The case was decided on January 21, 2025. Brenda Andrew was convicted by an Oklahoma jury of murdering her husband, Rob Andrew, and was sentenced to death. During her trial, the prosecution introduced extensive evidence about her sex life and personal failings, which was later conceded to be irrelevant. Andrew argued in a federal habeas petition that this evidence was so prejudicial it violated the Due Process Clause. The Oklahoma Court of Criminal Appeals (OCCA) upheld her conviction, finding some of the evidence about her extramarital affairs relevant but acknowledging that much of the other evidence was irrelevant. Despite this, the OCCA deemed the errors harmless. Two judges dissented, arguing that the prejudicial evidence undermined the fairness of the trial. In federal court, the District Court denied relief, and the Tenth Circuit Court of Appeals affirmed, stating that Andrew failed to cite clearly established federal law. The Tenth Circuit majority acknowledged the precedent set by Payne v Tennessee but dismissed it as a pronouncement rather than a holding. Judge Bacharach dissented, arguing that the prejudicial evidence deprived Andrew of a fair trial. The Supreme Court of the United States reviewed the case and held that the Tenth Circuit erred in its interpretation. The Court clarified that Payne established that the Due Process Clause can protect against the introduction of unduly prejudicial evidence that renders a trial fundamentally unfair. The Court vacated the Tenth Circuit's judgment and remanded the case for further proceedings to determine if the trial court's admission of irrelevant evidence was so prejudicial as to render Andrew's trial fundamentally unfair. Rob Andrew is probably best known as the prodigious point scorer kicking goals for England, when he played fly-half as part of Will Carling's team of the late 80s and 1990s. He tells us about how rugby was an amateur game back then and how even top players had to juggle playing international rugby with holding down a day job. But before all that, Rob won Cambridge Blues at university in both rugby and cricket, even scoring a first class century against Nottinghamshire, then getting a call up to play rugby for England in his final year at uni. His glittering rugby career over, Rob is now CEO at Sussex CCC and we talked to him just as Covid restrictions were being lifted in the summer of 2020. We looked at the prospects for Sussex, especially in the T20 Blast and he also spoke of his involvement with the Lord's Taverners.

Round Four of the Six Nations ended with decisive victory for England at Twickenham, Wales taking one step closer to Grand Slam glory, and Ireland stepping it up against France who went AWOL again. With Brian Moore this week is the former England fly half Rob Andrew. After England's resounding win over Italy Brian and Rob discuss the merits of having Ben Te'o, Manu Tuilagi, and Joe Cokanasiga all playing, Jamie George's 20 metre pass, and whether England have now over-kicked with the forwards getting involved too. Rob also states that this has not been a compelling tournament with only two matches being a contest. Former Wales flanker Martyn Williams joins to discuss whether the Grand Slam will happen saying it will be an anticlimax if it doesn't and he believes Cardiff will be the difference come Saturday. They also put forward the importance of this being the last Six Nations match for both Warren Gatland and Joe Schmidt. Speaking of Joe Schmidt, we get an Irish perspective from former prop Paul Wallace after their bonus point win over France. With many saying Ireland have their mojo back Paul is reluctant to agree as he remains concerned about their conversion rate. As for Scotland they are once again ravaged by injury, but former Scotland back rower Ally Hogg is remaining positive about the tournament saying they can always muster something against the English. The second round of the Six Nations has come and gone with England backing up a stellar performance in Ireland with a resounding victory over hapless France, the Welsh second string ground out a win away in Italy, whilst Scotland are yet again left to rue their missed opportunities against Ireland. Alongside Brian Moore to discuss it all is the former England and Lions fly half Rob Andrew. Brian and Rob discuss the way England were able to capitalise on French confusion to secure victory in half an hour at Twickenham saying that England showed how athletic they are across the pitch. Up to Scotland who blamed the referee on the day but really only had themselves to look to for not providing more of a competitive match for Ireland. Their flanker John Barclay joins to say it was a frustrating game but if they can get everyone fit again then they are a match for any side. As for the winning side, Ireland, former centre Paddy Wallace says the weight of expectation is causing problems for his old team and the loss to England may well have been a blessing in disguise. Wales are England's next opponents but the question mark over them is who to start at half back following an unconvincing performance by Dan Bigger over Italy. We ask former fly half James Hook for his thoughts on Wales' squad selections and how they can defeat England. We also speak with referee Nigel Owens on the laws pertaining to "advantage" and "penalty tries", plus a word with Maggie Alphonsi on the Women's Six Nations.

I loved the challenge to #BeatTheGame and loved that tummy churning exciting feeling the night before the game and the hours after the game that I would analyse the game over and over before drifting off the sleep. As I stumbled from builder’s apprentice, through to insurance clerk and then onto printing, I finally found my calling (thanks to a drunk Danny Hodgson!) as Northumberland YDO…a job that I loved and that taught me so much. It was then onto Newcastle Falcons and my dream job of coaching the finest players from the North East in the Academy... Academy Director followed and the first opportunity to work with my great friend Peter Walton. I then got elevated to the first team (with Walts) to replace Rob Andrew who had moved to Twickenham. A steep and enjoyable learning curve that ended in the valuable lesson of a sacking… an environment where I was told to make the players hate you was clearly not the environment for me. Next adventure was down to the RFU to work with Stuart Lancaster (still the best boss that I have ever had!). We plotted the direction of travel over copious amounts of Yorkshire tea at Scotch Corner Services and then I worked tirelessly developing a great Performance Pathway and a team of fantastic people.
