Bruce Praet is a well-known name in law enforcement, especially across California. He co-founded a company called Lexipol that contracts with more than 95% of police departments in the state and offers its clients trainings and ready-made policies.In one of Praet's training webinars, posted online, he offers a piece of advice that policing experts have called inhumane. It's aimed at protecting officers and their departments from lawsuits.After police kill someone, they are supposed to notify the family. Praet advises officers to use that interaction as an opportunity. Instead of delivering the news of the death immediately, he suggests first asking about the person who was killed to get as much information as possible. Reporter Brian Howey started looking into this advice when he was with the Investigative Reporting Program at UC Berkeley's Graduate School of Journalism. He found that officers have been using this tactic across California, and the information families disclosed before they knew their relative was killed affected their lawsuits later. In this hour, Howey interviews families that have been on the receiving end of this controversial policing tactic, explaining their experience and the lasting impact. Howey travels to Santa Ana, where he meets a City Council member leading an effort to end Lexipol's contract in his city. Brian Howey is a freelance journalist who won the Polk Award for Justice Reporting after exposing a deceptive police tactic widely used in California. He began the project, which was eventually published by the Los Angeles Times and Reveal, as a graduate student in the UC Berkeley Graduate School of Journalism. “It's one thing to hear about this tactic and hear about parents being questioned in this way. It's another thing entirely to hear the change in a parent's voice when they realize for the past 20 minutes they've been speaking ill of a relative who's actually been dead the entire time, and to hear that wave of grief and sometimes that feeling of betrayal that cropped up in their voice and how the way that they spoke to the officers afterwards changed.” This is the fourth in a week-long series of conversations with winners of this year's George Polk Awards in Journalism. Bruce Praet is a well-known name in law enforcement, especially across California. He co-founded a company called Lexipol that contracts with more than 95% of police departments in the state and offers its clients trainings and ready-made policies. In one of Praet's training webinars, posted online, he offers a piece of advice that policing experts have called inhumane. It's aimed at protecting officers and their departments from lawsuits. After police kill someone, they are supposed to notify the family. Praet advises officers to use that interaction as an opportunity. Instead of delivering the news of the death immediately, he suggests first asking about the person who was killed to get as much information as possible.  Reporter Brian Howey started looking into this advice when he was with the Investigative Reporting Program at UC Berkeley's Graduate School of Journalism. He found that officers have been using this tactic across California, and the information families disclosed before they knew their relative was killed affected their lawsuits later. In this hour, Howey interviews families that have been on the receiving end of this controversial policing tactic, explaining their experience and the lasting impact. Howey travels to Santa Ana, where he meets a City Council member leading an effort to end Lexipol's contract in his city. The two SEC commissioners, Hester Peirce and Mark Uyeda, who dissented from the agency's decision to charge Impact Theory, argued that the SEC's application of the Howey test was too broad. The Howey test is a legal framework used to determine whether an investment contract is a security. The test has four parts:There is an investment of money.The investment is in a common enterprise.There is a reasonable expectation of profits to be derived from the efforts of others.The profits are to be derived from the efforts of a promoter or other third party, rather than from the investor's own efforts.The SEC argued that Impact Theory's NFTs met all four parts of the Howey test. The company raised money from investors, who were promised a share of the profits from Impact Theory's business. The profits were to be derived from the efforts of Impact Theory's team, not from the investors themselves.However, Peirce and Uyeda argued that the SEC's interpretation of the Howey test was too broad. They pointed out that the NFTs in question did not give investors any ownership rights in Impact Theory. The NFTs were simply digital collectibles that gave investors access to certain benefits, such as early access to Impact Theory's content.Peirce and Uyeda also argued that the SEC's decision to charge Impact Theory set a bad precedent for future NFT offerings. They warned that the SEC's broad interpretation of the Howey test could discourage innovation in the NFT space.The SEC's decision to charge Impact Theory is the first time that the agency has brought an enforcement action against an NFT issuer. It is likely that the SEC will continue to scrutinize NFT offerings in the future. The dissent from Peirce and Uyeda suggests that the SEC's approach to regulating NFTs is likely to be challenged in court.Here are some additional thoughts on the SEC's decision to charge Impact Theory:The decision is a sign that the SEC is taking NFTs seriously and is willing to regulate them.The decision could have a chilling effect on the NFT market, as companies may be hesitant to offer NFTs if they fear being sued by the SEC.The decision could also lead to more litigation, as companies challenge the SEC's interpretation of the Howey test.It remains to be seen how the SEC's decision will affect the NFT market. However, it is clear that the SEC is taking a close look at NFTs and is willing to regulate them if necessary.

The court stated that XRP sales in which buyers directly purchased from Ripple constituted sales of securities, amounting to $728 million. The court concluded that Ripple's Programmatic Sales of XRP did not constitute the offer and sale of investment contracts. However, the individual defendants, Garlinghouse and Larsen, will proceed to trial. The court considered the economic reality and totality of circumstances to determine whether the Howey Test was satisfied. The order does not address secondary market sales, implying that most XRP tokens already in circulation are not considered securities.
