À l'occasion de sa revue de presse, vendredi, Paul Arcand commente un dossier de La Presse qui révèle qu'entre 2020 et 2024, le nombre de femmes en situation d'itinérance ayant perdu la vie a bondi de plus de 200% dans la province. Ces chiffres, qui proviennent d'une étude de l'Université de Sherbrooke, indiquent également que plus du tiers des personnes qui sont décédées durant ces quatre années se trouvaient en situation d’«itinérance cachée» au Québec. Ces données alarmantes, basées sur le dépouillement des dossiers du Bureau du coroner, ne brossent toutefois qu'un portrait partiel de la réalité. Les chercheurs rappellent que leurs travaux se concentrent uniquement sur les morts violentes ou suspectes, laissant présager un bilan réel encore plus lourd. The CFPB's June 5, 2026 statement on "Ability to Repay and Immigration Status" presents creditors with a difficult, and potentially unprecedented, compliance dilemma. The Bureau says that when creditors are required to assess a consumer's ability to repay, they may, and in some circumstances may be required to, consider information about the consumer's immigration status if that information bears on the consumer's current or reasonably expected future income. But how can creditors take immigration status into account without violating federal or state fair-lending laws that prohibit discrimination based on national origin? That was the central question explored in the latest episode of the Consumer Finance Monitor Podcast, released today. Our host, Alan Kaplinsky (founder, leader for 25 years and now Senior Counsel of our Consumer Financial Services Group) was joined by three Ballard Spahr lawyers with complementary expertise: Dustin O'Quinn, a nationally recognized immigration lawyer; Richard Andreano, leader of the firm's Mortgage Banking Group and a leading authority on mortgage lending regulation; and John Culhane, a longtime member of Ballard Spahr's Consumer Financial Services Group. The discussion demonstrates just how difficult the CFPB's guidance may be for creditors to operationalize. Key Topics Discussed Include: ·                 What exactly did the CFPB say? ·                 Credit cards and mortgages are different; John Culhane explained that the credit card ability-to-repay requirement is fundamentally a point-in-time assessment. ·                 Immigration status is anything but binary; nOne of the most important points made during the podcast was that creditors cannot sensibly divide applicants into two categories—those who are "legal" and those who are "illegal." ·                 The ITIN issue; The CFPB guidance also raises questions about lending to consumers who have an Individual Taxpayer Identification Number (ITIN) rather than a Social Security number. ·                 The fair-lending problem; Rich Andreano described the problem succinctly: The guidance raises the risk associated with failing to consider immigration status but does not provide clear guideposts for considering immigration status without running afoul of ECOA and other civil-rights laws. ·                 Simply lending only to citizens and permanent residents is not the answer; One possible reaction might be for a creditor to adopt a bright-line policy: lend only to U.S. citizens and lawful permanent residents. ·                 The banking agencies have entered the picture; Among the subjects addressed are credit risk and underwriting, source of repayment, collateral considerations, documentation and verification, portfolio and concentration risk, and consumer compliance. ·                 What should creditors do? The podcast participants agreed that simply ignoring the CFPB guidance is unlikely to be a satisfactory answer, particularly for banks subject to regular examination. The CFPB's immigration-status guidance sits at the intersection of ability-to-repay requirements, immigration law, fair lending, safety and soundness, and state law. It is therefore an unusually complicated issue that cannot be analyzed solely from a consumer-finance or immigration-law perspective. Così il desiderio di giustizia spinge il commissario Alessandri nelle zone cieche dell'animo umano per trasformarsi in qualcosa di più intimo e sconvolgente: la ricerca di sé.Sembra addormentato l'uomo seduto a terra contro un ippocastano del viale, circondato da un marasma di foglie e rami spezzati dal nubifragio della notte precedente. Ma non dorme, è stato ucciso altrove, con ferocia, e spostato lì dove la pioggia ha lavato via ogni indizio. Agli agenti basta poco per riconoscere in quel corpo Riccardo Mazza, noto storico dell'arte e curatore di una mostra su trenta capolavori ritrovati inaugurata in pompa magna appena poche ore prima. A occuparsi del caso è il commissario Amedeo Alessandri, che di una vittima celebre come quella farebbe volentieri a meno. Come avrebbe fatto a meno di partecipare all'inaugurazione dove ha stretto la mano proprio all'uomo che ora giace, composto e senza vita, di fronte a lui. Lui che da vent'anni non ha più aperto un libro d'arte, non ha più guardato un dipinto, un catalogo; vent'anni trascorsi dalla morte di un altro stimato storico dell'arte, suo padre. Ma in quest'indagine ci sono altri elementi a turbare il commissario: il medico legale gli ha fatto sapere che il cadavere è istoriato con la parola falso, tatuata ovunque centinaia di volte, ossessivamente, con l'unica eccezione della testa e delle mani. E poi, nell'appartamento della vittima, vuoto come la cella di un monaco, viene rinvenuto un reperto che lo riguarda, destinato a far sanguinare vecchie ferite di un passato che non passa. In questo giallo, dove l'arte è scenografia e prim'attrice, Giuseppe Fusari racconta attraverso un indimenticabile protagonista i vizi di un piccolo mondo che giudica, nasconde, intrallazza, talvolta uccide. Quand les nazis spoliaient les objets du quotidien Quand l'historienne Sophie Juliard, qui travaille sur le pillage des ateliers d'artistes sous l'Occupation, la contacte, Adrianna Wallis découvre, quatre-vingts ans après les faits, que sa famille a été spoliée. Elle savait que Diane Esmond, sa grand-mère paternelle, était peintre, mais avait presque oublié qu'elle était juive. Après le départ précipité de celle-ci pour New York, l'appartement parisien qu'elle occupait a été entièrement vidé par l'administration nazie, comme 38 000 autres dans la capitale : les toiles ont disparu, mais aussi le mobilier et jusqu'aux moindres objets du quotidien. Pour Adrianna, elle-même artiste, ce passé familial refoulé résonne étrangement avec son travail, elle qui n'a cessé, sans trop comprendre pourquoi, d'interroger l'absence, le vide laissé par la disparition d'objets chers. En tissant enquête intime, archives et les réflexions du physicien Joël Chevrier, Adrianna Wallis remet en mouvement cette histoire longtemps tue et interroge ce qui se transmet, parfois à notre insu, d'une génération à l'autre.
