This Day in Legal History: The Declaration of SentimentsOn July 20, 1848, at the close of the two-day Seneca Falls Convention in upstate New York, roughly a hundred people signed the Declaration of Sentiments—the founding document of the organized women's rights movement in the United States. Drafted principally by Elizabeth Cady Stanton, it was a deliberate and pointed act of legal argument: Stanton modeled it on the Declaration of Independence, echoing Jefferson's cadences but adding two words that changed everything—”that all men and women are created equal.”The genius of the document was to take the nation's own founding logic and turn it on the exclusion of half the population. It then catalogued, in the form of a bill of particulars against “man” rather than King George, the specific legal disabilities women lived under. Married women had no right to their own property or wages—under the common-law doctrine of coverture, a wife's legal identity was absorbed into her husband's. Women could not vote, were barred from most professions and higher education, had almost no rights to their own children in the event of separation, and were governed by laws they had no voice in making. The Declaration listed these as concrete legal grievances, not vague complaints, framing the denial of women's rights as a violation of the country's stated principles.The most controversial demand was the resolution calling for women's suffrage, which passed only narrowly and with the public support of Frederick Douglass, who attended the convention. The significance of July 20, 1848 is that it launched a legal and political campaign that would take seventy-two years to win the vote, with the Nineteenth Amendment in 1920, and far longer to dismantle coverture and the web of laws built on women's legal subordination. The reasoning flows from the Supreme Court's recent framework, which asks whether a gun regulation is consistent with the nation's historical tradition of firearms regulation; the majority concluded these bans are not. What makes this a genuinely big deal is the split it creates. Just last week, a different federal appeals court upheld Illinois's ban on semi-automatic weapons—so we now have appeals courts squarely disagreeing on whether these bans are constitutional. That kind of circuit split is precisely the condition that draws the Supreme Court in, and the Court is already poised to take up whether bans on semi-automatic rifles violate the Second Amendment. The significance is that a question affecting roughly a dozen states with similar laws is now barreling toward a definitive answer. For the moment, New Jersey's ban is unenforceable as to these weapons, but the durability of that outcome—and of assault-weapons bans nationwide—now depends on what the Supreme Court does next.US appeals court declares New Jersey's ban on assault rifles unconstitutional | ReutersA federal judge has ruled that the Trump administration cannot rely on a White House budget-office regulation to cancel billions of dollars in grants simply because those grants no longer match its priorities. U.S. District Judge Indira Talwani in Boston sided with a coalition of Democratic-led states, rejecting the administration's claim that a clause in Office of Management and Budget regulations gave it authority to revoke funding whenever an agency's focus shifts. Here's the underlying principle. When Congress appropriates money for a program and an agency awards grants under it, the government generally can't just take that money back on a whim—grant recipients have relied on it, and the terms for termination are limited. The administration's theory was that an OMB regulation let it terminate grants it deemed “inconsistent with agency priorities,” effectively a roving power to defund causes it disfavors. Judge Talwani found the regulation didn't authorize anything of the kind. The significance connects to a theme we keep returning to: the limits of executive power over money that Congress has already directed. The administration has repeatedly tried to redirect or withhold funds to reshape policy without going through Congress, and courts have repeatedly pushed back. U.S. District Judge William Orrick in Oakland ruled that the workers hadn't shown the “irreparable harm” needed for an emergency order halting the layoffs, which are set to begin July 22, and that the merits of their novel claims will be decided in private arbitration. The allegations are striking. The plaintiffs—engineers, managers, researchers, and designers suing anonymously—say Meta used a suite of internal AI systems to score and rank employees onto a termination list, including an assistant called “Metamate,” an employee-trained “second brain” that tracked workers' communications, and a productivity score drawn from scanning keystrokes, screen content, emails, and browser history. Meta denies wrongdoing and insists humans, not algorithms, made the layoff decisions. This is a frontier legal question: when an employer uses AI to help decide who gets cut, and those tools allegedly disadvantage people with disabilities or on leave, is that illegal discrimination? The judge's refusal to block the layoffs was procedural—losing a job usually isn't “irreparable” because money damages can fix it—but he pointedly noted the case raises “serious questions” and said he might reconsider based on more evidence about how AI was actually used. Ken Kies, who served as the agency's acting chief counsel and as Treasury's assistant secretary for tax policy, told administration officials their requests would violate a federal law that bars the president, the vice president, and other White House officials from ordering the IRS to conduct or terminate an audit of any specific taxpayer. That statute is a direct legacy of Watergate-era abuses, when presidents tried to sic the tax agency on their enemies, and tax professionals regard it as the single most important safeguard against weaponizing the tax code. Kies apparently stood on that law—and lost his job for it. The story connects directly to one we covered recently: the administration's $1.8 billion “anti-weaponization” settlement that would have given the president and his family immunity from IRS audits, which a federal judge struck down as a collusive arrangement with no basis in law. The significance is about the fragile independence of tax administration. The protections that keep audits free from political direction only work if the officials inside the agency are willing to enforce them—and when the person who says “no” to an unlawful demand is pushed out, it sends a chilling message to everyone who remains. This week, we're examining where the big push for new gun restrictions in Virginia has ended up. The legislature has finished its job. So, we have fellow-Virginian and gun commentator Cam Edwards from Bearing Arms on the show to go over where things stand. Lawmakers accepted seven of Democratic Governor Abigail Spanberger's recommendations for changes to the gun bills they passed. However, she rejected two of her most significant changes, including one to the "assault firearms" ban. That means she will have to decide whether to sign or veto the original language she was sent. Cam said animosity between the governor and legislative leaders may be part of the reason the House and Senate rejected her changes. However, he said it's unlikely she vetoes either bill as a result.  He also agreed the overall package is among the most aggressive any state has passed in a decade or more. Cam argued that could drag down the governor and her party's numbers, leaving an opening for Republicans to outperform in next year's elections. But he also said there's a good chance the legislature could come back and double down on even more gun restrictions before then. Cam said the legal battle is where a lot of the short-term action in the fight over these bills is likely to happen. He noted there are real hurdles to victory for gun-rights activists, though, especially in federal court.Special Guest: Cam Edwards.

As the legislative session kicks off this month, a group of Minneapolis parents are determined to drive change around gun violence in Minnesota.Their children attend Annunciation Catholic School and were present during the mass shooting on August 27th. Two children were killed and 28 others injured.As their community takes steps to heal, the parents also want to ensure that nothing like it ever happens again.Meanwhile, lawmakers are set to introduce a slate of legislation aimed at gun violence prevention, school safety and mental health resources. DFL State Rep. Emma Greenman will introduce an assault weapon ban on Tuesday. Rep. Greenman joined Minnesota Now host Nina Moini to talk about the legislation.

This week, we're looking at the dueling reactions to the Annunciation school shooting. On the left, Minnesota Governor Tim Walz (D.) is calling for a special session of the legislature to pass a gun-control package likely to include an AR-15 ban. On the right, the Department of Justice is reportedly considering an effort to ban all trans people from owning guns. The Second Amendment Foundation is opposed to both of these ideas. So, we have Kostas Moros, a lawyer who was recently hired by the gun-rights group, back on the show to explain why he doesn't like the proposals and how they might fare legally and politically. Moros said any attempt to blanket-ban people who identify as trans or who have been diagnosed with gender dysphoria from owning guns would run into serious legal and constitutional trouble. He explained that current law requires an individual finding of dangerousness for the government to strip anyone of their gun rights on the basis of mental health. He argued, even if Congress changed the law, it would run afoul of the Second Amendment, and the Supreme Court would likely strike it down. Moros argued the same is true for the potential "assault weapons" ban that could come out of Minnesota. He said four Supreme Court justices have already signaled they'd strike down a ban, and a Minnesota law could actually provide further reason for the Court to get involved. As a lifelong Democrat, I always thought the problem of gun violence was easy to solve. Just get rid of the guns. It was one of the most important issues for us as Bill Clinton rallied voters to the polls in 1992. But back then, it wasn't mass shootings that we worried about. It was handguns. Just look at this scene in Aaron Sorkin's The American President, released in 1995, where Michael Douglas has to bury protecting the climate to pass a weapons bill, but by the end, he realizes he doesn't have to sacrifice anything. He can and will get both.Four years later, Eric Harris and Dylan Klebold would become famous by shooting up Columbine High School with illegally purchased weapons. That led to the renewal of the now-expired 1994 Assault Weapons Ban originally implemented after Patrick Edward Purdy killed five children at an elementary school in Stockton, California, in 1989. We had a joke back then called “going postal,” referring to the same kind of person who would open fire on post offices or other office buildings. It seemed like men reacted violently to being rejected, either by a job or a woman. School shootings were rare. But Columbine hit differently than any tragedy that came before it.It wasn't just the crime itself; it was the pleasure the shooters took in carrying it out, performing for the security cameras, the casual cruelty, and later, how they became subversive icons. All of these years later, many of our early theories about them turned out to be wrong. They weren't really bullied. For them, it was more about the thrill of killing and gaining fame for it. By 1999, two significant changes had occurred in American society. The 24-hour news cycle, thanks to the O.J. Simpson trial, and the rise of the internet, which could give us our news even faster. However, it did something else as well. It allowed ordinary people to become famous overnight. That's still true. Anyone can get famous for anything. Mass shooters also have their influencers and platforms. But even more importantly, like the Columbine shooters, they are all caught up in the romance of building a mythology behind their planned shootings, their grand statements against society as they carry out their evil acts. They seem to have empathy for other shooters. They want to be like them. They want to be feared and remembered. The more evil the deed, the greater the myth. The endgame always seems to be suicide, go out with a bang. Solving that problem, understanding it, trying to get ahead of it, proved too difficult, so we pivoted to the guns. Always the guns. Just get rid of the guns, and the problem will be solved.Like these TikTokers: I used to believe that. I also demonized people who carried them, and it was an easy excuse to blame the other side. What else is new? At least we want to do something about it, I would say. For this reason, I began studying mass shooters. I thought that if I could identify the one thing they had in common, maybe we could find a way to reach them before they decide to pick up a gun.Every time I brought it up to anyone I knew on the Left, I would always get the same answer: it's the guns. Take away the guns, solve the problem. They didn't want to talk about anything else. If you lived through the Oklahoma City bombing and 9/11, it seemed obvious that if people want to kill, there are other ways. Just look at suicide bombers, or people who drive trucks through crowds, or go on stabbing sprees. No, guns just made it easier, but taking them away is not only impossible, it doesn't solve the problem. In my research, I came across a site called GunViolence.org. They lay out just how rare mass shootings are compared to the rest of the shootings in America. I was shocked when I actually looked at the numbers. Here is their ten-year review:Gun deaths are part of the everyday reality for many working-class families living in high-crime cities, and yet, in the post-George Floyd America, even talking about “Black on Black” crime is strictly verboten. It has to be the guns. On August 27, the same day as the most recent shooting in Minneapolis at a Catholic school, several other people lost their lives to gun violence. They won't talk about how residents in DC are relieved to be able to walk on the streets and feel safe at night. This latest shooter, Robert/Robin Westman, bought his guns legally. Giffords.org gives Minnesota a grade of “B.” Yet, here are their suggestions to improve that grade:None of these improvements would have stopped Westman from shooting his gun through the window while Catholic students were praying on the second day of school. He did it because he knew that they were too trusting and that there would be few barriers in his way. For a guy like Westman, or any of the latest trend of trans and nonbinary perpetrators of violence, wearing a mask of a woman offers an extra layer of protection, but it also reveals someone who doesn't want to be who he is in a society that no longer has any use for men. Not only won't they look into it, but their greatest fear coming out of the event was whether they would offend the transgender community.You see how easy it is to blame the guns? Then, you never have to look at anything else, uncomfortable things, things no one can even talk about.And for those complaining that the Republicans are “politicizing a tragedy,” know this: all the Democrats have done for the last 30 years is politicize tragedies. Never let a crisis go to waste. And the answer is always the guns. Because “it's the guns,” we never had to face what we'd done to contribute to making this country worse. We never had to confront what the feminist movement had done to men. Listen to how these women talk on TikTok. It isn't just that men have fled the Democratic Party. It's that they've been abandoned by them and, worse, they've been demonized.I am not excusing violence, certainly not mass murder, certainly not of children. But how can we not even talk about what has happened to men over the past 20 years that has brought them to the point where so many of them feel like there is no place for them in society, that they are loathed at best, invisible at worst? And if we don't understand them, if we don't see them, if we don't know how to reach them, how can we possibly stop them? Oh, don't worry, we'll just take away the gun. That will solve the problem.We never had to confront what psych meds might have done to potential mass shooters. We weren't even allowed to bring it up lest we offend those afflicted with mental illness. At least now, under Trump, we have RFK, Jr. to take a look, finally, at whether or not these drugs had any impact on mass shootings. After the massacre at Sandy Hook, I realized we lost the gun debate. Adam Lanza's guns were locked up. But he stole them, shot his mother in the face, and went on a rampage, where he would later end his life.I knew that wasn't about the guns. It couldn't be. So what else was going on? How can we prevent this problem from happening again? The guns? Seriously? That's all you got? Yes, that's all they got. Even now. But what I know now is that we have to do the other thing. We have to pivot to protecting children — schools, churches, parks, restaurants. We must ensure our buildings are shooter-proof, just as we make sure they are earthquake-proof. Debating about guns for 30 more years isn't going to do anything. And then, we have to have a serious conversation about the deeper issues at play, not just with the most recent shooting, but with all mass shootings. How is it that they become celebrities? Why do men feel left behind? Why do they think they need something like this to be valued? Why did this shooter and so many others of late feel they had to transition or identify as something other than a man to be seen and valued? What can we do as a society to help them?We live in a take-no-prisoners new world of algorithms and isolation. It will likely disrupt our species in ways we can't even fathom. This week, the Supreme Court cleared its slate of gun cases. It made three substantial moves along the way. First, it finally revealed what it would do with long-languishing cases against Rhode Island's magazine ban and Maryland's AR-15 ban. Then, it decided, unanimously, whether Mexico could sue Smith and Wesson over cartel violence. To break it all down, we have the new editor of one of the premier Supreme Court publications. Zach Shemtob of SCOTUSblog joins the show to give his perspective on what the Court decided and what it means for future cases. He said Justice Brett Kavanaugh's statement on the Court's decision to deny the AR case and his confident prediction it would take a different one up soon was less a signal that Justices John Roberts and Amy Coney Barrett agreed with him and more a message to them. Shemtob said Kavanaugh could be the fourth vote to take up a case at any time and may be trying to convince the two conservative holdouts to come around to his point of view, which clearly favors striking down such bans. He also said Justice Elana Kagan chooses her words carefully when writing opinions. So, including a line about the popularity of AR-15s in her Mexico opinion may signal a willingness to find they're protected arms. However, he ultimately argued the liberals on the Court are still unlikely to agree with their conservative colleagues on AR bans. Special Guest: Zach Shemtob.
