win if the church had said we know there's been some damage done here, or do you agree with Elder Oaks, "The church just doesn't apologize." Greg: No, I don't agree with that. I think they should apologize on multiple things, and it would have been a P.R. win, if they had said humbly, "We apologize for the damage that this has done," because demonstrably it did a lot of damage. Families were ripped apart. I think there's good evidence that more than a few people took their lives over this, and you can't undo that by reversing the policy. That's the real residual damage of this thing. It's not like okay, we went there, now we've come back, now let's go on and life goes on as it did before, but it doesn't. You step in something and you step out of it, but you still got it in your shoes, and that's where we are? How do you undo that kind of damage? It also creates a dilemma that may even affect the orthodox church member more than the progressive church member, and that is, "Wait a minute, you told us this was revelation, and now three years later, you're saying it's back to where we were?" That creates a real dilemma. GT: I have actually seen some orthodox members say, "I think the church is now in apostasy." Greg: Yes. It's an unforced error, but, nonetheless, it's something that they're going to have to deal with, and it has repercussions because it affects the whole brand of revelation. If people thought that something being called revelation conferred permanence to it, now it becomes much more relative, and it has a ripple effect beyond that particular revelation. It calls into a question other [revelations] and say, "Well, how unchangeable is the rest of it?" In my mind, changeability is bedrock for Mormonism, but it's something that makes most church members really nervous. They will embrace the concept of continuing revelation, but they're really hesitant to accept change. It's a paradox. In this next conversation with forensics expert George Throckmorton, we'll talk more about Mark's dealings with church leaders. What got Mark in hot water with church officials? https://youtu.be/sxCVD1vmqMY GT: He had an appointment with, I believe it was Elder Oaks, Elder Pinnock. I don't remember who all. George: Elder Pinnock was the one that was dealing with him quite a bit. GT: Yeah. And so, so can you a little bit about what was the relationship between Mark Hofmann and Elder Pinnock? George: Business. Elder Pinnock had a history. In fact, I've known him. He was my wife's bishop when we got married and so I've known him. I knew him for a long time before this and he was, you know, as much a victim as anybody. It turns out this Mark Hofmann was trying to give more credence to the Spaulding Theory, which states that Sidney Rigdon got a copy of the Spaulding Manuscript, gave it to Joseph Smith, and Joseph plagiarized the Book of Mormon from Solomon Spaulding. The problem has been, there has never been any connection between Joseph Smith and Solomon Spaulding. However, Mark tried to solve that problem with a forgery with a new collection known as the McLellin Collection. George: There's an old theory called a Solomon Spaulding theory. Are you aware that? GT: I am aware of that. George: Okay. But one of the problems, it's never been given much credibility. They think that Solomon Spalding wrote it. GT: Wrote the Book of Mormon. George: And Martin[1] just copied the Book of Mormon, but there was really no relationship between Solomon Spalding and Joseph Smith that could be found. So, it's not given a whole lot of credit. I mean there's always people that bring it up, but my opinion is not given credit because they never met until too late, until this land deed showed up. And it's a land deed that was signed by Solomon Spalding and Martin Harris. So, it showed there was a relationship between Solomon Spalding and Martin Harris and the date was appropriate. And this is the document that Mark Hofmann showed Hugh Pinnock and Al Rust and some others, and he says this is part of the McLellin Collection. [paypal-donation] In April 2014, Elder Oaks gave a sermon on women and priesthood. Dr. Jonathan Stapley said this was no ordinary talk. He called it theologically groundbreaking! I was a bit surprised how revolutionary Stapley felt the sermon was. It seemed to me to be a response to the Ordain Women movement which was asking for women to be allowed to attend the priesthood session of General Conference. I saw the address under a different light than Jonathan. https://youtu.be/sznFXhm4wDA GT: I remember just thinking, “Oh, this is just to placate the Kate Kelly people and to say, ‘Women, you've already got priesthood. You just didn't know it yet.'” But you're saying this is a theological change. ... Jonathan: When Elder Oaks delivered that sermon, I was looking around like, does anyone else [recognize this?] This is mind-blowing. I couldn't believe it. And everyone else was just like, “Oh yeah, this is just Elder Oaks.” Revolutions happen sometimes a very subtly apparently. ... Jonathan: It's certainly a linguistic shift and language frames our reality. So, it is certainly, for example, an interesting piece from Elder Oaks' sermon was he was quoting in many parts from a sermon that Joseph Fielding Smith gave to the Relief Society in a general Relief Society meeting. And in this meeting Joseph Fielding was as I remember, the president of the Quorum of the Twelve at the time, discussed women's authority in the church and how they were heirs to a great heritage, but also heirs to authority and their capacity of the work in the Relief society and the temple. But he was quick to say, you have authority to do this work. You have authority in the temple, but authority is not the same thing as priesthood. Jonathan: And Elder Oaks takes this sermon he talks about, he quotes Joseph Fielding Smith, how women have this great authority in the church and this great heritage. And then he stops and says, what else can this authority be except priesthood? Right? So, it's this really wonderful kind of re-imagining of what these terms mean. At the same time, reaching to our past to grab hold of our past and make sure we're still connected, but also in very interesting and creative ways, refashioning it in a way that makes more sense for the present. [paypal-donation] Sadly, October 15 marks 32 years since Kathy Sheets and Steven Christensen were killed. Shannon asks, and answers an important question. Shannon: People have asked me, “Do you think he would ever murder anybody again?” I believe yes and no. [This is] my own thought of it. I believe no because he is not naturally that way. He sort of is now. But I believe yes because someone told me this, and I hope that it is true. Often times when a bear hurts or kills somebody in Yellowstone Park or something like that, they have to put the bear down. Because they say that once that bear gets the taste of blood in his mouth, he will do it again and again and again. I think that's Mark. He's done it once. If he did not have a motivation to do it, I don't believe he would. He wouldn't go out and shoot somebody for no reason, but I believe he has the taste of blood in his mouth. If he got himself into another situation where he was up a creek and didn't know what to do and was about again to be exposed, I mean that's the reason he killed Steve Christensen. Lots of people have wondered who the third bomb was intended for. We'll get into the different theories. Shannon: that's the reason he was parked where he was. That wasn't just a random place to park. It was right down the street from the McEwen Mansion. The attorney representing the guy that was going to purchase that McLellin Collection, pay off the loan, his office was in the McEwen Mansion. So Mark was right down to the last hour, minute, and second. He couldn't get out of it anymore. He was going to have to go up that road and say, I don't have it, which he believed at that point the whole thing would unravel. It very well may have. ... At that point he may have been so irrational that that's possible. What in fact happened was, he parked that car, sat there for quite a while and thought, “I am caught. I am caught. What do I do?” He got out of the car, that bomb package was sitting on the driver's seat and he made a decision to flip it over. GT: So you think he did it on purpose. Shannon: Oh yeah. Now if he believed that he could have survived that, the car did burn but there were enough papers and stuff in the trunk that had it burned completely, which it didn't, which cars don't. That only happens in the movies. He could have said, “Yes. McLellin Collection right there.” Who could have proved him wrong? GT: Right. Shannon: He could have come up with a story about who put that bomb there, that he was really going up to the office and then he forgot something, came back, flipped the package over. So does he regret what he did? No. Was he suicidal as, “I'm trying to repent of this?” I don't think so. I think his hand is in the cookie jar and he's thinking still, “how can I get out of this?” He flipped the package. ... Shannon: To get back to that third bomb, I don't know if there was a rational reason for that. I just use all those examples because there doesn't need to be a rational reason for it to have happened, because there was lots of irrational things. Who was that intended for? No idea. Maybe he didn't know who it was intended for until that day.
