Specialiștii și antreprenorii sunt revoltați de introducerea e-TVA. Consultanții fiscali arată că noul sistem nu ajută nici bugetul de stat, nici companiile. Dimpotrivă, chiar. Rar se întâmplă ca atât de mulți specialiști și antreprenori să fie revoltați de introducerea unor prevederi noi fiscale. Este vorba despre așa-numitul decont de TVA sau e-TVA. Lăsăm la o parte nemulțumirile legate de lipsa de transparență și dialog. Deja, a devenit o obișnuință nocivă ca reprezentanții guvernului să nu dialogheze cu cei ai mediului de afaceri pe actele normative care se pregătesc. Nu luăm în calcul nici aplicarea noilor prevederi foarte repede, respectiv, într-o lună de zile.Marea problemă a e-TVA este aceea că specialiștii și antreprenorii demonstrează cu argumente că de fapt mecanismul gândit de Ministerul Finanțelor este inutil, ineficient și de-a dreptul inept. Despre ce este vorba? Noua reglementare prevede ca ANAF să transmită tuturor firmelor în data de 20 ale lunii un decont precompletat cu TVA colectată din vânzări, TVA deductibil datorită achizițiilor și, deci, diferența care rezultă pentru TVA de plată. Toate aceste date sunt adunate și completate de fisc în decontul preliminar de TVA.Contribuabilul are obligația să verifice în cinci zile, până pe 25 ale lunii, datele transmise de fisc și dacă sunt diferențe mai mari cu 20% între datele fiscului și cele ale contribuabilului, acesta din urmă are obligația de a informa ANAF de unde provine diferența.Ce mare lucru ar putea spune, unii. Este mare lucru, pentru cel puțin două motive. Primul motiv este acela că e-TVA este inaplicabil pentru multe firme. Consultanții fiscali demonstrează clar acest lucru. De exemplu, în ultimele luni, fiscul a transmis notificări prealabile către unele companii. Un consultant fiscal ne-a declarat că în cazul a 99% din aceste notificări datele ANAF nu erau la fel cu cele ale companiei. În cazul e-TVA procentajul diferențelor va fi mai mic decât 99%, dar este limpede că ele vor exista pe scară largă.O demonstrează consultantul fiscal Adrian Bența, într-o analiză publicată pe hotnews.ro. Specialistul în fiscalitate arată că diferențele dintre datele fiscului și cele ale companiei sunt inevitabile, pentru că noua legislație nu ține cont de faptul că efectiv ANAF nu are la dispoziție toate informațiile.Fără a intra în amănunte tehnice, Adrian Bența demonstrează că fiscul nu are informații privind TVA la încasare, ANAF nu știe dacă TVA pentru folosirea autoturismului firmei se plătește integral sau se deduce parțial, fiscul nu știe vânzările pe care o firmă le face către persoane fizice cu plata ulterioară prin bancă, nu se cunosc ajustările de TVA și fiscul nu are o soluție pentru situațiile în care sunt emise două documente fiscale pentru aceeași tranzacție.Sunt, așadar, multe cazuri despre care, deocamdată, fiscul nu are date. Poate anul viitor va avea, dar acum aceste informații nu ajung în bazele de date ale ANAF. În aceste condiții, diferențele între ceea ce vede fiscul în baza sa date și ceea ce are efectiv compania în contabilitate pot fi destul de mari. Prin e-TVA, statul îi pune pe contribuabili și pe profesioniștii în fiscalitate să muncească de două ori pentru aceeași raportare lunară.De fapt, e-TVA ne arată că în pofida tuturor e-urilor introduse prin procesul de digitalizare (e-factura, SAF-T, e-transport, e-sigiliu) informațiile primite de fisc nu se pot corela între ele sau sunt insuficiente. Drept urmare, ANAF s-a gândit că trebuie să îi pună la muncă pe cei din sectorul privat. Doar că pentru companii metodologia e-TVA presupune creșterea costurilor, respectiv angajarea de noi salariați sau plata mai consistentă a celor existenți. Cheltuieli care, în ultimă instanță, se vor transfera către clienții companiei.Al doilea motiv este că, practic, e-TVA nu folosește la nimic, nici nu reduce evaziunea, nici gap-ul de TVA (diferența dintre ce ar trebui să încaseze statul și cât colectează efectiv). Deci, decontul de TVA nu atinge niciunul din obiectivele pentru care teoretic a fost introdus în legislație. Have you ever said something like, "She just brings out the worst in me!"? It really is true certain people and certain circumstances seem to bring out the worst in us. Did you ever think that there might be a reason for that? In Psalm 19:12, David wrote: Who can discern his errors? Forgive my hidden faults. Then he goes on to pray in verse 13: Keep your servant also from willful sins... We see David was dealing with two types of sin and error in his life: Ones hidden to him that he could not even see, and ones that were willful. Of course, David's not the only one who has these two areas of sin in his life; we all do. We all understand the need to deal with the errors that are blatant; the ones we know about. But what about those hidden errors? Many times, these are things in our lives which never are changed because we just don't see them. "Who can discern his errors?" David asks. In other words, it's not easy to see them for yourself. So, what does God do for us? He sends people into our lives that bring out the worst in us. Here's a person in your life that causes you to be angry every time that person is in your presence. It seems like you say something hateful or unkind to him or her all the time. The truth is no one is in your life by accident, and those people who bring out the worst in you are there to show you those hidden errors, so you are no longer blind to them. Think about it: Who are the people that bring out the worst in you? Or perhaps it's a certain type of person that brings out the worst in you. Can you identify some of those people or types? Inept and dense people bring out the worst in me. I tend to have very judgmental attitudes toward them. When I analyze that, I realize it's the sin of pride, thinking I'm better than someone else. Wow, those hidden errors! Underneath them we'll discover all kinds of wrong attitudes that need to be changed. One of my regular prayers is to ask God to show me my hidden errors. It's a good prayer, so I encourage you to pray the same. And then every time you're around someone who brings out the worst in you, stop and realize God is answering your prayer and showing you your hidden errors, so that you can become more Christ-like.
