Although AB5 was signed into law in 2019, it resurfaced again when the U.S. Supreme Court declined to take the California Trucking Association's challenge to California's AB5 independent contractor status test. Which means AB5 still stands, even in transportation.     This is not ideal for drivers who want to be independent and for companies that like the service they receive from independent contractors.    However, this is not the end of independent contractor work as we know it. Our host, Nick Hancock, chats with Openforce General Counsel Doug Grawe to learn more about what AB5 is and what it means for transportation companies that utilize independent contractors in California and nationally. We've seen in the past few days the Infrastructure bill and Budget Reconciliation stuff go through the Senate. One of the things that's been a priority for Democrats has been the PRO Act. Protecting the Right to Organize. One of the things the act does is implement the ABC test that was the heart of California's AB5, and the ABC test would then determine classification of employee verses independent contractor for purposes of labor laws.  If it's passed and stands up to court challenges, PRO Act could force Doordash, Uber, Grubhub, Lyft and other gig companies to hire employees rather than employees. Steve Johnson of UberLyftDrivers.com joins us to talk about employment, being an independent contractor, the repercussions of being an employee, and whether Pro Act has a chance of passing. Also, when a broker doesn't pay, federal law requires them to carry a bond to cover carriers who have hauled a load. But in practice, it only comes through in a limited number of cases, and usually not for the full amount owed. And Hurricane Ida is already having an impact on the markets. California's new AB5 law is here, and it's already harmed the lives of countless west coast freelance writers, photographers, musicians, and more. And it could potentially harm California-based freelance game developers, too. Long story short, AB5 originally intended to provide greater worker protections for exploited workforces like those working for Uber, Lyft, and other contractor agencies. Instead, the bill was written so broadly that it now arbitrarily restricts the number of submissions we can make to a company per year. Imagine only being able to write or produce 35 pieces of work, including smaller examples like a news story, PER YEAR.
