Andrew Hinkes, partner at K&L Gates and adjunct professor at NYU, and Martin Koeppelman, co-founder of Gnosis, talk about the sanctions on Tornado Cash, how they will impact Ethereum on the base layer, and the likelihood of having two chains. Show highlights: the legal meaning of the OFAC sanctions on Tornado Cash and why it is causing complications how legislation is built for the fiat world, and how in DeFi and crypto there's no clarity how miners have changed their behavior prior to the Merge whether a proof of work chain or a proof of stake chain would be more censorship resistant whether laws apply to validators in a PoS chain the ways in which the government could provide more clarification the different entities involved in Proof of Stake the liabilities for each entity in PoS and what secondary liability is how the task of the bidder can be described as a mathematical optimization problem whether Lido is exposed to US regulations how long would it take for a large staker like Coinbase to stop being a validator how a user-activated soft fork works and the conditions in which a fork could happen whether social slashing is enforceable considering it is not in the protocol the likelihood of Ethereum becoming a permissioned system the role of Flashbots' relay code and what it means for Ethereum's censorship resistance how DeFi's exposure to US-based institutions can affect the likelihood of the chain complying with sanctions whether DAI is just wrapped USDC how MakerDAO is trying to be more independent of USDC why US-based companies will choose a conservative path, considering the lack of guidance the importance of educating the regulators how cash and crypto are the only remaining private payment methods Thank you to our sponsors! Ari Redbord, Head of Legal and Government Affairs at TRM Labs, talks about the sanctions on Tornado Cash, and the role of blockchain analytics tools in crypto. Show highlights: Ari's background as a federal prosecutor and his work for the US Treasury why regulators sanctioned Tornado Cash, according to Ari why the Ronin hack was important for regulators to start taking DeFi hacks more seriously the fact that for the first time the Treasury Department sanctioned software whether the Office of Foreign Assets Control (OFAC) messed up whether regulators understood the impact on regular users the role of TRM and blockchain analytics tools in mitigating risk how decentralized applications use tools like the ones provided by TRM to comply with regulations and to block addresses why, if Ari were a regulator, he would focus on regulation guidance whether the sanctions on Tornado Cash are unconstitutional what the future of privacy in crypto looks like and whether the government is going after privacy technologies Thank you to our sponsors! 1inch: https://1inch.io/ Crypto.com: https://crypto.onelink.me/J9Lg/unconfirmedcardearnfeb2021 Ari Twitter: https://twitter.com/ARedbord Tornado Cash Treasury Press release: https://home.treasury.gov/news/press-releases/jy0916#:~:text=WASHINGTON%20%E2%80%93%20Today%2C%20the%20U.S.%20Department,since%20its%20creation%20in%202019 Tornado Cash Sanctioned: https://www.coindesk.com/policy/2022/08/08/crypto-mixing-service-tornado-cash-blacklisted-by-us-treasury/ Developer arrested: https://www.fiod.nl/arrest-of-suspected-developer-of-tornado-cash/ TRM Labs blog post: https://www.trmlabs.com/post/how-defi-platforms-are-using-data-from-trm-labs-to-respond-to-tornado-cash-sanctions Tornado Cash post on compliance: https://tornado-cash.medium.com/tornado-cash-compliance-9abbf254a370 Coin Center's article authored by Jerry Brito and Peter Van Valkenburgh: https://www.coincenter.org/u-s-treasury-sanction-of-privacy-tools-places-sweeping-restrictions-on-all-americans/ Second Coin Center article authored by Jerry Brito and Peter Van Valkenburgh: https://www.coincenter.org/analysis-what-is-and-what-is-not-a-sanctionable-entity-in-the-tornado-cash-case/ Coin Center may challenge the US Treasury's decision to sanction Tornado Cash: https://decrypt.co/107475/coin-center-tornado-cash-ban-court Circle freezes USDC in sanctioned wallets: https://www.theblock.co/post/162172/circle-freezes-usdc-funds-in-tornado-cashs-us-treasury-sanctioned-wallets Crypto exchange dYdX blocked accounts that received funds from Tornado Cash: https://www.coindesk.com/business/2022/08/11/crypto-exchange-dydx-blocked-accounts-that-received-even-small-amounts-from-tornado-cash/ The possibility of forking Tornado Cash: https://www.coindesk.com/tech/2022/08/10/cloning-tornado-cash-would-be-easy-but-risky/ What the sanctions mean for privacy coins: https://www.coindesk.com/layer2/2022/08/09/what-the-tornado-cash-sanction-means-for-privacy-coins/ Tornado Cash laundered $1.5 billion, according to Elliptic: https://hub.elliptic.co/analysis/tornado-cash-mixer-sanctioned-after-laundering-over-1-5-billion/ Celebrities get Dusted: https://decrypt.co/es/107090/tornado-cash-dusts-public-wallets-jimmy-fallon-brian-armstrong-steve-aoki-logan-paul Previous Coverage of Unchained: Tornado Cash Sanctioned. This event is sold out. We will take walk-ins at the door if room becomes available. Cryptocurrency. Decentralized finance. Nonfungible tokens. Once only experts on the cutting edge of financial services were familiar with these terms. Now, with the emergence of digital assets within the global financial system, crypto, DeFi, and NFTs are becoming part of the mainstream financial services lexicon. The rapidly emerging crypto ecosystem faces uncertainty within a regulatory regime designed for very different institutions and securities. In response, on March 9, 2022, President Biden issued an executive order, “Ensuring Responsible Development of Digital Assets,” which ordered agencies to submit policy recommendations based upon multiple principles such as: providing consumer protection, ensuring U.S. financial system stability, mitigating systemic financial risk, responsibly developing digital assets, and examining the creation of a U.S. Central Bank Digital Currency (CBDC). Supporters of increased financial regulation over cryptocurrency see this as a necessity to provide security essential to ensuring financial stability and consumer protection within the digital asset space. Others view these federal regulatory efforts as a threat to future opportunities for economic innovation. SEC Commissioner Hester M. Peirce and an expert panel including Jerry Brito, Ryan Selkis, C. Todd Phillips, moderated by J.W. Verret, will address current and future efforts at regulation of cryptocurrency and its implications for innovation, financial stability, and consumer protection. Last week, the @WhiteHouse released its long-anticipated Executive Order on cryptocurrencies, marking the first time this administration explicitly highlighted the need to preserve innovation and competitiveness in the US. This Executive Order lays out a process for multiple agencies to write a framework around digital assets. This episode is an overview of the Executive Order, outlining the implications, pertinent sections, and reactions from thought leaders in the cryptolaw space. Here are links where you can read the full Executive Order and Fact-Sheet. Jake Chervinsky's (@jchervinsky) article on stablecoins. Highly recommend following Ryan Selkis (@twobitidiot), Congressman Tom Emmer (@RepTomEmmer) and Jerry Brito (@jerrybrito), whose insightful comments were mentioned throughout this episode. This "solo-pod" is my attempt to add value to the space by highlighting ongoing blockchain regulation across the world - with a focus on the legal implications. It's a work in progress and can only get better (right??). Would appreciate any feedback on this format @JacobRobinsonJD or by leaving a review. If you have suggestions for topics of future solo-pods, I'd love to hear that as well!

First, the Brief: Bank of America's research highlights the pros of El Salvador's bitcoin law Federal Reserve Governor Lael Brainard discusses the need for a U.S. CBDC Bank of China intends to continue significant pressure on crypto No sign of a slowdown in U.S. bitcoin mining industry Kentucky as the fifth state to stop BlockFi Lastly, a record week for NFTs and the emergence of a new institutional narrative Our main discussion centers on the ongoing battle surrounding a crypto provision within the highly debated infrastructure bill. The original language of the draft targeted crypto intermediaries, from hardware wallet manufacturers to miners, mandating that they report transactions made through their services. Doing so would be virtually impossible and hinder the U.S. crypto industry. In response, the community rallied for an updated bill with more forgiving standards. Crypto allies, from industry heavy hitters like Coin Center's Jerry Brito to Sen. Ron Wyden of Oregon, expressed their discontent with the original language of the draft. With an amendment process underway, will these statements be enough to make a significant change? Enjoying this content? A few weeks ago, Coinbase CEO, Brian Armstrong tweeted that Mnuchin was looking to 'rush out' new regulation before the end of President Trump's term in office. This regulation is not without opposition and Coin Center is addressing many concerns with the new rules and the method in which they are being passed. In this interview, I talk to Jerry Brito and Peter Van Valkenburgh, Coin Center Executive Director and Research Director. We discuss the implications of the new regulations, the key issues and what you can do to prevent them from passing.

Location: Skype Date: Monday, 27th January Project: Coin Center Role: Peter Van Valkenburgh & Jerry Brito Welcome to the Beginner's Guide to Bitcoin. Bitcoin can be intimidating for beginners. The protocol is complicated, the community can be aggressive and unforgiving, silly mistakes can lose you money, and it is easy to succumb to altcoin marketing. Bitcoin does though, offer you the opportunity to hold a new type of monetary asset, one which can't be seized by the government and is censorship resistance and It has the potential to change the way the world. The goal of What Bitcoin Did has always been about making things simple; there are no stupid questions, and the show is here to help beginners navigate this new world. To kick off 2020, we are launching a special series to help beginners understand Bitcoin. We will be looking at the basics from breaking down the protocol to explaining the economics and discussing the potential societal shift. Beginners Guide Part 8 - How is Bitcoin Legal with Peter Van Valkenburgh & Jerry Brito Bitcoin is still a relatively new technology. However, it is already a very real threat to government-issued fiat currencies and central banks. This has made regulating Bitcoin a tricky proposition for governments. China took a hard-line approach to this new asset class and in 2013, banned Bitcoin transactions, and in 2017, the government banned exchanges and ICOs. In Bolivia, there is a unilateral ban on all cryptocurrencies. Other countries have taken a far more progressive view of Bitcoin, embracing it, though often with caution. Most accepting has been Malta which has created the Malta Digital Innovation Authority; a government body brought in specifically for creating responsible crypto policy. While the regulatory landscape is complex and jurisdiction-specific, regulations tend to apply more aggressively to businesses in the space than users. These laws and regulations that Bitcoin businesses must comply with, however, still have an impact. For example; the majority of exchanges must follow AML/KYC rules which means when buying Bitcoin on an exchange you do give up your privacy. In Part 8 of the Bitcoin Beginner's Guide and to help explain and navigate the regulatory landscape I talk to Peter Van Valkenburgh & Jerry Britto, the Director of Research & Executive Director at Coin Center a non-profit focused on the policy issues for Bitcoin. We discuss the Bitcoin regulatory landscape and the implications to the users.

Recently the IRS issued its first Cryptocurrency Tax Guidance in 5 years. The crypto community has been hoping that this would help clarify taxes around things like hard forks and airdrops, but it seems that confusion persists: The IRS document reads: “If your cryptocurrency went through a hard fork, but you did not receive any new cryptocurrency, whether through an airdrop (a distribution of cryptocurrency to multiple taxpayers’ distributed ledger addresses) or some other kind of transfer, you don’t have taxable income.” Their language here suggests some confusion about the nature of airdrops and hard forks. Jerry Brito of Coin Center told CoinDesk last week: “One unfortunate consequence of this guidance is that third parties can now create tax reporting obligations for you by simply forking a network whose coins you own, or foisting on you an unwanted airdrop.” Crypto Lawyer Sasha Hodder joins me to talk about the guidance issued: none of this is tax advice btw! We cover things like the IRS' allowance for "first in, first out", which means that you can either identify specific units sold, or use a first in, first out method depending on which is more suitable for your situation. We will also talk about IRS specifically saying it would not create an exemption for transactions below a certain threshold, making day-to-day purchases in crypto difficult. In this panel, recorded at the Oslo Freedom Forum 2019, I moderated what an attendee described as a "lively" discussion on the relationship between finances and freedom with Bitcoin author and educator Jimmy Song; Alena Vranova, Head of Strategy at Casa; and Coin Center founder Jerry Brito. We talked about what it's like to live under a regime where people don’t have a lot of financial freedom, how the move to a cashless society is leading to a surveillance state, and how we're seeing the emergence of a corporate surveillance state. We talked about how cryptocurrency could bring us more financial freedom, how crypto is/should be regulated, privacy coins and the imminent Financial Action Task Forces rules that require crypto exchanges and other services send each other information on customers for each transaction. Plus, we discuss bad state actors using crypto. The full audio version of "The Case for Electronic Cash" by Jerry Brito. Abstract Cash is more than a method of payment. It is a fundamental tool for individual privacy and autonomy, and it is necessary for an open society. This paper shows that a cashless economy is a surveillance economy. It also argues that removing the option to freely transact without intermediation greatly limits our economic self-determination, placing our economic lives in the hands of financial institutions and governments. This paper presents several case studies demonstrating the dangers of a completely intermediated payments system and concludes that electronic cash is a tool that should not only be tolerated, but fostered and celebrated. The conclusion of The Case for Electronic Cash by Jerry Brito. Today we close out this amazing piece with the moral case for why we should not only refrain from demonizing and restricting digital cash, but we should foster and celebrate it! Blockchain and cryptocurrency experts discussed their 2019 policy priorities at a recent luncheon on Capitol Hill on March 15, 2019 hosted by the Technology Policy Institute in conjunction with the Blockchain Caucus. The conversation focused on stablecoins, privacy, and regulatory uncertainty. Blockchain 201: Policy Questions for 2019, 12:30 – 2:00 PM, Capitol Visitors Center, First Street, NE, CVC – Congressional Meeting Room North (CVC 268), Washington, DC 20515. As firms continue investing in blockchain, which has endured its first boom-bust cycle, policymakers are considering whether and how to regulate this new technology. In this panel, we will discuss whether policymakers are speeding or slowing the rollout of blockchain and what Congress can do to encourage innovation and protect consumers. For private blockchains, are policies supporting continued investment in auditability, interbank settlement networks, and supply chain safety? For public blockchains, such as Ethereum and Bitcoin, will open protocols usher in new innovations in networked communications, or might the technology fail to gain traction? Should light-touch regulation, if any, apply to crypto-asset markets? Join us for a lively discussion about what Congress should consider as it seeks to make policy. This lunch event is in conjunction with the Blockchain Caucus. Speakers include: Jerry Brito, Executive Director, Coin Center, Daniel Gorfine, Chief Innovation Officer and Director of LabCFTC, Mark O’Riley, Technology Policy Counsel, International Business Machines, Diego Zuluaga, Policy Analyst, Center for Monetary and Financial Alternatives, Cato Institute, Sarah Oh (moderator), Senior Fellow, Technology Policy Institute

Researchers at George Mason University's Mercatus Center recently launched a website, PiracyData.org, to determine whether or not there are legal alternatives for viewing the world's most pirated movies. Drawing upon TorrentFreak's weekly list of the 10 most pirated movies, the researchers will quantify the validity -- or invalidity -- of copyright holders' claims that pirates are thieving material that is indeed available elsewhere, as well as claims that search engines like Google should quit linking to pirated content. In this TechNewsWorld podcast, we are joined by Jerry Brito, a research fellow at the Mercatus Center and a cofounder of the site.
