SEASON 2 EPISODE 86: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: The seven justices of the Supreme Court have given no indication HOW they will rule on Trump's disqualification under the 14th Amendment and they have given no indication WHEN they will rule but here's a bigger issue: They have no RIGHT to rule. The 14th Amendment clearly, unquestionably, inarguably, and ETERNALLY states that an insurrectionist can't serve in an elected federal or state office, or a lot of other offices, and it doesn't allow anybody to overrule the Constitution because the 14th Amendment already HAS a means for disqualified traitors to appeal – the drafters OF the 14thAmendment BUILT THAT REMEDY IN - and they have already designated two bodies to overrule disqualification under special circumstances, and those bodies are the United States House of Representatives and the United States Senate and if they each vote by two-thirds to let Trump back on the ballot, he's back on the ballot. That is, for all practical purposes, IN the Constitution! And if they DON'T, he's not. That is also, for all practical purposes, in the Constitution! And we KNOW this because it was written, principally, by Congressman John Bingham, a Radical Republican who not only was one of the House Managers for the IMPEACHMENT of President Johnson, but earlier Bingham had been the Assistant Judge Advocate General during the trial of the accomplices of the man who murdered Lincoln, John Wilkes Booth. And if John Bingham's attitude towards insurrectionists wasn't clear enough from the 14thAmendment and the completely justified slow roasting of President Andrew Johnson – just a reminder: the eight co-conspirators charged in the Lincoln Assassination that the co-author of the 14th Amendment PROSECUTED included Mrs. Mary Surratt who ran the boarding house where the conspirators met, and the stagehand at Ford's Theater who did nothing more than hold Booth's horse while he went in and murdered the president. They HANGED half of the defendants – including the woman who ran the boarding house. Three of the other four were given life sentences. The guy who held the horse got six years at hard labor. They DID make a concession to Mrs. Surratt. While they were preparing to hang her and the others they let her sit in a chair. The authors of the 14th Amendment weren't EFFING AROUND. Jayden and Mikyla Battey, a married couple in their 20s, did their own soul-searching and, as a result, decided to move into community housing with 28 men who are at risk of homelessness and face mental health issues and challenging life circumstances. They were looking for a deeper way of living alongside others. They've found that as House Managers at Hamer Court, an affordable housing initiative run by the group Servants. As widely anticipated, the second impeachment trial of former President Donald Trump ended in an #acquittal. 57 Senators in total — 48 Democrats, two Independents, and seven Republicans found Trump guilty, while 43 Republican senators found him not guilty of inciting the January 6th insurrection. While this was the most bipartisan vote in any US President's impeachment trial, 10 additional guilty votes were needed for a conviction. A poll released this week showed that 58 percent of Americans believe Trump should have been convicted. Trump's acquittal has further factionalized the Republican Party, as the seven Republican senators who crossed party lines to convict, face censure and rebuke from their State GOP leaderships. Meanwhile, the Democrats and House Managers who argued the case to convict Trump but failed to secure what would have been a first in US history, have come under sharp criticism for their decision to forgo witness testimony after a majority of senators voted to grant that last minute request. Many argue that the live testimony of a Republican congresswoman, Representative Herrera Beutler, who was willing to testify about a desperate call for help made by Republican House leader Kevin McCarthy to President Trump while the Capitol being overtaken by insurrectionists, would have been damning and could have made it more difficult for some Republican senators to acquit. The Kansas City Chiefs are Super Bowl champs for the first time in 50 years! Congratulations are certainly in order and to the people of their home state. Problem is, Donald Trump apparently doesn't know where that is. Never at a loss for words for “important issues” Trump tweeted his congratulations to the team and “the Great State of Kansas”. Whoolps! The Chiefs are based in Kansas City, Missouri, not Kansas City, Kansas. While this faux pas would be acceptable from many others, much like those who mistakenly identify New York City as the capital of New York, rather than Albany, where I grew up, it is troubling coming from the supposed leader of the country. It would appear that geography isn't exactly a strength for this “stable genius”. Perhaps he'd do better pointing out Ukraine on a blank map. Probably not. With the impeachment trial and State of the Union probably weighing heavily on his mind, Trump might be forgiven for this slip of the tongue if he didn't so readily pounce on so many others who have made verbal gaffes, like his perceived chief rival, former Vice President Joe Biden. Maybe Trump was confused by the similarities between the characters of The Wizard of Oz in not knowing that the Chiefs are from Kansas City, Missouri? After all, one could argue that his mistake resulted from his resemblance to the Scarecrow (no brain), Secretary of State Mike Pompeo's resemblance to the Tin Man (no heart), or even the Cowardly Lion (President Bone Spurs) as they lead Dorothy (Ivanka) and her little dog (Jared Kushner) through the treacherous land of impeachment haunted by the Wicked Witch (Nancy Pelosi D-CA) and her “flying monkeys” (House Managers). It's a stretch, but the similarities are there, and Dorothy WAS from Kansas, after all. Of course, Trump was tweeting from the friendly confines of his Mar a Lago where he hosted a multitude-million dollar Super Bowl party for club members, at taxpayer expense. Remember how he repeatedly pledged that, if elected, he would have no time for golf? Right. Perhaps if we collectively click our heels and utter in unison “We want a real leader”, the country will magically return to sanity. Let's hope it happens on November 3rd. After visiting the prison, Reeves says maintenance teams are working to improve conditions. All wardens have been placed on 12 hour shifts and they're cracking down on contraband cell phones. The governor says the Mississippi Bureau of Investigation agent on site at the prison is screening guards for gang affiliations. He is also considering relocating some inmates to Walnut Grove a facility that was closed in 2016 but is in better shape. Sharon Brown is with the Mississippi Prison Reform Coalition. The impeachment process for a sitting president can be a daunting task. Just ask Arkansas Governor Asa Hutchinson, formerly a Congressman from Arkansas who served on the House Judiciary Committee during impeachment proceedings against Clinton. Hutchinson, who was one of 13 "prosecutors" – referred to as House Managers- during Clinton's impeachment trial in the Senate, sits down for an interview with "The Investigation" co-hosts Chris Vlasto and John Santucci. "It [was] an unwise call," Hutchinson said, referring to that July 25th phone call between President Trump and Ukrainian president Zelenskiy, adding "but that doesn't mean that a president ought to be impeached." As the House gears up for two days of the first public testimony surrounding the impeachment inquiry, Hutchinson reminds: "you cannot impeach a sitting president without the support of the American public...you're not going to gain the confidence of the American public without having public testimony."
