Lindsay Clancy's lawyer just stood in a Plymouth courtroom and asked the judge where the evidence is that she killed her three children. Cora was 5. Dawson was 3. Callan was 8 months. In January 2023 their father, Patrick Clancy, came home from errands and found them on the basement floor with exercise bands around their necks. Lindsay Clancy was in the yard after jumping from a second-floor window. She was charged with three counts of first-degree murder. At trial the defense was not criminally responsible — postpartum psychosis, a voice telling her to kill the children and herself — because the judge would not split guilt from insanity. Kevin Reddington said it himself: they had to admit culpability to raise criminal responsibility. A six-week trial ended September 4 in a mistrial after the jury hung. On September 29 he flipped. “Where is the evidence that she did this?” No real investigation, he said. Speculation. She was told what happened. She had no memory. Prosecutor Shanan Buckingham called that laughable and reminded the court that at trial the defense objected on the grounds that she admits she did this. Judge William Sullivan was not ready to rule. Both sides said it was too soon to set a second trial. Next date is November 2. Reddington says his caseload means he cannot try it before June 2027. Three kids. A hung jury. A new theory. When will people be held accountable for what we had to endure during the Biden regime? Republicans are letting this opportunity slip through their fingers. AOC stood in front of a packed New York hall and told the room ICE is Palantir, ICE is AI, ICE is facial recognition, ICE is surveillance, and ICE is coming after you regardless of your status. This was not a gaffe. At a Students vs. Billionaires town hall in Ithaca, in front of more than 1,000 people, Alexandria Ocasio-Cortez called for abolishing ICE and framed the agency as a post-9/11 surveillance-state shop tied to private contractors, not ordinary law enforcement. She named Palantir. She brought up facial recognition. She said ICE is going after every man, woman, and child because detention company CEOs have profits to post at the end of the quarter. Then she aimed it at the crowd: coming after you, status or not. That is the Democrats' save-immigration push heading into the midterms. Not a fight about the border. A scare pitch that turns immigration enforcement into a dragnet aimed at citizens, so that the people who actually entered illegally drop out of the story. "Regardless of your status" is the tell. If the agency is coming after everyone, then enforcing the law stops being law enforcement and starts sounding like a conspiracy. Right now, the prediction markets have James Talarico at about 60–40, and the polling shows either a tied race or one where he's slightly ahead of Ken Paxton. But I live in the most liberal enclave of Texas, and this doesn't feel like Beto mania. You see Talarico signs around Austin, but you don't see the same cultural energy. Maybe that's by design. Talarico is trying to appeal more to the middle, and Beto lost in a favorable environment during Trump's first midterm.The biggest wind at Talarico's back is the environment. Trump is historically unpopular, gas prices are high, inflation is persistent, and people are paying more to get the same or less. That's a recipe for killing presidential and party momentum. It would help Republicans if they had a dynamic candidate, but Paxton is a big fat bullfrog who mostly sits on a log and puffs his neck. Mr. Saturday Night he isn't, and his lack of charisma may be the least of his problems. He's rife with scandal, including a divorce from his very loyal wife on biblical grounds.Politics Politics Politics is a reader-supported publication. Talarico is weak because of who he is: a slight guy from the most progressive place in a state that isn't progressive, with years of statements from the legislature that can and will be used against him. He took progressive positions during a progressive age that are no longer fashionable. That would normally be enough to sink a candidate, but it hasn't because I think he's running a good campaign. The upside comparison is Brock Purdy — undersized, underqualified, carrying baggage from his past, but succeeding when he finally gets his shot.Talarico's campaign still seems unsure how to sell him. One ad puts him in a rocking chair on a front porch somewhere outside Austin, trying to reassure religious voters that he's just like everyday Texans. But the chair's back towers over his head, making an already slight candidate look even smaller. Paxton's campaign, meanwhile, stinks on ice. Until MAGA Inc. and the Senate Leadership Fund arrived, he barely had a pitch. He doesn't talk to the camera, doesn't appear in his own ads, and hasn't offered a basic argument about what he accomplished as attorney general. The outside groups are now doing that work for him.The coalition problem cuts both ways. Talarico needs the Democratic city centers, Black voters around Houston, and Hispanics along the border who moved toward Trump in 2024. But Jasmine Crockett still hasn't bridged the gap between Talarico and Black voters after losing the primary. She released an endorsement list without his name on it. Paxton needs the suburbs, rural Texas, and as many Trump-voting Hispanics as possible, but John Cornyn seems perfectly happy to watch him crash and burn after losing the Republican primary. Cornyn and Crockett should form the Sore Losers Guild.So, does Talarico have a shot? Yes, but everything has to go right. He got the opponent, environment, and campaigns he wanted, but it's like needing a coin to land tails 10 times — getting nine doesn't matter if the last flip is heads. Texas remains highly polarized, voters still dislike the Democratic Party, the Republican advantage may improve if gas prices fall, and Democrats are being badly outspent. James Talarico just posted a slick little video: He "dialed" Ken Paxton's cell and invited him to a Fox News debate. Paxton didn't pick up. The clip took off. Fair enough — it's good campaign theater. It does not reset the record on how Talarico talks about Christianity and Christian Texas. He's a Presbyterian seminarian running for U.S. Senate, and for years, he has drawn a hard line between his faith and the faith of the people who actually fill Texas pews. He has called Christian nationalism heretical, unbiblical, a cancer, and a betrayal of Jesus. He has described himself as a Christian who hates Christianity. On the Texas House floor in 2021 he told colleagues “God is nonbinary” while fighting a girls' sports bill. He has used Gabriel's and Mary's “consent” as a theological case for abortion. He has said God is not a Christian. Pat also covered: Tucker just called on Trump's own Cabinet to 25th-Amendment him over Iran — not impeach him. Remove him. On today's KITM, David Waldman and Greg Dworkin count down the days until the midterm elections and determine that there are altogether too many of them. Are Democrats going to win the midterms? Who knows! If you were to poll polls, they would tell you that they like "Democrats", and that they really do not like "Republicans". That, and several bucks, will buy you a cup of coffee. We do seem to have a blue wave and a red undertow in those polls. The primaries portend well. Early voting is happening a lot. All that probably means many things, much of which will become clearer in retrospect. In New Jersey's 7th congressional district, home of Kean University and future former home of Tim Kean, Kean's incumbency and red district don't look like they'll save him. Maine voters might end up term limiting Susan Collins to five terms. In Texas, John Cornyn isn't going to even bother with Ken Paxton. Ohio has been falling into a red sinkhole for decades, but the data centers issue might actually lift it out. Even lifelong Republican John Fetterman says it's entirely possible that Democrats take back the Senate. As usual, most of the credit has got to go to Donald K. Trump, the least wily of all super-geniuses in world history. Victory in Venezuela, and that dotard still can't keep from spoiling all of his spoils. AI might not be as smart as Trump, but it can FUBAR a million times faster. Meanwhile, Stephen Miller is living the life he deserves, hiding in fear. Miller might not be in danger every moment of every day, but as long as he feels that way, it's okay.
