Come January, the State of Maryland will have three new elected officials in three key statewide offices: Governor, Attorney General and Comptroller. Governor Larry Hogan is term-limited and cannot run again. Attorney General Brian Frosh is retiring, and the incumbent Comptroller, Democrat Peter Franchot, did not seek re-election to a fifth term, opting to run for Governor instead. Today, it's another installment in our series of Conversations with the Candidates 2022, with the two contenders who are running to succeed Mr. Franchot as Maryland State Comptroller. Republican Barry Glassman is completing his second term as Harford County Executive. Maryland voters head to the polls next week. Mail-in voting has already begun. Early voting starts Thursday. Election day is two weeks from Tuesday. Today, it's a special installment in our series of Conversations with the Candidates 2022. Two of the three leading candidates in the Democratic primary for Governor join Tom for the hour to discuss the issues on the minds of Marylanders. In early June, a poll published by the Baltimore Sun identified Comptroller Peter Franchot, non-profit executive Wes Moore and former Labor Secretary Tom Perez leading a 10-person field in the Democratic primary. Those three candidates polled in the low double-digits. A large number of respondents said they had not made up their minds. In a poll released on Tuesday of this week, commissioned by WYPR, the Baltimore Banner and Goucher College showed the race between Mr. Franchot, Mr. Moore and Mr. Perez to be even closer than it was in early June. Those three candidates are now in a statistical tie. The other candidate who is closest to them is former Attorney General Doug Gansler, who is about ten points behind. We invited the top three candidates to appear on Tuesday of this week. Peter Franchot's spokesperson declined our invitation citing a schedule conflict. We tried a different date, today, and once again citing a schedule conflict, the Franchot campaign declined our invitation. And so, we are pleased to welcome Wes Moore and Tom Perez to today's conversation. They join us on Zoom. Wes Moore is a best-selling author who has worked in the private and non-profit sector. He was most recently the CEO of the Robin Hood Foundation, a national philanthropic organization. And, full disclosure: he once hosted Future City,a public affairs show on WYPR. He has chosen as his running mate former Delegate Aruna Miller from Montgomery County… Tom Perez is a lawyer who headed the Civil Rights Division in the US Justice Department, and served as MD labor secretary during the O'Malley administration. He was also appointed US Labor Secretary during the Obama Administration, and he was the chair of the Democratic National Committee (DNC). As Maryland's comptroller for the past decade and a half, Peter Franchot has wielded one of just three votes--along with the governor and state treasurer--on the powerful Board of Public Works. As Franchot sees it, his know-how as comptroller prepares him to be governor, so he's running for the Democratic nomination. Franchot rejects the idea that his pattern of cooperating with the Republican governor, after sparring with the previous Democratic executive … won't play well with Democratic primary voters. “I speak up. People like that, they want somebody who is going to be - have an outsider perspective. Today, it's another installment in Midday's series of Conversations with the Candidates: 2022. Tom's guest for the hour is Peter Franchot. He was first elected to the General Assembly in 1986. He represented part of Montgomery County in the House of Delegates for 20 years. In 2006, he was elected Comptroller of MD. In 2018, he won the race for his fourth term in that office by the largest margin of any statewide candidate in MD history. He has decided not to stand for election to a fifth term as Comptroller. Instead, he's running in the Democratic primary for Governor. Mr. Franchot has often been at odds with Democratic leaders during his 35 years in Annapolis. He opposed slot machines when legislation to legalize them was introduced in 2008. He joined Gov. Larry Hogan and then Treasurer Nancy Copp to end the contract to develop the State center complex in Baltimore. And in 2019, in a dispute with Democratic leaders, the legislature stripped the Comptroller's office of some of its regulatory role over alcohol and tobacco. Mr. Franchot is one of 10 contenders in Maryland's gubernatorial primary, and internal polls from his campaign and the campaign of Rushern Baker show him in the lead, with 71 days left until early voting begins. Before entering elective politics, Mr. Franchot served in the Army during the Vietnam War, and later worked for Ralph Nader, the Union of Concerned Scientists, and as a staff director for then-Congressman Ed Markey of Massachusetts. Peter Franchot is 74 years old. He holds a bachelor's degree from Amherst College and a law degree from Northeastern University. He and his wife, Anne Maher, are the parents of two grown children, and three grandchildren. They are longtime residents of Takoma Park. Mr. Franchot has chosen former Prince George's County Councilwoman Monique Anderson-Walker as his running mate for Lt. Governor. Peter Franchot joins us today on Zoom from Takoma Park. A monument honoring Confederate soldiers is staying put for now in front of Talbot County's Courthouse in Easton, Maryland. The Talbot County Council voted 3-2 on Tuesday, August 11, 2020, against removing the statue. Yesterday, federal authorities announced that 3.3 million people filed for unemployment benefits last week. 42,000 of those claims were from Marylanders. As we went on the air today, the House of Representatives was preparing to vote on the $2.2 trillion dollar economic aid package. (The measure passed on an overwhelming voice vote in the early afternoon, and the President signed it into law a few hours later.) A word about Day Care. The Governor has ordered day care centers to close, but there is a service to provide day care to children of ESSENTIAL PERSONNEL who are responding to the COVID-19 pandemic. There is a free referral hotline. The number is 877-261-0060. That forced some companies to halt production for weeks, or delay product launches.Meanwhile, President Donald Trump’s 10 percent tariff on imported aluminum remains in effect.Brewers and Farmers Refute Barley Shortage FearsA recent paper published by 10 international scientists in the Nature Plants journal suggested a barley shortage caused by climate change could cause beer prices to double. The report said heat waves and droughts could lead to barley yield declines of as much as 17 percent while beer production could drop 16 percent.However, Brewers Association (BA) chief economist Bart Watson told NPR that the “study isn’t a great indicator of what is going to happen in the real world” and the study overstates the effects on the beer industry.Dwight Little, president of the Idaho Grain Producers Association, added that climate change is likely to occur slowly, which will give farmers time to adapt and change their planting schedules.Craft Beer Cellar Lawsuit Against Glassdoor Thrown OutA federal court has dismissed a lawsuit filed by Craft Beer Stellar LLC, the franchisor of the Craft Beer Cellar retail outlets, against Glassdoor. In the suit, Craft Beer Stellar argued that anonymous users — possibly franchisees — had unfairly critiqued the company and violated the federal Computer Fraud and Abuse Act, among other claims.According to Massachusetts trial attorney Andrew Caplan, the court tossed out Craft Beer Stellar’s lawsuit, citing the federal Communications Decency Act, which bans lawsuits against website publishers for defamatory statements posted by third parties.A-B’s Natty Light 77-Packs Draw Ire of Maryland ComptrollerMaryland Comptroller Peter Franchot is accusing Anheuser-Busch of promoting binge drinking following the release of specialty 77-packs of Natural Light, which were exclusively sold in College Park, the home of the University of Maryland.“Corporate beer manufacturers claim to care about the public health impacts of alcohol, but the message they send by selling a 77-pack of beer designed to look like a keg in a college town shows they care more about their bottom line than the negative impacts of binge drinking,” Franchot spokesman Alan Brody told the New York Daily News.A-B released the multipacks earlier this month to celebrate the year of the brand’s creation. Today’s guest is a first for GBH - we’re speaking with a state wide, publicly elected political figure - who finds himself at the center of a political movement working to change the laws for Maryland’s small craft brewers. It’s no accident that he ended up in this movement - states all over the union have been reinventing their beer laws to make way for new business models necessary to support small craft brewer, especially when it comes to own-premise taproom models, self-distribution, and franchise rights with wholesalers. Most states have incrementally improved these laws over time, attempting to balance the needs of federally mandated wholesale tier, meant to prevent monopolies, and the beds of consumers and brewers, and more recently, the retail voice has been finding its way into these discussions as well. But a few states, like Texas, Georgia, Alabama, and Maryland, have been especially slow to evolve. In these states, the multi-generational wealth of wholesalers, backed by the largest brewing conglomerates in the world, have held an immense amount of influence over politicians. And progress in those states beer laws has been all but static. Peter Franchot, the state’s elected comptroller, is very well known and depending on your view of things, he’s either a uniquely divisive figure in Maryland politics, or he’s uniquely talented at uniting folks around an issue. His role as comptroller is to structure the states financial agenda, which includes tax incentives for industry, and creating fairness is its economic systems, among many other related things. Unlike most states, Maryland doesn’t appoint their comptroller through the governor’s office, but instead elects the comptroller directly. And that means two important things - 1. it enables the voters to compartmentalism their financial interests from the rest of their political agendas - and 2. it protects that office from political influence to a degree, because the comptroller is beholden to the voters, not the governor. For Franchot - that can sometimes put him at odds with his own party’s agenda when they’re in power. And it can sometimes put him in the position of courting the factor of a republican governor when he wants to get something done, and that works against the democratic machine. And he seems to relish in it. And he keeps getting re-elected - with barely any contention. One of the ways he maintains that powerful role is through the campaigns he initiates that tend to be popular, perhaps even populist agendas. He’s gone after common sense school reforms, he fought against sot machines infiltrating his state, and most recently he’s saddled atop the rapid growth in craft beer as a way to rally his voters around something they want to see more of, and against the special interests it threatens. And he’s riding that saddle to electoral victory over and over again, but so far, doesn’t have a victory to show for it on behalf of he brewers themselves. He’s had remarkable success using the uncommon leverage of his office and its popularity to ram through big changes that most states are required to piece-meal over time. He makes a lot of enemies along the way, and more than a few friends, and it remains to be seen wether that’s good for craft beer legislation, or if this might be one battle he takes to the teeth of big beer money and power, and perhaps walks away wounded for the effort. It remains to be seen - and there are small brewers I spoke with on its sides of that strategy. Some are rallying behind the effort while others fear it may hinder their progress at the expense of Franchot having a self-serving campaign that keeps him popular even if he fails. Most would be happy with even a small win. But Franchot, never a meek contender, only seems interested in making his cause bigger in the meantime. In fact, as we sat and talked, I watched his handler wince more than once as Franchot, on the spot, started spontaneously adding new provisions to his bill. It’s a bold strategy. Let’s see if it pays off for him.

Today, another in Midday's series of Conversations with the Candidates.Tom's guest is Maryland Comptroller Peter Franchot. He’s been the state’s fiscal chief since 2007, after firsxt beating the incumbent, William Donald Schaefer, in the 2006 primary. As comptroller, Franchot is a member of powerful Board of Public Works in Annapolis. And he is vice-chair of the State Retirement ---- Pension System. Franchot is a Democrat who does not always toe the party line. His relationship with the legislative leadership in Annapolis -- fellow Democrats Senate President Thomas V. Mike Miller and House Speaker Michael E. Busch -- has seemed increasingly frayed this year. Franchot does seem to have a close working relationship with Republican Gov. Larry Hogan. Before becoming Maryland’s top fiscal officer, Franchot served in the House of Delegates for two decades, representing the 20th District in Montgomery Co. That district reaches roughly from Takoma Park, north to Colesville.He has been Maryland’s comptroller for 11 years, and he is seeking a fourth term. Maryland’s Public Information Act creates a balanced framework for guaranteeing public access to open information, while protecting sensitive and private material. The rapid ascension of new technologies has strained the implementation and effect of these laws – potentially chilling their otherwise beneficial use. SB 788/HB 1638, Public Information Act - Revisions, clarifies and reframes the Maryland Public Information Act to better accommodate citizen electronic engagement, personal surveillance footage from first responders and other county officials, and the release of sensitive personal information. MACo this week testified in opposition to HB 1270/SB 1042. In theory, the bill seeks to ensure there is adequate legal representation for low-income individuals asserting a constitutional claim in State courts. In practice, the bill would trigger a rush of litigation and costs for the State and local governments and create a profoundly unbalanced system that favors plaintiffs over defendants. Governor Larry Hogan this week announced the Board of Public Works’ approval of a new Text to 9-1-1 technology for Maryland, helping to update 1960s-era emergency systems with life-saving technology. This new Internet-based infrastructure allows citizens to send a Short Message Service (SMS) text message to 9-1-1. The Federal Communications Commission estimates that more than 70 percent of all 9-1-1 calls now come from cellular users. Text to 9-1-1 is a component of Next Generation 9-1-1 (NG911), an initiative aimed at updating the 9-1-1 service infrastructure to improve public emergency communications services in a wireless mobile society. NG911 will improve and enhance the handling of 9-1-1 calls from cell phone users with technology that will increase response times, location accuracy, and allow text, photo, and video data to be shared by callers to First Responders on their way to the emergency. A perennial MACo initiative, counties have called for the return of their fair share of transportation-sourced revenues to fund their roadwork for years. This year, MACo’s initiative calls for a Local Infrastructure Fast Track – a #LIFT4MD – to bring local governments back their historic 30 percent share of transportation revenues from the State’s Transportation Trust Fund. It also calls for an assessment of the state of local infrastructure in Maryland, and for the State to share any additional federal infrastructure funds with counties and municipalities. After discussing the topic with a myriad of stakeholders, MACo decided instead to introduce a consensus bill, with terms appealing to not only counties, but municipalities and the Administration. Therefore, House Bill 1569, as introduced, restores highway user revenues to counties and Baltimore City in eight years, and municipalities in two years. The hearings on MACo’s Local Infrastructure Fast Track for Maryland Act are scheduled for Wednesday, March 7 at 1 pm in the Senate Budget and Taxation Committee and Friday, March 9 at 1pm in the Senate Budget and Taxation Committee and Friday, March 9 at 1 pm in the House Environment and the Senate Budget and Taxation Committee and Friday, March 9 at 1 pm in the House Environment and Transportation and Appropriation Committees. Maryland lawmakers are considering a bill by Comptroller Peter Franchot that would repeal some of the state’s regulations on craft beer breweries. In November 2017, Franchot proposed the Reform on Tap Act of 2018, a bill to relieve regulatory burdens on craft beer production and sales. The Comptroller's bill would remove the state’s limits on how much beer breweries are allowed to sell on-site. It would also allow breweries to sell directly to retailers instead of requiring them to make franchising agreements with distribution companies. Currently, Maryland craft breweries are allowed to sell up to 3,000 barrels of beer, or about 500,000 pints, directly to consumers each year.
