In this breaking news episode of Freight Expectations, Craig Fuller (Founder & CEO of FreightWaves) and Matthew Leffler (The Armchair Attorney) react in real-time to the most pivotal legal moment in the trucking industry since deregulation. The Supreme Court has issued a unanimous ruling in Montgomery v. Caribe Transport II, LLC, effectively killing F4A preemption. Freight brokers are no longer shielded by federal law from state negligence lawsuits when they hire unsafe motor carriers. Craig and Matt break down exactly why this "extinction-level event" will fundamentally rewrite the rules of logistics, liability, and the supply chain. In this episode, we cover: The Death of F4A Preemption: What the unanimous SCOTUS ruling means and why it caught the entire legal and freight community off guard. The "Extinction Event": Why this ruling could wipe out 30% to 50% of all freight brokers operating today. The Insurance Nightmare: Why broker liability insurance premiums are predicted to skyrocket by 5x to 10x—if brokers can even secure coverage at all. The Winners and Losers: Why mega-carriers (like Knight-Swift and J.B. Hunt), trial attorneys, and compliance tech companies are positioned to win big, while load boards, small carriers, and small brokers face an existential threat. The Shipper Target: Why major shippers are the next logical target for plaintiff attorneys and why many are already dissolving their private fleets. The Path Forward: The urgent need for congressional intervention, tort reform, and for the FMCSA to step up its safety rating processes. Buckle up. The freight industry will never be the same. In this episode, Danny Ramon from Overhaul brings another insightful conversation about staying ahead of rapidly evolving strategic cargo theft and fraudulent double-brokering schemes in a global market! Danny shares how bad actors are moving from traditional smash-and-grab tactics to complex fictitious pickups and identity theft, essentially running their criminal enterprises with the efficiency of a direct-to-consumer business, the critical need for carrier verification, the impact of broker liability, and why simply having cargo insurance isn't enough when the true cost of a loss is three to seven times the value of the freight. From the lack of a DOT equivalent in the EU to the implementation of biometric security at the dock, we're covering the high-tech hurdles and the boots-on-the-ground prevention strategies you need to protect your margins! About Danny Ramon Danny Ramon has been working in Supply Chain Security for over 15 years and specializing in Supply Chain Intelligence for the last 13. Danny studies both cargo theft and any factor that can affect the flow of cargo through the supply chain to identify how variables might interfere with the flow of global logistics. In his role as Director of Intelligence and Response at Overhaul, Danny not only presents these findings to the security and logistics teams at the world's largest technology and pharmaceutical companies, but also leads the recovery and investigations team that works closely with law enforcement and private resources across the globe to recover stolen cargo and apprehend the criminals involved. Danny spreads awareness of cargo theft and promotes supply chain visibility as a subject matter expert. He is quoted or published in several leading industry publications, including Transport Topics, Supply Chain Brain, Fleet Owner, FreightWaves, and CCJDigital and he has presented for Inland Marine Underwriters Association (IMUA), the International Supply Chain Protection Organization (ISCPO), the Transportation and Logistics Council (TLC), Miami-Dade Police Department (MDPD), Ocean Carrier Equipment Management Association (OCEMA), National Motor Freight Traffic Association (NMFTA), and the Transported Asset Protection Association (TAPA). The freight industry has long been thought of the circulatory system of the economy. It's how the things bought & sold through commerce get from point A to point B in the real world. And when today's guest last appeared on this channel back in November, he warned that freight volumes had fallen dramatically due to tariff uncertainty and economic sluggishness. A recession in the economy of "real things" looked imminent.But...the situation now seems to be experiencing a sharp and welcome turnaround. Freight volumes are up. And US manufacturing is on course to enjoy one of the best markets in years. What's responsible for this happy development? How sustainable does it look to be? Could the ramifications of the war in Iran and the resulting oil price shock derail this recovery? To discuss, we're fortunate to welcome back to the program Craig Fuller of Freightwaves, a price reporting agency (PRA) focused on the global freight market and the leading provider of high-frequency data for the global supply chain.WANT PROFESSIONAL HELP? In this episode, we explore how a proposed city council bill in New York could disrupt Amazon's entire last-mile delivery network. The legislation effectively targets the use of subcontractors, which could force independent delivery service providers to shut down or convert their independent contractors into full employees. Next, we head out on the water, where CMA CGM and its Ocean Alliance partners have launched a new direct container service from Asia to the Port of Jacksonville. This strategic expansion provides shippers with a vital alternative to congested West Coast ports and enhances supply chain diversification for the Southeast. Finally, we unpack the high-stakes boardroom drama at the fleet payments giant WEX, which is currently facing a significant proxy battle from an institutional shareholder. The outcome of this struggle could trigger substantial changes in leadership and impact how operational expenses are handled across the broader trucking industry. The U.S. government took two big steps to fix problems with truck drivers who live outside the country. One is a new rule from the Federal Motor Carrier Safety Administration (FMCSA), Restoring Integrity to the Issuance of Non-Domiciled Commercial Drivers Licenses (CDL), which tightens rules on who can hold a commercial driver's license. The other, Delilah's Law, is a new Senate bill that proposes even stricter nationwide changes. The bill is named after Dalilah Coleman who was five years old in June 2024 when she was critically injured in a multi-car pileup in Adelanto, California. The crash was caused by an 18-wheel tractor-trailer driven by Partap Singh, an Indian national who had entered the U.S. illegally in 2022. Both moves come after deadly crashes and widespread state noncompliance, and they could reshape the pool of available drivers for fleets. The trucking industry is facing pressure from every direction .... the courtroom, the criminal underworld, and regulators. In this episode we break down a major U.S. Supreme Court case that could redefine broker liability and determine whether freight brokers can be sued for negligent carrier selection after crashes. If the Court expands liability, it could reshape how freight is matched, how carriers are vetted, and how insurance markets price risk across the industry. We also dive deep into the growing crisis of freight fraud and cargo theft, speaking with investigative journalist Phillip Brink, the new head of Fraud Media & Education at FreightWaves and CEO of The Bannon Report. Brink exposes how organized crime rings are infiltrating the freight marketplace and how scammers are impersonating legitimate carriers to steal high-value loads.Plus, Dale Prax of FreightValidate and Truckstop.com joins the show to discuss regulatory compliance issues including UCR enforcement, the implications of the Supreme Court case, and what carriers and brokers should be doing right now to protect themselves.Topics include:• The Supreme Court case that could change broker liability• Negligent carrier selection and the future of freight brokerage• How cargo theft rings are professionalizing their operations• The rise of freight fraud and identity theft in trucking• Compliance issues every carrier should understand• What the industry must do to restore trust in the freight marketplaceTrucking is changing fast and the consequences are reaching the highest court in the country. This is Brake Check, the industry wake-up call. Voice Of GO(r)D welcomes back to the show Mr Rob Carpenter, trucker, consultant, software developer, expert witness, and industry researcher and reporter, amongst so many other hats he wears.A question I am often asked by friends and followers is “How do these small companies employing people with no experience and no training in the trucking industry get insurance?” Rob has delved into that question, and has written a series of articles for his own Substack, The Tea , as well as on Twitter/X, and over at FreightWaves, and joins the show to tell us what is going on here. His work is so deep and detailed and explains so much of what is going on that he has had several meetings with FMCSA head Derek Barrs and Transportation Secretary Sean Duffy. The first of a seven part series by Rob looking into the insurance side of the equation can be read at FreightWaves, and they are all worth your time.https://www.freightwaves.com/news/the-dumping-ground-insuring-americas-most-dangerous-truckers-no-questions-askedRob's writings have been so revealing about the dysfunction in the insurance market that various entities have asked FreightWaves to take his articles down.Clearly he is over some targets.https://x.com/Thewhitesmoke/status/2025184999821971527Rob has also written extensively on the utter lack of accountability enforcement throughout all levels of regulation in the business, including the fact that those who have murdered others by truck are still out their in business on our highways.https://www.freightwaves.com/news/the-driver-involved-in-the-10-fatality-alabama-crash-is-back-in-business-and-still-crashingAnd for those of you into other types of Murder, or Murder Mysteries, if you will, Rob has written about FBI investigations into serial killers who happen to have CDLs.https://x.com/Thewhitesmoke/status/2013764452244455806I reference some of Rob's voluminous output in my book coming out on March 24, which I am told by my publisher has already sold over 1000 copies on pre-order.Secure your copy today! In The US, you can order it directly from my publisher, Creed and Culture -https://creedandculture.com/books/end-of-the-road-inside-the-war-on-truckers/In Canada, you can pre-order from Chapters/Indigohttps://www.indigo.ca/en-ca/end-of-the-road-inside-the-war-on-truckers/9781967613021.htmlAnd if you must order from Amazon, make sure you go back and leave a review for me there after you read it; that greatly helps with the algorithm.https://www.amazon.com/End-Road-Inside-War-Truckers/dp/1967613028/Thanks for listening, and please share with someone you know who might be a trucker or involved with the industry - word of mouth is the best advertising, especially for a one man show podcast project that generates zero dollars.Questions, comments, suggestions, corrections and Hate Mail are welcomed and strongly encouraged - gordilocks@protonmail.com

Is trucking entering a new era? In this episode of Brake Check on FreightWaves, we examine two forces shaping the future of freight workforce development and legal accountability. First, Lindsey Trent of the Next Generation in Trucking Association joins us to discuss the mission of the next generation in trucking. Are we finally fixing the pipeline? What are we getting right and where are we still missing the mark? Then we turn to the Supreme Court ruling in Montgomery v. Caribe Transport II, LLC with Shannon Everett of American Truckers United. We break down:• What the ruling actually means • Whether broker immunity is narrowing • Insurance and liability ripple effects • The impact on small carriers • Non-domiciled CDL concerns • Whether this strengthens accountability or destabilizes freight This episode connects the next generation entering trucking with the legal framework they're stepping into. In this episode of Brake Check, we're getting into what's really going on in freight right now — and yeah, things are finally getting interesting again. Charles Gracey sits down with JP Hampstead from FreightWaves to break down why the truckload market is suddenly way more volatile than what we've seen the past couple years. Winter storms, rising tender rejections, tightening capacity, spot rates heating up — we explain what all of that actually means without the fluff. If you've been wondering whether this market shift is real or just another fake-out, this conversation puts it into plain English. We also dig into earnings and outlooks from major carriers like Old Dominion, Heartland, and CFI, talk inventory levels, tariffs, and why some shippers are trying (and failing) to lock in last year's rates. The big question: is this finally a sustainable rebound, or are we setting up for another crash? Then we shift to the people side of trucking with Kevin Hall, CEO of CDLLife. We talk driver recruiting, why drivers are being way pickier right now, what a “quality driver” actually means, and why respect matters more than most job ads want to admit. If you recruit drivers, manage drivers, or are a driver, this part hits home. And to wrap it up, Malcolm Harris jumps in for some real talk on the current freight temperature, broker vs carrier perspectives, and why relationship-based freight might finally be making a comeback. Markets, money, drivers, relationships — it's all in here. Learn more about your ad choices. Visit megaphone.fm/adchoices

Recorded live at Trimble Insight 2025 in New Orleans, FreightWaves' Thomas Wasson sits down with Jonah McIntire, Chief Platform Officer at Trimble Transportation, for a wide-ranging and refreshingly candid conversation about AI, software, and the future of logistics work. Jonah breaks down how Trimble operates at the “plumbing layer” of the supply chain, why tools like PC*MILER are still the industry's ground truth, and why many past tech hype cycles—blockchain, visibility, buzzword AI—missed the mark. He doesn't shy away from the hard truth: AI will eliminate back-office jobs, even as it radically increases productivity and reshapes how logistics companies scale. The conversation dives deep into AI-written code, self-connecting systems, rewriting legacy software in days instead of months, and why Trimble is betting on AI colleagues—not just AI features. From creative destruction to AI agents interviewing for dispatcher roles, this episode offers a rare, inside look at how one of the largest supply-chain software companies is rebuilding for the next decade. In this episode of the Daily, FreightWaves investigates a startling report on national security, detailing Dragon in the Cab: How China Quietly Embedded Itself in American Trucking. We discuss the growing concerns regarding unvetted drivers hauling military freight and the specific vulnerabilities found within U.S. port infrastructure. In major corporate news, we cover the return of a legacy fleet to private domestic ownership as Former, current USA Truck execs acquire TL carrier from DSV. Conversely, we analyze a severe financial crisis in the last-mile sector, looking at the factors behind Last mile provider FAST Group's post-merger meltdown. The industry's financial volatility is further highlighted by the news that STG Logistics files Chapter 11, charts path forward. We also touch on regulatory and labor enforcement, including a whistleblower victory where a Texas carrier ordered to pay more than $100K to fired driver and a security-related contract cancellation where USPS insourcing forces Denver contractor to layoff 700 workers. Finally, we examine critical economic indicators showing a shift in supply chain strategies as Warehouses empty in December. This segment explores how historic lows in inventory levels may force shippers back into a reactive, just-in-time operating environment for the year ahead. In this episode of FreightWaves' The Daily, we map out the critical operational shifts defining the 2026 supply chain landscape, focusing on risk management over pure technology. We examine how generative AI and OEM partnerships are accelerating Waabi's push for point-to-point autonomous trucking to solve the commercial inefficiencies of the "highway trap." Regulatory risks are rising as a massive budget deficit in California threatens to disrupt federal, leading to significant compliance volatility for carriers. An internal audit highlights systemic weaknesses in the state's safety programs that could make roadside inspections and protocols increasingly unpredictable. On the macro front, a robust 4.3% GDP growth rate in Q3 signals a healthier economic foundation driven by strong consumer spending and exports rather than just import fluctuations. This economic shift is prompting industry leaders to stop designing for certainty and start building supply chains for adaptability to better handle market disruptions. We also discuss how this renewed focus on efficiency is setting the stage for a resurgence in large carrier M&A, including the anticipated spin-off of FedEx Freight. Finally, we analyze the urgent need to harden networks against sophisticated criminal rings that are exploiting commercial freight channels to smuggle narcotics and stolen vehicles across borders. In this episode of the Daily from FreightWaves, we dive into the escalating risks facing global logistics, starting with a $200K cargo theft that exposes growing fraud schemes in trucking industry and highlights the sophisticated digital deception threatening shippers. Impersonators posing as a global engineering firm used fake paperwork to steal merchandise from a small business, underscoring a reported 29% spike in cargo theft incidents. We also analyze the historic UP, NS: Merger will create 10,000 single-line service lanes, shift 105k truckloads to rail, a strategic move designed to reverse a decade-long decline in rail market share. This massive consolidation targets "watershed markets" and aims to reduce transit times by up to 70 hours on key routes by eliminating costly interchanges. In regulatory news, the New York City bill that targeted Amazon won't get taken up in 2025, avoiding a potential legal battle over interstate commerce despite having supermajority support in the City Council. Meanwhile, infrastructure concerns take center stage after over-sized cargo strikes six Oklahoma overpasses, forcing closures and prompting an emergency declaration for expensive repairs along the Will Rogers Turnpike. Legal scrutiny intensifies as a judge denies summary judgment in deaf driver applicant's rejection, allowing a discrimination suit against Wilson Logistics to proceed to trial. On the global front, the Federal Maritime Commission is escalating a dispute as the US weighs sanctions as Spanish port ban escalates over denied docking access for U.S.-flagged vessels bound for Israel. Finally, we discuss the critical distinction highlighted in The Difference Between a Truck Owner and a Business Owner in Trucking, emphasizing how intentional systems—not just hustle—are essential for survival. This episode challenges listeners to consider whether they are building a fragile operation dependent on personal effort or a durable business asset. Learn more about your ad choices.
