Beyond the Numbers host Rob Nowak, CPA, Real Estate Tax Partner interviews personal tax expert Justin Reeves, CPA, Partner-In-Charge, Dallas office to discuss the new K2 or K3 tax forms and what they mean.“The purpose of these new forms is really, just a new way to present information that's been required for over 60 years. The IRS has noticed, perhaps a lapse of reporting in the area as it relates to foreign tax credits, that's ultimately what this is driven at calculating,” explained Reeves.He continued to note that these forms give practitioners in the field a simple and efficient way for practitioners to provide information to individual shareholders in the case of S corporations or in partnership filings. Nowak shared that the information regarding the forms can be misleading which are intended to assist taxpayers in having more gross income. For an individual or a trust who is claiming a foreign tax credit, the K2 or K3 form starts with foreign gross income, and on the form, there is total worldwide income or U.S only income. Ultimately, Reeves shared that the system helps drive down expenses allocated against their foreign-derived income, resulting in a larger credit. Additionally, as with everything tax-related, there are exceptions that exempt some from having to complete these forms. Exemptions include if a taxpayer is in a partnership or a flow-through entity, has no foreign activity, never provided foreign income information in the past, and neither partners nor shareholders require this information for individual return, then you will not need a K2 or K3 form. An employee is someone that receives a W-2 where deductions have come out of your check. The Form 1040NR, U.S. Nonresident Alien Income Tax Return, and its shorter version Form 1040NR-EZ, U.S. Income Tax Return for Certain Nonresident Aliens With No Dependents, are used by nonresident aliens who have U.S. source income and therefore have to file a U.S. tax return. Joint returns are not permitted, so that husband and wife must each file a separate return. The Form 1040NR-EZ can be used under conditions similar to those for the 1040EZ form. The Form 1040X, Amended U.S. Individual Tax Return, is used to make corrections to Form 1040, Form 1040A, and Form 1040EZ tax returns that have been previously filed. Generally for a tax refund, this form must be filed within 3 years after the date that the original version was filed, or within 2 years after the date that the tax was paid, whichever is later. Forms 1040X are processed manually and therefore take longer than regular returns. For years prior to 2010, Form 1040X had three columns: for the amounts from the original version, for the net increase or decrease for each line being changed, and for the corrected amounts. For 2010, the form was condensed with a single column for the corrected amounts. Due to confusion amongst taxpayers on how to complete the single-column form, the IRS revised the Form 1040X again for 2011 by returning to the original three-column format. Internal Revenue Service (IRS) tax forms are forms used for taxpayers and tax-exempt organizations to report financial information to the Internal Revenue Service of the United States. They are used to report income, calculate taxes to be paid to the federal government, and disclose other information as required by the Internal Revenue Code (IRC). There are over 800 various forms and schedules. Other tax forms in the United States are filed with state and local governments. Individual forms. 1040. As of the 2018 tax year, Form 1040, U.S. Individual Income Tax Return, is the only form used for personal (individual) federal income tax returns filed with the IRS. In prior years, it had been one of three forms (1040 , 1040A and 1040EZ - see below for explanations of each) used for such returns. The first Form 1040 was published for use for the tax years 1913, 1914, and 1915. For 1916, Form 1040 was converted to an annual form (for example, updated each year with the new tax year printed on the form). Initially, the IRS mailed tax booklets (Form 1040, instructions, and most common attachments) to all households. As alternative delivery methods (CPA/Attorneys, internet forms) increased in popularity, the IRS sent fewer packets via mail. In 2009 this practice was discontinued. Income tax returns for individual calendar year taxpayers are due by April 15 of the next year, except when April 15 falls on a Saturday, Sunday, or a legal holiday. In those circumstances, the returns are due on the next business day. An automatic extension until Oct. 15 to file Form 1040 can be obtained by filing Form 4868. Form 1040 is two abbreviated pages, not including attachments. Prior to the 2018 tax year, it had been two full pages, again not counting attachments, but following the passage of the Tax Cuts and Jobs Act of 2017, the IRS dramatically shortened both pages. The current first page collects information about the taxpayer(s) and any dependents, and includes the signature line. The current second page includes information on income items and adjustments to income, and additionally calculates the allowable deductions and credits, tax due given the income figure, and applies funds already withheld from wages or estimated payments made towards the tax liability. Prior to 2018, information on income items and adjustments to income had been entered on the first page. The Presidential election campaign fund checkoff, which allows taxpayers to designate that the federal government give $3 of the tax it receives to the Presidential election campaign fund, is near the top of the first page on both pre- and post-2018 versions of Form 1040. In 2021 partnerships and S corporations have a couple of new schedules, we have a K2 that now is going to show the distributions. We have a K3 on 1065. That's going to show additional deductions in income and credits. A K2 under 1120 S. Again showing ratios to deductions and we have the K3 that's also going to be showing deductions so this will be on 1065, the 1120s, and the form 8865. So if you perform or do taxes, make sure you notice we've got a few changes. And you call the IRS or you look on the IRS website and they say well, you just have to wait. Well, the first thing you want to do if at all possible is you need to go back to your employer and say I haven’t received it I will come by and pick it up. They can charge you a fee if it is electronic form, but make sure you have your documents. Otherwise, you’re at the mercy of the IRS to file the taxes for you. Have you checked out the new federal tax forms? You probably don’t want to wait until the last minute to prepare your taxes this year. With the new tax code here you’ll want to give yourself plenty of time to get familiar with the new federal tax forms. But before you get started you need to arm yourself with as much information as you can about the new tax code. That’s why today we brought our very own tax extraordinaire, Grayson Blazek to share his extensive knowledge of the new federal tax forms. Listen to this episode as Grayson helps us understand what the new tax forms look like, what’s changed, how to save and be more efficient on taxes, and what planning opportunities there are to prepare for next year. What’s different on the new federal tax forms? Well, that time of year is here again, everyone’s favorite season: tax season! You may have heard that there are many new changes this year to the 1040. The idea behind the new federal tax form is to simplify the tax filing process. The new 1040 is touted as a postcard, while not exactly postcard sized, it is down from 79 lines to 23. Although there are only 23 lines on the new tax form there are several addendums which utilize a building block approach. There might be a touch of confusion for the first few years, but the new tax forms should be pretty easy to get used to. Listen as Grayson explains the new federal tax forms and takes us on a tour of the new 1040. Here is the lowdown on the new schedules 1-6 Schedule 1 is similar to lines 10-36 of the old 1040. It is used to report extra income items like rental income and real estate and other above the line deductions. Schedule 2 generally covers the old lines 45-47. It is used for the alternative minimum tax. You may not even see this one since most people won’t come across it. Schedule 3 replaces lines 48-55 on the previous tax form. Schedule 3 covers child tax credits and dependent care credits. Schedule 4 is a replacement for lines 57-63 and covers self-employment. Schedule 5 is used for estimated tax payments and amounts paid with extensions Schedule 6 is the 3rd party designee. Besides the new federal tax forms, what else has changed? Obviously, the changes in the tax code are not only in the format. There are several other changes made as well. They eliminated personal exemptions which were $4500 per taxpayer on the 2017 return as well as dependents. The child tax credit used to be $1000 per child but has been increased to $2000 per child. The income threshold has been increased. There has also been a substantial change to standard and itemized deductions. And it is estimated that the number of people that will itemize their deductions will lower from 20% to 5%. Although there are fewer deductions your overall tax burden may be similar. Listen to this episode to hear what else has changed with the new tax code. What are the planning opportunities? When preparing your taxes each year you have the opportunity to reflect on what you could have done to decrease your overall tax burden and what you can do in the future to ease your tax burden. Consider whether you should be taking advantage of your retirement savings accounts or health savings accounts. You can also think about your deductions and how efficiently you can space your charitable deductions. Decide whether you could donate every other year to get past the new threshold for itemized deductions. A donor-advised fund is a great tool to use when planning for your taxes. There are many other planning opportunities to consider so listen in to discover how you can begin planning next year’s taxes. The OID is the difference between the stated redemption price at maturity and the issue price. OID is considered to be a form of interest. All debt instruments that pay no interest prior to maturity (zero coupon bonds) are presumed to be issued at a discount. The majority of OID bonds are zero coupon bonds.
