Ugens gæst hos Rune Lykkeberg er intet mindre end en amerikansk legende inden for organisering, kampagner og bevægelsesbygning. Marshall Ganz er født i 1943 i USA og blev tidligt engageret i den amerikanske borgerrettighedsbevægelse. I 1964 drog han til Mississippi for at hjælpe de sorte med at registrere til valget samme år og kom her til en by stærkt skæmmet af, at tre sorte mænd netop var forsvundet. Det var dén historie, som senere blev fortalt i filmen Mississippi Burning. Marshall Ganz blev siden engageret i Bobby Kennedys præsidentkampagne, som endte brat, da han i 1968 undergik samme skæbne som sin bror, John F. Kennedy, og blev skudt og dræbt. Marshall Ganz fandt herefter sammen med den legendariske mexikanske fagforeningsleder, Cesar Chavez, og blev de næste 16 år en del af hans bevægelse, United Farm Workers. Her lærte han teknikker og praksisser til, hvordan man forvandler folkeligt engagement til magtfulde bevægelser og går fra mobilisering til institutionalisering. Siden var Marshall Ganz stærkt involveret i Barack Obamas præsidentkampagne (2007-2008) og opbyggede hele den græsrodsbevægelse, som var med til at bære USA's første afroamerikanske præsident frem til Det Hvide Hus. Frazer Rice (00:05)This is, I wouldn't say it's fun talking about someone's estate, but this one's particularly interesting. We all remember Gene Hackman from Hoosiers and Superman and Mississippi Burning and all sorts of great movies. Unfortunately, his end was sad and as it turns out, Gene Hackman's Estate was complicated and public. From a planning perspective, we can learn a lot. ⁓ Take us through a little bit about where where Gene's estate kind of went from and ended up as far as a fact pattern. Fact Pattern in Gene Hackman's Estate Planning Lawrence D. Mandelker (00:37)Sure. So, you know, the news sort of surprised all of us when we heard that he had died. And then over the next couple of days and weeks and even months, more more detail came out. And as you said, it was pretty disturbing. But it seems as though Gene Hackman was a very successful ⁓ actor and he engaged in estate planning. Gene worked with attorneys, which is always a good thing to do it to work with people who are experts in the field And he had a you know a normal estate plan. He lived with his wife It seems like he had a little bit of a fractured family. It was not his first marriage. We learned after he signed his estate planning documents sort of things over the next 20 years sort of changed for him he He had some health issues. He was suffering from advanced dementia at the time he died and as we know his wife died from a virus apparently a week before. Then as the details came out we learned that he had the advanced dementia. There was a fractured family the the wife and his kids did not get along so well. It's unclear what the situation was with how much contact he did have with his children. But he had a will, he had signed it 20 years before he died. The facts changed. It looks like he hadn't reviewed it in a while. His attorney died so we have a sad situation here. Frazer Rice (02:12)Many lessons to get from that. Let's start with the first one. He definitely had ⁓ sort of dementia situations, cognitive dysfunction that eroded over the course of time. Maybe take us through a little bit about the scope of that issue. mean, it affects lots of people and a growing number every year and some things that should be in place because of that. Lawrence D. Mandelker (02:38)Yeah, you know, we all think we've got a lot of time and for someone who gets a diagnosis of dementia It's sort of a warning sign as soon as that happens that, you know, we never know when our time is going to come, but the dementia is sort of the warning. You know, maybe you're entering the second half of the game or the fourth quarter of the game. So maybe you should start getting your affairs in order while you still can. So it's a good ⁓ impetus to do that. You know, when we're looking at estate planning, there's, you you can do different types of estate planning, but really think about it as, you know, you can do it for yourself. You can do it- your loved ones and then you know for depending on the nature of your assets you can do it for tax purposes but you know getting ...

Gene Hackman may have retired from acting 20 years before his unfortunate passing earlier this year, but in his five decades of filmmaking, he created a filmography that's impossible to match. We get into some of his heavy hitters, like HOOSIERS, MISSISSIPPI BURNING, UNCOMMON VALOR, and UNFORGIVEN. This week, Gene HackMarch continues with an outstanding acting showdown between two of the all-time greats of American screen acting, as our man Gene stands tete-a-tete with Denzel down in the briny deep with the fate of the world hanging in the balance. It's 1995's Crimson Tide, directed by Tony Scott, featuring script punch-up from Quentin Tarantino, and starring Denzel Washington, Gene Hackman, Viggo Mortensen, James Gandolfini, George Dzundza, Matt Craven, Danny Nucci, Steve Zahn and Daniel von Bargen. A naval submarine thriller of the highest order, it's the first of five collaborations between Tony Scott and Denzel Washington, and while it's easily the high water mark of the bunch it's also plain to see why they would be eager to re-team time and time again to try to recapture this magic. The acting showdown at the heart of this movie's conflict is its greatest spectacle, and while the movie got shut out at the Oscars come awards season, it was nominated for Best Film Editing, Best Sound Mixing and Best Sound Editing, losing all three. In 1989 and 2004 something unusual happened in the town of Philadelphia in Neshoba County, Mississippi.  After decades of silence whites finally joined their black neighbors in commemorating the 1964 murders of three young civil rights workers.  What was different about 2004, however, was that the commemoration was just the beginning. The organizers forged an identity, as the Philadelphia Coalition, and went on to achieve several transformative goals.  They helped bring justice to the Klan leader responsible for the murders, they helped make civil rights education mandatory across the state, and they helped establish a South African-style Truth and Reconciliation Commission to look at racially motivated crimes in the state's past.  How commemorations can become something larger, something transformative, is the focus of Furman University sociologist Claire Whitlinger's book, Between Remembrance and Repair: Commemorating Racial Violence in Philadelphia, Mississippi.

MISSISSIPPI BURNING is the name of a motion picture, released in 1988, starring Gene Hackman and Willem DaFoe, loosely based on the murders of 3 Civil Rights workers in Mississippi, during the “Freedom Summer” of 1964.  James Chaney, Andrew Goodman and Michael Schwerner were lured to Philadelphia, Mississippi, and executed by the Ku Klux Klan. No one was ever convicted of their murders, until over 40 years later when Jerry Mitchell, an investigative reporter with The Charion-Ledger, in Jackson, Mississippi, convinced authorities to reopen more than one cold murder case from the Civil Rights Era, prompting one colleague to call him "the South's "Simon Wiesenthal."  In 2009, he received a "genius grant" from the MacArthur Foundation. Author John Grisham wrote of Mr. Mitchell: “For almost two decades, investigative journalist Jerry Mitchell doggedly pursued the Klansmen responsible for some of the most notorious murders of the civil rights movement. His book, “Race Against Time,” is his amazing story. Thanks to him, and to courageous prosecutors, witnesses, and FBI agents, justice finally prevailed.” It is my honor to welcome Jerry Mitchell to Murder Most Foul today.

The case became one of the highest profile murder investigations of the 1960's and helped turn public support in favor of civil rights and was instrumental in the passage of the Civil Rights act of 1964 and the 1965 Voter Rights Act. In June 1964, at the height of the civil-rights movement, the Ku Klux Klan burned a Black Methodist church to the ground in the town of Philadelphia, Mississippi, and murdered three civil-rights workers in cold blood. This crime became one of the most notorious of its era, shocking the nation on the eve of the passage of the Civil Rights Act and later inspiring a Hollywood blockbuster: Mississippi Burning. But when the reporter Ko Bragg started questioning how this history is being preserved in Philadelphia, she was confronted with a town that would much rather forget its violent past. Bragg finds a few Black residents taking it upon themselves to keep the story of this crime alive, and she asks where the burden of safeguarding history should lie.  A transcript of this episode will soon be made available.
