The Shulhan Aruch discussed the Mukse status of Tefilin on Shabbat. Tefilin are not worn on Shabbat, and thus the question is whether they may be moved on Shabbat. The Zohar HaKadosh (Midrash Ne'elam) teaches that not only is there no Misva to wear Tefilin on Shabbat, but it is prohibited to do so. That is also the implication of Maran in the Bet Yosef, Siman 31. Therefore, Hacham Ovadia, Rav Moshe Halevy and the Ben Ish Hai all rule that Tefilin have the status of "Kli She'melachto L'isur"-a utensil whose primary function is prohibited. Accordingly, the Tefilin may only be moved for two purposes. 1. "L'sorech Gufo"-their innate function. For example, a teacher may handle the Tefilin to show them to students as a demonstration.2. "L'Sorech M'komo"-for its place. If the Tefilin were in the way, they may be moved to make room for something else.The question is whether one may carry his Kuracha, containing both his Tallit and Tefilin, on Shabbat. The Kuracha is designated a "Basis"-base for both forbidden items (the Tefilin) and permitted items (the Tallit and Siddur), and therefore may be moved. If the Tallit can be removed without moving the Tefilin, that is best. However, if the Tefilin are in the way and prevent him from accessing his Tallit, he may move the Tefilin, since this is considered "L'Sorech M'komo"-for its place.Hacham Ovadia (Halihot Olam) poses a very strong question. Why is it permitted to remove the Tallit from the Kuracha? Once the Tallit is removed, it is no longer a Basis for permitted and forbidden items. It remains a "Basis L'davar Ha'asur," and becomes Mukse and may not be moved. This would be an apparent violation of "Bitul Keli MeHechano" suspending a utensil from function. Before the Tallit was removed, it was permitted to move the Kuracha, and afterwards it is prohibited.Hacham Ovadia suggests that the Halacha relies on the minority opinion that "Kli She'melachto L'isur" does not create a Basis, and therefore the Tefilin do not render the Kuracha Mukse, and there is no issue of "Bitul Kli MeHechano" suspending a utensil from function. Furthermore, he cites the opinion of the Rema who classifies Tefilin as Kli She'melachto L'heter-a utensil designated for permissible activity. He holds that there is no prohibition wearing Tefilin on Shabbat for reasons other than the Misva, such a protection from Mazikim (evil spirits). By relying on the combination of these two minority opinions, Hacham Ovadia permits removing the Tallit from the Kuracha.SUMMARYWhile Tefilin may not be worn on Shabbat, they may be moved if their place is needed or for use in an educational demonstration. One may carry a Kuracha contacting Tefilin and Tallit, and may remove the Tallit form the Kuracha.

In Hilchot Mukse, there is a category of objects classified as "Kli She'melachto L'heter"-utensils designated for permissible activity. A classic example would be plates, books and food, since the use of these items is permitted on Shabbat. The Gemara states that these items may be used for a broad range of functions. Specifically, they may be handled and moved for three purposes:1. "L'sorech Gufo"-their primary purpose. For example, using a cup for drinking.2. "L'Sorech M'komo"-for its place. If the item is in the way, it may be moved to make room for something else.3. "Me'Hama L'Sel"-From sunlight to shade. That is, if the item was exposed to danger of being damaged or lost, it may be moved to safety.Maran adds that within this category, food, drink and holy books are even more lenient and may be moved for no justification at all. The Poskim discuss what is the status of other items in this category, such as eating utensils, clothes and furniture. Is one permitted to randomly move a cup or chair, without one of the three purposes outlined by the Gemara? The Rambam (Hilchot Shabbat 25:1), as understood by the Magged Mishna, rules that these other items, besides food and books, need a justification to be moved. This is indicated by Maran as well in Siman 308:4, and this is also the ruling of Hacham Ovadia and the Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909).On the other side, the Shilteh Giborim does not make a distinction between the items and rules that these items may be moved without any need whatsoever. The Mishna Berura (Rav Yisrael Meir Kagan of Radin, 1839-1933), in his primary ruling, agrees with this. The Menuhat Ahaba (Rabbi Moshe Halevi, Israel, 1961-2001) is also lenient.Halacha L'ma'aseh, the practical conclusion is that one should be stringent and not move utensil and furniture for no reason. Only food, drink and books may be moved without a justification. It should be noted that the Poskim give expanded definitions of what is a justifiable purpose in moving these items. The Hazon Ish (Rav Abraham Yeshaya Karelitz, 1878-1953) ruled that fidgeting with a fork to relieve nervous anxiety is also a valid justification. The Ben Ish Hai ruled that removing items from the table to make it more presentable is a valid justification, even though technically, the item was not in his way. One can learn from this Halacha how serious the issue of Mukse is. Even "Kli She'melachto L'heter"-a utensil designated for permissible activity has restrictions on how it may be moved. SUMMARYFood, drink and holy books may be moved on Shabbat for no purpose whatsoever, whereas eating utensils and furniture may only be moved for a distinct purpose.

The Shulhan Aruch presents the Halachot of Mukse in Siman 308. A utensil whose primary function is for Melacha, such as a hammer, is called a "Kli She'melachto L'isur." Such a utensil may me moved for only two purposes. First, "L'sorech Gufo"-using it for a permissible function. For example, using a hammer to crack nuts. Second, "L'sorech M'komo"-for its place. The hammer is in the way and one needs its place. The Poskim discuss whether one may use the hammer to crack nuts, even if he can use a "Kli She'melachto L'heter," a utensil meant for permitted actions, such as a nutcracker. The Mishna Berura (Rav Yisrael Meir Kagan of Radin, 1839-1933) is strict. He rules that it is only permitted to use a hammer L'sorech Gufo, if there is no other means available. He brings a proof to his opinion in his Sha'are Sion. The Kaf HaHaim concurs with the Mishna Berura. On the other hand, Hacham Ovadia, in his Halachot Shabbat, clearly holds that once the Hachamim permitted using it, the leniency applies even if there is a better solution available. He marshals a long list of Poskim who are lenient. He also brings proof that Maran himself is of this opinion: If a garment is hung to dry on a rod, Maran permits either removing the garment from the rod or the rod from the garment. The rod is a "Kli She'melachto L'isur," and yet Maran permits moving it, even though there was another option of removing the garment from the stick. The Menuhat Ahaba (R. Moshe Levi, Israel, 1961-2001) in Vol. 1 and in Tefila L'Moshe takes this one step further. He argues that even if the alternative is immediately available, it is still permitted to take the "Kli She'melachto L'isur" instead of the "Kli She'melachto L'heter." There is absolutely no difference between them. Accordingly, one may take the hammer to crack the nuts even if the nutcracker is on the table, in front of him.Rav Moshe Feinstein (Russia-New York, 1895-1986) in his Iggerot Moshe (Vol. 5) makes a sort of compromise. He rules that if the nutcracker is immediately available, then of course he should use it. However, one does not have to trouble himself whatsoever to bring the "Kli She'melachto L'heter." For example, if he can bring a nutcracker from a neighbor's house. He says that even the Mishna Berura would be lenient in that case.The conclusion of the Sepharadic Poskim is that one may use the hammer in any event. However, if the nutcracker is immediately available, it is better to take the Mishna Berura's position into account and use it, since there is no difference.SUMMARYOne may use a hammer to crack nuts, even if he can bring a nutcracker. If the nutcracker is immediately available, it is better to use it, rather than the hammer.

One of the categories of Mukse is Keli She'm'lachto L'isur-a utensil whose primary function is prohibited on Shabbat. The Hachamim permitted moving such an item only L'sorech Gufo-for another permitted function or L'sorech M'komo-for its place. One example of Keli She'm'lachto L'isur is a sewing needle, as its primary purpose is for sewing which is prohibited. It would be permitted to use it to remove a splinter, L'Sorech Gufo. The same applies to knitting needles. The Poskim define rulers and scales, as Kelim She'm'lachtam L'isur, since it is prohibited to measure on Shabbat. This applies to non-digital scales as well. It is only permitted to use a food scale for the purpose of a Misva, such as measuring Masa or Maror for the Misva on Pesah. Other examples include: calculators, radios and flashlights. Accordingly, if someone wanted to move his clock radio to see the time, it would be permitted, as that would constitute L'sorech Gufo, as long as he is careful not to pull out the plug. He would also be permitted to move the clock radio from the dresser, L'sorech M'komo, in order to make space for something else that he wants to put there. A car is Keli She'm'lachto L'isur. If someone forgot food in the car before Shabbat, he may open the door or trunk to remove the food. This is considered L'sorech M'komo, since the closed door is blocking access to the food, it may be moved out of the way. Of course, this leniency applies only to rare cases in which opening the car door or trunk does not activate any lights or electric circuits. Also, there is no rationale to permit directly closing the door after removing the needed items.Clothes that were left in a closed electric dryer before Shabbat may be removed on Shabbat, assuming that opening the dryer door does not activate lights or electric circuits. Like the car, the leniency is because the door is a Keli She'm'lachto L'isur and opening the door is L'sorech M'komo. It would not be permitted to directly close the door after removing the clothes. It is permitted to move the fan to bring the flow of air closer, since that is considered L'sorech Gufo. Likewise, the fan may be moved so that the flow of air blows away from him, since that is considered L'sorech M'komo. Percolators, crockpots and coffee makers are classified as Keli She'm'lachto L'isur. If they have water inside of them, it is permissible to move them as needed. If not, they may be moved only L'sorech Gufo and L'sorech M'komo, e.g. remove them from the counter if their space is needed.Other examples of Keli She'm'lachto L'isur include:• extensions cords • adapters• scissors• Shabbat timers• nail clippers• fly swatters• regular pens (as opposed to special artist pens or quills which would have a stricter classification.• hole punchers, staplers• umbrellas• hair brush and comb• gardening tools such as hoes, rakes and sprinklersWallets- There is a Machloket (disagreement) between Ashkenazim and Sepharadim regarding wallets. When it has money in it, it is clearly Mukse as a Ba'sees (base) and may not be moved at all. However, if there was no money in the wallet, Ashkenazim are strict since it is designated for money. However, Maran in 310:7 rules that it is permissible. Similarly, an empty Sedaka pouch or an empty case of a musical instrument is also not Mukse.Toothbrush- According to the Poskim that brushing teeth with toothpaste is prohibited, a toothbrush is a Keli She'm'lachto L'isur. Hacham Ovadia has a famous ruling to permit the use of toothpaste on Shabbat, in which case the toothbrush is not considered Mukse at all.

Hacham Yishak Beracha, in his book Birhat Yishak on Hilchot Mukse (p.10), establishes a principle based on the Gemara in Masechet Shabbat (p. 124) that any item not considered a Keli (utensil), is completely Mukse, and may not be moved even L'Sorech M'komo-for its place, or L'sorech Gufo-for a permitted function. Therefore, a log of firewood is altogether Mukse and may not be moved for any purpose. A log is not a Keli (utensil), since it only has a one-time use; it is consumed as soon as its purpose is fulfilled. Hacham Yishak applies this principle to matches, cigarettes and charcoal, as well. These items are not considered a Keli, since they are consumed and destroyed with their use. However, he cites Hacham Bension who distinguished between a natural log of firewood and these items which were designed and produced expressly for this purpose. Therefore, he considers the match a Keli (utensil), and it may be moved L'Sorech M'komo-for its place, or L'sorech Gufo-for a permitted function-such as a toothpick or collar stay. Rav Moshe Feinstein (Russia-New York, 1895-1986) was stringent and did not view matches as a utensil, rather as firewood. However, all agree that this line of reasoning does not apply to a disposable utensil whose function was prohibited, such as an aluminum foil baking pan. Although like firewood, it too is discarded upon completing its function, there are two major differences. First, while the disposable pan may be thrown away after use, it does not disintegrate as the log, match and cigarette. Moreover, it is common to reuse aluminum foil pans nowadays. Therefore, disposable pans have the same Halacha as cooking pots and are designated Keli She'm'lachto L'isur, which may be moved L'Sorech M'komo-for its place, or L'sorech Gufo-for a permitted function. The Hachamim instituted a prohibition to return a door that has become dislodged to its place, out of concern that one will fasten it in place with a nail. Hacham Ovadia (Hazon Ovadia Shabbat Vol. 3, p. 10) discusses a case which is not included in this restriction: If a Mezuzah scroll falls out of its case on Shabbat, it is permissible to return it to its place. The scroll is not Mukse, because it is Kitveh Kodesh-holy scripture, and the Hachamim did not include such a case in their restriction.The English Yalkut Yosef, as well as Shemirat Shabbat K'hilhata (23:32) discus a common case in which a door knob or door handle falls out of the door. They hold that it is problematic to return it to its place, as this would constitute "Boneh."
