In this episode of the Energy Evolution Podcast, host Taylor Kuykendall discusses climate litigation with legal experts Hannah Weisman, a professor of law at Penn State University, and Phil Goldberg, special counsel with the Manufacturers Accountability Project. Weisman argues that litigation is a crucial avenue for accountability in the face of legislative inaction on climate change, while Goldberg contends that courts lack the tools to effectively address broader policy issues and that litigation may divert attention from meaningful legislative solutions. The conversation highlights the differing perspectives on the role of the judiciary in climate action, with Weisman emphasizing the urgency of the crisis and Goldberg cautioning against using the courts as a primary mechanism for policy change. Phil Goldberg is a Washington, DC-based lawyer who is helping defend the oil and gas industry in the more than two dozen climate-related lawsuits that have been filed against it by local governments across the U.S. Goldberg talks about the history of climate litigation, why the public nuisance claims being made against the industry are “unimaginably broad,” the NGOs that are funding the litigation, and why those NGOs “want to have judges set energy policy.” (Recorded July 26, 2023.)
The US Supreme Court recently decided it would not weigh into a dispute between oil companies and local governments over the appropriate venue to hear lawsuits seeking damages for adverse impacts allegedly caused by the oil and gas industry's greenhouse gas emissions. These climate liability lawsuits are now poised to proceed in state courts across the country. Phil Goldberg, special counsel for the Manufacturers' Accountability Project, joined the podcast to discuss the implications of the Supreme Court action and what to expect going forward as these cases are litigated. He also delved into what's at stake not just for the oil industry but for consumers and businesses, and why he views climate lawsuits as a “lose proposition for everybody,” especially those of us that regularly need to fill up at the pump. Stick around after the interview for Starr Spencer with the Market Minute, a look at near-term oil market drivers.

"Plugged In" hosts Neil Chatterjee and energy reporter Breanne Deppisch welcome climate attorney Phil Goldberg to discuss a recent surge in climate lawsuits against utility companies and energy manufacturers from the legal perspective. Goldberg, the managing partner at the D.C. office of Shook, Hardy, and Bacon, argues that federal regulators and lawmakers should decide the climate change debate, not the courts. When asked if the industry should play a financial role in mitigating the effects of climate change, he said "we all have to be part of the solution, and the energy companies are no different.See omnystudio.com/listener for privacy information.

This is a case in point with the speakers from this minute: Russell Simmons, Phil Goldberg and Georges Billard-Madrieres. Nik and Niva join us for the lively Minute which discusses the world that Paramahansa Yogananda was stepping into when he first landed on the shores of Boston, America. We break our usual protocol of having a maximum of four people on the podcast, the guests shared a pod from conception to birth, and we did not feel it right to separate them now. They are our first Indian guests on the podcast, and would you believe it was recorded a month ago but the stars aligned (without our planning) to have it published precisely on Indian Independence Day! Nearly two dozen lawsuits against energy manufacturers seeking state tort damages over climate change have been filed in state courts. The defendants removed the cases to federal courts because the subject matter of the litigation involves exclusively federal issues, namely national energy policy over the worldwide uses of fossil fuels. On May 17, 2021, The Supreme Court released its decision in one of the cases, BP P.L.C. v. Mayor and City Council of Baltimore. By a vote of 7-1, the judgment of the U.S. Court of Appeals for the Fourth Circuit was vacated and the case remanded. Justice Gorsuch's majority opinion was joined by all other members of the Court except Justice Sotomayor, who dissented, and Justice Alito, who took no part in the consideration or decision of the case.Phil Goldberg and Karen Harned join us to discuss this decision and its implications. Philip Goldberg is our guest today, here to talk about his latest book, “Spiritual Practice for Crazy Times: Powerful Tools to Cultivate Calm, Clarity, and Courage.” And this is definitely the year for it! We are all hoping for an end to the pandemic in the next 6 to 8 months through the power of vaccines, but it is currently surging and there is widespread anxiety and depression regarding that, the racial problems, the on-going political divide—despite the change in leadership, the economic concerns that continue to rise and may worsen if leadership does not intervene and the potential for disaster if we do not address the climate change issue. These are potentially transformative times, but we are still in the chaos stage of such change. Goldberg's intervention is to offer us the “sanctuary of the self” and to teach us how to access it. In the 20th century a good number of Hindu teachers emigrated to the US. One of the most influential was the man known as Paramhansa Yogananda (1893-1952). He began a small school in India that grew into a worldwide mission that focused on instructing people of all or no religions on the deeper practices, philosophy & theology of Raja Yoga. His 1946 book "Autobiography of a Yogi" is still a spiritual bestseller today. Phil Goldberg is a leading author on Hinduism in the West. He's also someone I love hanging with every time I'm in LA. His book on Yogananda is well researched, & a compelling story. It is neither hagiographic nor a sensational hit piece. If you enjoy Eastern thought, you'll appreciate these 2018 episodes

Philip Goldberg – Spiritual Practice For Crazy TimesHow To Build Your Own “Sane Asylum”Aired Tuesday, May 5, 2020 at 2:00 PM PST / 5:00 PM ESTInterview with Practitioner, Teacher and Author Philip Goldberg “Timeless wisdom is always timely.”— Swami BeyondanandaAs our attention is drawn “out there” to the latest news or latest speculation or latest commentary about COVID-19, information given ostensibly to safeguard our health is making people more stressed, and consequently less healthy. The question is not so much how do we tune that information out, but how do we attune ourselves in to the resources that will help us process this information in a helpful, healthy way?Long-time meditation teacher, practitioner and author Philip Goldberg has a new book out that couldn’t be more timely – Spiritual Practice for Crazy Times. And anyone who doesn’t think these are crazy times must be nuts.Philip Goldberg has been studying the world’s spiritual traditions for more than 50 years, as a practitioner, teacher, and writer. He is the author or co-author of more than 20 books, including The Intuitive Edge; Get Out of Your Own Way; and Roadsigns on the Spiritual Path: Living at the Heart of Paradox. His 2010 book American Veda: From Emerson and the Beatles to Yoga and Meditation, How Indian Spirituality Changed the West chronicles the remarkable influence of India’s traditional spiritual teachings on the West and was named one of the top 10 religion books of the year by both Huffington Post and the American Library Association’s Booklist. His most recent book, published by Hay House, was The Life of Yogananda: The Story of the Yogi Who Became the First Modern Guru. He also appears onscreen in the award-winning documentary Awake: The Life of Yogananda. A screenwriter and published novelist (This Is Next Year), Phil is an ordained interfaith minister, spiritual counselor, and meditation teacher trained in 1970 by Maharishi Mahesh Yogi. Now I have to be honest. Phil and I go back a long, long ways – since before I knew him. We both attended John Marshall Junior High School in Brooklyn at the same time, even though I didn’t know him then, and we grew up in the same spiritual tradition – as Brooklyn Dodger fans.I’ve had a chance to go through Phil’s prescriptions for creating a “sane asylum” during these crazy times, and they are filled with humor, down-to-earth pragmatic wisdom, and uncommonly commonsensical practices. If you’re ready to “go sane” and help others in your community do the same, please tune in this Tuesday, May 5th 2-3 pm PT / 5-6 pm ET. http://omtimes.com/iom/shows/wiki-politiki-radio-show/To find out more about Phil Goldberg’s work, please go here: http://philipgoldberg.com/about-philip-goldberg/Support Wiki Politiki — A Clear Voice In the “Bewilderness”If you LOVE what you hear, and appreciate the mission of Wiki Politiki, “put your money where your mouse is” … Join the “upwising” — join the conversation, and become a Wiki Politiki supporter: http://wikipolitiki.com/join-the-upwising/Make a contribution in any amount via PayPal (https://tinyurl.com/y8fe9dks)Go ahead, PATRONIZE me!
