This Day in Legal History: Pennsylvania Coal Co. v. MahonOn this day in legal history, November 14, 1922, the Supreme Court heard arguments in Pennsylvania Coal Co. v. Mahon, a foundational case in American property law. At issue was a Pennsylvania statute—the Kohler Act—that prohibited coal mining beneath certain structures to prevent surface subsidence. The Pennsylvania Coal Company had previously sold the surface rights to a parcel of land but retained the right to mine the coal beneath. When the state blocked their ability to do so, the company sued, arguing that the law had effectively stripped them of valuable property rights without compensation. The case reached the Supreme Court, where Justice Oliver Wendell Holmes Jr. delivered the majority opinion.In his decision, Holmes introduced the now-famous principle that “while property may be regulated to a certain extent, if regulation goes too far it will be recognized as a taking.” This line marked the birth of the regulatory takings doctrine, which holds that government actions short of full appropriation can still require just compensation under the Fifth Amendment. Holmes emphasized that the economic impact of a regulation on the property owner must be weighed, not just the public interest it serves. In this case, the regulation was deemed too burdensome to be considered a mere exercise of police power.The Court sided with the coal company, holding that the Kohler Act, as applied, amounted to an unconstitutional taking. The lawsuit follows public comments by Donald Trump and Robert F. Kennedy Jr. promoting the same unproven theory. Composed in 1812 during a period of personal turmoil, the Eighth is often described as a cheerful outlier among his symphonies, compact and effervescent despite being written amid deteriorating health and emotional strain. It was premiered in 1814, but it was a revival performance on November 14, 1814, in Vienna that helped solidify its reputation and gave the public a second opportunity to appreciate its lightness and humor in contrast to the more dramatic works surrounding it.Unlike the grand scale of the Seventh or Ninth, the Eighth is shorter and more classical in form, often drawing comparisons to Haydn in its wit and economy. Yet Beethoven infuses it with his unique voice—syncopations, dynamic extremes, and abrupt harmonic shifts abound, particularly in the first movement. Following last week's vote to end the anti-xeno defence pact with the Sirius Corporation, Councillor Nakato Kaine is advocating on an "Alliance first" trade policy, buying from Alliance-based corporations, while Prime Minister Mahon wants to continue the Alliance's dependence on external mega-corporations like Sirius. Alliance systems have split along these lines, with Kaine and Mahon keen to show that their policies will deliver better growth for the economy.

We’ll be right back Break 2: GWINNETT FAIR STORY 4: Elderly woman dies after fire breaks out at Snellville home A heartbreaking Labor Day weekend in Snellville—an elderly woman lost her life after being rescued from her burning home, Gwinnett fire officials shared Tuesday. The fire broke out Sunday evening on Eastwood Drive. Neighbors called 911, reporting flames in the garage and smoke pouring from the crawlspace. They said the woman was trapped inside. Firefighters found her on the first floor, rushed her out to paramedics, but she passed away shortly after reaching the hospital. The fire started in the garage, though the cause remains unknown. Power lines were down, flames had spread fast, and by the time crews arrived, the garage was engulfed. STORY 5: State floating new rules for data centers The Georgia Department of Community Affairs (DCA) is shaking things up with new rules to restart reviews of data center projects. Why the pause? Back in July, they hit the brakes after environmental advocates raised red flags, saying these massive facilities—huge energy and water guzzlers—weren’t being scrutinized enough. The proposed rules? Developers would have to spill the details on energy and water usage. Big centers (300,000+ square feet in cities, 500,000+ in rural areas) would face stricter reviews. A public hearing’s set for Sept. 9 in Atlanta, with comments open until Sept. 12. Final decisions drop Nov. 20 in Savannah. We’ll be right back. „Begin Again, Again“ – der Titel des neuen Albums des Wahlberliners J Mahon bringt das lebenslange, repetitive Sich-neu-orientieren auf den Punkt. Er selbst assoziiere diesen Titel bereits mit seinem Kinderzimmer, als er dort Musik gehört habe und sich immer wieder über die Zukunft gewundert habe. „Ich war so dankbar dafür, dass ich dort war, wo ich im Leben stand, und dass die Menschen, die mich jetzt umgeben, mir so viel bedeuten. Ich bin glücklich, dass ich einen Neuanfang machen konnte und dass auch andere diesen Weg gehen,“ sagt Mahon selbst über den Titeltrack seines neuen Albums. Auf dem folgt er konstant dem musikalischen Stil seines Debütalbums („Everything Has A Life“, 2023) – einer Champer-Pop Mischung zwischen Folk-Rock, Psychedelia verwoben mit Synthesizern, Streichern und Piano. Beeinflusst von Künstler*innen wie Grizzly Bear, Sufjan Stevens oder Bright Eyes, hat J Mahon mit „Begin Again, Again“ zwölf neue Tracks kreiert, die ihn zudem als wunderbaren Geschichtenerzähler herausstellen. In lyrischer Form beobachtet Mahon Absurditäten des Lebens, welchen Wert beispielsweise das Wort toter Menschen im Hier und Jetzt noch haben kann, oder welche Kosten ein Neuanfang – wie sein eigener nach dem Umzug von Australien nach Berlin – tatsächlich mit sich bringt.

As you've been hearing in our news bulletins, there's been an accusation that democracy hasn't been upheld at a meeting of Ennis's elected representatives. Tense exchanges took place during this week's Ennis Municipal District meeting where residents and business owners flooded the public viewing gallery to observe a discussion about the Draft Ennis Local Transport Plan. After a motion tabled by Fianna Fáil Councillor Tom O'Callaghan calling for the removal of proposals to reduce two-lane access to Carmody Street, Mill Road, Clare Road, Clonroad, Lifford Road and Highfield Park received unanimous support, the Clarecastle representative asked for a vote on the matter. This request was denied by Mayor of Ennis, Fine Gael Councillor Mary Howard, however, who stated that it couldn't go to a vote as public consultation is ongoing. This was met with fierce opposition from Councillor O'Callaghan as well as Sinn Féin Councillor Tommy Guilfoyle and members of the public in the gallery. Clare FM's Seán Lyons was at the meeting and spoke to local businessman Michael Barry who was one of those in attendance. Meanwhile, a local community group is lending its support to the Ennis Local Transport Plan, saying “Ennis Can't Stay Stuck in the Past”. Better Ennis, which advocates for healthier town centres, and active and public transport for all ages and abilities has robustly defended many of the proposed interventions that they believe will make the town a much healthier and attractive place to live and work. The Trump administration is continuing its efforts to claw back $20 billion worth of Biden-era climate funding for low-income communities — part of the Greenhouse Gas Reduction Fund. For now, the $20 billion remains frozen in a Citibank account, preventing eight organizations from distributing the money that would finance tens of thousands of projects across the country to fight climate change. EPA Administrator Lee Zeldin has accused the recipients of the program of misconduct and waste. Cathie Mahon is the president and CEO of Inclusiv, one of the groups in charge of disbursing the now-frozen funds.
