Office of Management and Budget director Russell Vought on Saturday halted new funding to the Consumer Financial Protection Bureau and temporarily shut down its headquarters. It's the latest effort by Vought, a Project 2025 architect, to tear down the so-called “deep state” of bureaucrats who could object to Trump's policies. Vought is also fixed on expanding the powers of the executive branch in relation to the legislative branch, supporting a presidential power to claw back funds already allocated by Congress. Big Oil “has been screwing you for decades,” Newsom said. “Price spikes have cost Californians billions of dollars over the years, and we're not waiting around for the industry to do the right thing,” Newsom said. “We're taking action to prevent these price spikes and save consumers money at the pump,” he said. The bill passed the California Assembly last week with a 41-16 vote. Many Democrats did not vote and four voted against the radical measure. The measure will force local refineries to stockpile fuel and if they don't follow the new regulations they can be fined up to $1 million PER DAY. The heavy fines will inevitably be passed down to the consumer and cause gas prices to spike. Refineries announced they are leaving California because of Newsom's new bill. Phillips 66 refinery announced they are ceasing operations in Los Angeles because of Newsom's bill. David Waldman and Greg Dworkin present their post post debate analysis and yes, they will be endorsing Kamala Harris for president! They aren't the only ones.  Liz Cheney, and her father — DICK! are favoring Harris, along with former AG and White House Counsel, Alberto Gonzales — DICK! On the other hand, Kamala has support from Taylor Swift and Linda Ronstadt (No word yet on the coveted Rex Smith vote) There's also a Ben & Jerry's ice cream flavor. Yep, looks like Kamala might have this popular vote thing locked up. Meanwhile, Haitians stealing ducks is the new Blacks stealing chickens, a trope that hasn't really evolved much over the last couple of hundred years, has it? And why should it? Plenty of potential voters yearn for that good old-fashioned anti-American bigoted conspiratorial propaganda. It isn't that Donald Trump no longer knows how to talk to anyone outside his base… it is that he doesn't need to. Trump wasn't joking, he just wants to find those 11,780 votes. Why waste his time and hundreds of millions of dollars trying to influence tens of millions of TikTok zombies, when only a few million bucks of rural doorknockers can move a few thousand nonvoters into an electoral victory? Stephen Miller makes a lot more sense now (relatively speaking), as well as Laura Loomer, who rightfully horrifies Marjorie Taylor Greene as Marge is guaranteed to be the first up against the wall once the new regime commences. And yet we few remaining TV watchers pray that the fact-checkers and undecided voter panels get the job done... C'mon Swifties!

John Knepper thought he would pursue a career in theater after graduating and performing at the Harvard Radcliffe summer theater. However, after  moving to Memphis, Tennessee, he took a left turn and started working in the marketing department of the nation's fifth largest security guard company. After nine months there, John quit his job and traveled around the country for six months. Working in Washington on Immigration Laws On the last leg of his travels, he was in Washington where, by chance, he met the assistant to the Chief of Staff for Senator Al Simpson of Wyoming. Six months later they called him for an interview and subsequently he started working on Capitol Hill. He talks about his work as a personal assistant for a senator before moving on to work for the Senate Judiciary Committee.  In 1995 and 1996, he worked on the 1996 immigration law, which was the last major piece of immigration legislation passed by Congress. John also worked for Senator Fred Thompson of Tennessee on the Governmental Affairs Committee and Homeland Security Committee for two years, where he worked on investigations into foreign influence in the 1996 Presidential election. John worked on campaign fundraising and regulatory reform, becoming one of the most knowledgeable staffers for the Senate Judiciary Committee without a law degree. From Washington to Law School In 1998, he decided to change careers and went to law school. He attended the University of Michigan School of Law, which was considered the best law school at the time. Upon graduating from law school in 2001, he worked for a federal judge for a year and later held a position with the US Department of Justice in the Federal Programs Branch. He was part of the team that defended the McCain Feingold campaign finance law, and John talks about  how the law faced constitutional challenges and the mistrust among the Republican and Democratic National Committees. John discusses his role in document review at the Republican and Democratic National Committees, and his decision to build an effective record of campaign finance regulations. He also talks about working on national security issues for President Bush, such as the freezing of assets of the Iraqi government and the question of how to give Iraq billions of dollars back to the government. Working as the Associate General Counsel of the OMB John was called to work as the Associate General Counsel of the Office of Management and Budget (OMB) in 2004. OMB is an agency within the White House responsible for ensuring that federal government actions are consistent with the President's priorities. Originating under President Franklin Delano Roosevelt, OMB is responsible for reviewing all testimony, legislation, and major regulations issued by the executive branch to Congress.  He talks about working under President Bush and eventually becoming the deputy general counsel of the Office of Management and Budget. The office was responsible for supporting the President's views and clearing executive orders. The general counsel's office was also responsible for reaching out to other federal agencies to discuss concerns and ensure they understood the consequences of their actions. Fannie Mae,  Freddie Mac, and Financial Bailouts In summer 2008, a friend of John's, who had been in the White House Counsel's office, called him to discuss the economic concerns with Fannie Mae and Freddie Mac. John moved over to become the Deputy General Counsel of the Treasury. The conversation turns to the bailout of Fannie Mae and Freddie Mac, the potential bankruptcy of AIG, and the impact of money market funds on the economy. He talks about the Troubled Asset Relief Program (TARP) which was developed to provide an asset against which companies could borrow from the Federal Reserve. This allowed the government to keep the velocity of money in the system, and AIG was a prime example of how the US government managed to keep these businesses operating. He also discusses an unsung moment during the financial bailout and the collaboration between Merrill Lynch and Wachtell Lipton, Rosen and Katz, and one reason for the bailout. From Washington to Wyoming In 2009, John was unemployed due to elections having consequences. He moved to Wyoming, where the economy was buffered by long-term commodities contracts, and he started working for the city of Cheyenne Wyoming as an attorney, working on $50 million government programs. John talks about Wyoming's unique tax system, with no state income tax, so revenue is largely mineral taxation. He worked with people in Wyoming suing companies over tax burdens. John worked there for two years before falling into another position as the Attorney General of Wyoming. He was appointed as the Chief Deputy Attorney General of Wyoming, and for five years, from 2013 to 2019, he was the number two lawyer for the state where he worked on environmental, law enforcement, and gun rights issues. Establishing a Solo Practice  From March 2019 onwards, John moved on to solo private practice in Wyoming. He chose this path because he wanted to take on more controversial litigation and avoid moving their family to a different location. He discusses his experience as a political appointee of George W. Bush and involvement in pro life cases, including pre and post Dobbs litigation on pro life issues. John has also been involved in controversial cases, such as defending coverage of gender transition services and determining equal protection. Large law firms often avoid this area due to financial constraints. His practice is paid law, with clients ranging from wills for small to large corporations, and he works on multi-district litigation. Influential Professors and Courses at Harvard John mentions a class on the Holocaust and genocide by Professor Eric Goldhagen, which he found to be incredibly profound. This course changed his interest in understanding the reasons behind people's resistance to horrible decisions, such as murder and atrocities. He also took courses on resistance to authority from social psychologist Herb Kelman and his senior thesis on the concept of the witch at the Salem witch trials. He mentions Professor Orlando Patterson of the Sociology department at Harvard had a class on freedom, focusing on the origins of the western and American concepts of freedom and liberty. This Day in Legal History: Former President Taft Becomes Chief JusticeOn July 11, 1921, William Howard Taft was sworn in as Chief Justice of the United States Supreme Court, making history as the only person to have held both the presidency and the chief justiceship. Taft had previously served as the 27th President of the United States from 1909 to 1913. His appointment to the Supreme Court was a lifelong dream come true, as he had always preferred judicial work over executive duties.During his tenure as Chief Justice, Taft made significant contributions to the federal judiciary. He advocated for judicial reforms and was instrumental in the creation of the Judicial Conference of the United States, which helped improve the administration of the courts. His leadership was marked by efforts to enhance the efficiency and integrity of the judicial system.Taft's unique perspective as a former president provided him with a comprehensive understanding of the interplay between the branches of government. This experience enriched his contributions to the Court's decisions and its operations. His tenure as Chief Justice lasted until his retirement in 1930, leaving a lasting impact on the American legal system.A recent U.S. Supreme Court decision has impacted two significant Illinois public-corruption cases involving former state House Speaker Mike Madigan. The ruling in Snyder v. United States clarified that federal law criminalizes bribery when officials accept bribes before performing official acts, but not when they accept gratuities after the fact. Following this decision, defense lawyers in the cases involving Madigan and his associates are seeking acquittals or new trials.Judge John Robert Blakey of the Northern District of Illinois requested updates from the lawyers involved. Meanwhile, attorneys in U.S. v. McClain indicated they would file motions to acquit or seek new trials for four defendants convicted of conspiring to solicit favors for Madigan. Michael McClain's lawyer argued the Supreme Court's ruling showed the jury was misinformed on the law, potentially invalidating the conviction.Madigan's legal team plans to file motions related to the Snyder decision, while prosecutors maintain their original allegations. Even if some convictions are vacated, the government argues that other charges, such as falsifying records under the Foreign Corrupt Practices Act, are likely to stand. Former prosecutor Rachel Cannon noted that these additional charges might withstand the impact of the Snyder ruling.The Snyder decision might also influence other prosecutions connected to the Madigan scandal. Besides McClain, Jay Doherty, John Hooker, and Anne Pramaggiore were also convicted and await sentencing, which has been postponed pending the Supreme Court's decision. These cases underscore the significant legal repercussions following the high court's interpretation of bribery statutes. SCOTUS Bribery Ruling Offers Chance to Undo Illinois ConvictionsA California judge has granted Tesla more time to prepare its defense against a proposed class action alleging it overcharged customers for insurance. The case, overseen by Judge Michael Markman of Alameda Superior Court, now has a hearing scheduled for October 2025 to determine whether it will proceed as a class action. The lawsuit, filed on behalf of drivers in 11 states, accuses Tesla of inflating insurance premiums based on false crash warnings instead of actual driving behavior, violating California's unfair competition law and breaching contracts with drivers.Tesla's attorney, Min Kang, cited delays in gathering defense information due to the involvement of multiple states and the recent departure of a key Tesla employee. This personnel change has complicated the process, with Tesla in the midst of hiring a replacement.Tesla, which denies any wrongdoing, previously attempted to dismiss some claims but was unsuccessful. The company's insurance program bases premiums on a "safety score," factoring in vehicle data such as hard-braking and forward collision warning alerts. Plaintiffs argue these scores are unfairly increased by false warnings, raising their premiums. This lawsuit has drawn attention from state regulators and plaintiffs' lawyers, highlighting broader concerns about Tesla's insurance practices.Tesla gets more time to defend against driver class action over insurance | ReutersHarvard University has appointed Jennifer O'Connor as its new general counsel, effective July 29. O'Connor previously held senior roles at Northrop Grumman and the US Department of Defense. This move comes as Harvard faces scrutiny over its policies on antisemitism and calls from some students to sever financial ties with military contractors. O'Connor brings extensive experience from large, complex organizations and has served as general counsel for the Department of Defense and held roles in the White House Counsel's office. She is an alumna of Harvard College and earned her law degree from Georgetown.Interim President Alan Garber praised her experience, emphasizing her readiness to manage Harvard's legal strategy amid congressional probes and lawsuits related to campus antisemitism and the aftermath of Hamas's attack on Israel. O'Connor will also address issues related to Harvard's admissions policies after a recent Supreme Court defeat. Neil Eggleston, who worked with O'Connor during the Obama administration, highlighted her familiarity with Washington's political landscape, which will aid Harvard in navigating upcoming challenges.O'Connor succeeds Eileen Finan, who has served as interim general counsel since March 1, following the retirement of Diane Lopez. This appointment aims to stabilize Harvard's legal department and address ongoing campus controversies.Harvard Hires New Lawyer From Weapons Maker Northrop Grumman (1)Rudolph Giuliani's personal bankruptcy case is likely to be dismissed by a federal bankruptcy judge by the end of the week after nearly seven months of inactivity. Judge Sean Lane of the US Bankruptcy Court for the Southern District of New York indicated during a hearing that he is inclined to dismiss the case entirely, with a final ruling expected on Friday. This dismissal would leave Giuliani without court protection from creditors, to whom he owes over $150 million. Giuliani's lawyers have consented to the proposed dismissal.The bankruptcy case has been fraught with disputes over missed deadlines and transparency issues regarding Giuliani's financial affairs. Giuliani filed for bankruptcy in December, reporting $10.6 million in assets after a $148 million defamation judgment for false accusations against Georgia poll workers in the 2020 election. Wandrea' Arshaye “Shaye” Moss, one of the poll workers, sits on an official creditors' committee that has requested a trustee's appointment.If dismissed, creditors would return to civil court to recover debts, and Giuliani would face continued lawsuits that were paused by his Chapter 11 filing. Acker later worked in entertainment industry outreach for the Kerry/Edwards presidential campaign and as Deputy Campaign Manager for the Los Angeles mayoral campaign of City Councilman Bernard C. Parks. After that, she worked as the General Counsel of a company that manufactured emissions control products. Acker received her B.A. degree at Howard University in 1992, where she graduated summa cum laude and was a member of Phi Beta Kappa. She was awarded a Luard Scholarship for study at St. Anne's College at Oxford University and served there as the co-editor-in-chief of the Oxford University Women's Magazine. From our archives a very special guest, John Dean. For those of you who lived through Watergate, his name is synonymous with the political intrigue of the 1970's. Dean served as White House Counsel for President Richard Nixon from July 1970 until April 1973. In that position, he became deeply involved in events leading up to the Watergate burglaries and the subsequent scandal and cover-up. Referred to as the "master manipulator of the cover-up" by the FBI, Dean's testimony before the House was watched by some 80 million Americans. Granted immunity, Dean laid out in stunning detail and intricacy how the President not only knew about but orchestrated the break-in and burglary of the DNC. He ultimately was sentenced to one year in Federal Prison, but emerged from the experience as a changed and soulful individual. Dean renounced his former politics and started a second life as an author and speaker. He's penned five books about Watergate and 10 books in total; including his most recent tome, Authoritarian Nightmare: Trump and his Followers. On March 6, 2024, Just Security and the Reiss Center on Law and Security at NYU School of Law co-hosted an all-star panel of experts to discuss the issue of government “jawboning” – a practice of informal government efforts to persuade, or strong-arm, private platforms to change their content-moderation practices. Many aspects of jawboning remain unsettled but could come to a head later this month when the Supreme Court hears arguments in a case called Murthy v. Two years ago, at the start of the war in Ukraine, $300 billion in Russian assets were frozen in Western banks. The assumption behind Western economic pressure on Russia was that sanctions and seizures of oligarchs' funds would have a chilling effect on both Russia's economy and the pursuit of the war in Ukraine. They have not. As a result, for only the second time in history, the United States is considering seizing Russian assets. Congress, in the lead, has brought the Biden administration around. The President needs new authorities to move forward. But seizing the frozen $300 billion – only $5 billion of which is in the United States – and re-distributing it to Ukraine for reconstruction and other reparation efforts is fraught. Will the Euros go along? Will this radical change affect how states approach seizing aggressors' assets? Perhaps more importantly, is the Biden administration's signal of approval for the policy just talk, or will Washington finally pull together measures that hit Russia where it hurts?Stephen Rademaker, currently Senior of Counsel at Covington and Burling LLP, has wide-ranging experience working on national security issues in the White House, the State Department, and the U.S. Senate and House of Representatives. Serving as an Assistant Secretary of State from 2002 through 2006, he headed at various times three bureaus of the State Department, including the Bureau of Arms Control and the Bureau of International Security and Nonproliferation. A larger investigation into President Biden is now underway, led by two Republican chairmen who believe there may have been an attempt on his part to obstruct his son, Hunter Biden's, cooperation with the impeachment inquiry in the House. The leaders heading this investigation, Chairman of the Oversight Committee James Comer of Kentucky and Jim Jordan of Ohio, Chairman of the Judiciary Committee, are focused on a statement released by the White House that ostensibly indicates President Biden had foreknowledge of his son's intention to disregard congressional summons. A joint announcement by the chairmen shares their interpretation of the situation: 'Taking into account an official message from the White House corroborating that President Biden was aware beforehand that his son, Hunter Biden, planned on refusing two congressional summons, we feel obligated to analyze, as a part of our impeachment investigation, whether the President played a part in a scheme to hinder congressional proceedings.' Trump not only inadvertently confessed to fraud at his New York trial but also managed to repeat - on the record - that he has no idea what year this in, nor when his presidency ended. The first will cost him $250,000,000 in cash and all his New York properties. The second could cost him his bid to seize power in 2025. And it had better. You saw Trump's plan for a Special Prosecutor to attack anybody named Biden, and deliberately politicizing the Department of Justice, and this Project 2025 and Trump's White House Budget Director Russ Vought going on the record to say that TO politicize the DOJ quote “You don't need a statutory change at all, you need a mindset change. You need an attorney general and a White House Counsel's Office that don't view themselves as trying to protect the department from the president” which I think is even nastier sounding in the original Russian when Stalin devised it. Trump is convinced he made mistakes during his presidency and he won't repeat them and the foremost of those mistakes was NOT to install a military dictatorship. Quoting The Washington Post, his team of evils is "drafting plans to potentially invoke the Insurrection Act on his first day in office to allow him to deploy the military against civil demonstrations.” And the creature at the center of that plot is Jeffrey Clark, indicted in Georgia, unindicted co-conspirator in Washington, would-be Attorney General, the environmental lawyer who wants to turn the world over to the least pro-environment person on the dying planet. Clark devised the last-minute January 2021 plot for the DOJ to seize voting machines and when told that if Trump stayed in office there would be riots in every major city he answered “Well, that's why there's an insurrection act.” Just remember that by August 1934 Hitler re-shaped the entire judiciary of Germany so that every judge and prosecutor had to swear an oath TO HIM and apparently the total number of resignations was one guy, a prosecutor in Wuppertal and his name was Martin Gauger and he wound up fleeing to the Netherlands and the Nazis caught him and sent him to Buchenwald and he was dead by 1941 and Trump has a four-year head start on Hitler. And then there are the polls. I'd love if they looked differently. On the other hand, no incumbent president hasn't been underwater to an opposition opponent - real or generic - at this point in the timeline in decades. And amid the calls to dump Biden, who's your choice? Who else are you willing to bet democracy on? B-Block (26:12) IN SPORTS: Cubs double the all-time salary for a baseball manager to hire Craig Counsell away from the Brewers (and outbid the Mets for him). Lovely guy. Has managed his team to six playoff series and lost five times. Mea Culpa welcomes back a very special guest, John Dean. For those of you who lived through Watergate, his name is synonymous with the political intrigue of the 1970s. Dean served as White House Counsel for President Richard Nixon from July 1970 until April 1973. In that position, he became deeply involved in events leading up to the Watergate burglaries and the subsequent scandal and cover-up. Referred to as the "master manipulator of the cover-up" by the FBI, Dean's testimony before the House was watched by some 80 million Americans. Granted immunity, Dean laid out in stunning detail and intricacy how the President not only knew about but orchestrated the break-in and burglary of the DNC. He ultimately was sentenced to one year in Federal Prison but emerged from the experience as a changed and soulful individual. Dean renounced his former politics and started a second life as an author and speaker. He's penned five books about Watergate and 10 books in total; including his most recent tome, Authoritarian Nightmare: Trump and his Followers.
